Members present were: Spitzer, Johxsox, Ehret, Leroux, Peloquix and Rosexqui.st. Also present were Bill Schwab, City Planning Coxsultaxt, aid Irene Leroux, City Council Member. Motion made by Spitzer, seconded by Peloquix, to approve minutes of the April 24, 1974 meeting after the name Machmeier was spelled correctly. Motion carried. FISHER CONSTRUCTION COMPANY Motion made by Peloquix to table the matter of the Fisher Construction Company Miiixg Permit renewal and as request ins p ee- q p tion report from the City Exgiieer and a report from the City Clerk ox whether there are a.iy complaints against the Fisher Coxstructiox Company. Motion carried uxaximously. SIEMENS-HOLTEN-ANDERSON MINIATURE GOLF COURSE Mr. Ehret read the Special Use Permit application for a miniature golf course on the vacant lot behind the Hugo MW. A site plan and parking facilities layout were submitted. The Plainiig Commission checked the zoning map to see what this property is zoned. It was zoned commercial. Mr. Gruber stated that he already had a com- plaint against the A&W because he had to pick-up their papers on a windy day. The Planning Commission requested they provide information on maximum parking capacity, sanitary requirements and lighting requirements. Mrs. Anderson stated that they had discussed purchasing a lot in the back from Mrs. Coil. The closest a person would be wondering near the property lines would be approximately 8 feet. Motion made by Spitzer, seconded by Rosenquist, that a public hearing be set on this Special Use Permit for June 11, 1974 at 7:30 P.M. ; that the property owners be notified and the applicants be instructed to make their presentation and resolve the questions of lighting, sanitary services, parking and fencing be answered at that time. Members for: Leroux, Peloquin, Ehret, Spitzer, Rosenquist and Johnson. Motion carried unanimously. Johnson suggested that they consider taller trees on the back side. CHURCH OF ST. JOHNS Father Fortin represented the Church of St. John. Ehret read the application for a Special Use Permit to build a pole type shed to be used only during the horse show. Father Fortin described on the City map the location of the proposed site for the building. It would be located approximately 30-35 feet from Egg Lake. It will be a flat top building and will only be used during the 4 days of the horse show. Father Fortin was told that every Special Use Permit request re- quires a site plan defining property lines and location of other buildings. Mr. Schwab said that they would be required to get a permit from the PCA and prove to them that manure will be disposed of at least 100' away from the lake, and that adequate control of runoff will be taken care of. Motion made by Spitzer, seconded by Leroux, that this Special Use Permit as requested, be approved subject to the following conditions: 1. PCA approval shall be obtained. 2. Site Plan be submitted to the Planning Commission and City Council. 3. Special Use Permit indicate that the use of this building for stabling of livestock be restricted to not more than 7 days consequatively a year. -3- Members fors Leroux, Peloquiu, Ehret, Spitzer, Roseuquist and Johnson. Motion carried unanimously. DON ALBRIGHT - VARIANCE Mr. Ehret read Mr. Albright' s application for a variance to erect a garage and read the ordinance regarding variances. Mr. Albright stated that his neighbor, Ken. Lindstrom, did not object to this addition, and that it would not be practical for Mr. Lindstrom to Add onto his house on this side. . Mr. Schwab felt that this variance should not be approved because the bare minimum setback if it is only a garage be 5' with a 2' overhang; if a house is to be constructed, that the 5' setback be from the house overhang. This is for safety reasons, primarily fire. The application for a variance wasn' t just for a garage but also for an addition to the house over the garage. Mr. Albright said this has been something thats been planned for a long time and just has been delayed. He has been using this area for a driveway and parking his car. Motion made by Johnson, seconded by Leroux, recommending denial for a request for a variance. Members for: Leroux, Peloquin, Ehret, Spitzer, Roseuquist and Johnson. Motion carried unanimously. DON TAUER - SPECIAL USE PERMIT Mr. Ehret read a letter from LaValle Excavating Company regarding the sewer system they installed at the Tauer residence. They in- stalled a 1250 gallon septic tank and a 1250 gallon holding tank which has a pump which pumps the liquid into a drain field. The drain field consists of four lines 60' long which run out to a bed type area 8' wide x 75' long, with 2' of rock under the perforated pipe and 6" of rock above the pipe. Mr. Ehret also read a letter from Mr. Ernest Kluegel, building inspector, who inspected the residence to determine if it conformed to the 1973 Uniform Building Code requirements as to light and venti- lation. These requirements were found to be adequate. Mr. Schwab asked Mr. Tauer if he knew what the percolation rate is. Mr. Tauer said that it was sandy clay soil and percolation tests were not done. There are eight people living in the house, six upstairs and two in the rented apartment. Mr. Spitzer asked how they could limit the amount of people to two in the apartment? Mr. Tauer said he had checked with his attorney and they would beable to limit it to two by a lease and that it was enforceable. 4 Mr. Schwab said that perk tests should be made and submitted to his office and that someone from his office would go out and check it. He also felt that we should hold a public:=hearing. Mr. Burkard stated that the Fire Chief had inspected the house. Motion made by Spitzer, seconded by Johnson, that the Tauer Special Use Permit application be tabled and that the following action be taken: 1. Percolation tests be made on the site of sewer system under the direction of the Planning Coordinator' s Office aid the results be submitted to the Planning Commission no later than June 4th. 2. That the Fire Chief be requested by the Planning Commission secretary to provide a report on a fire safety inspection of the subject building. 3. A public hearing be scheduled for 8:00 P.M. on June 11th. That a notice be published ix the official news paper and adjacent property owners be notified. Members for: Leroux, Peloquin, Ehret, Spitzer, Rosenquist and Johnson. Motion carried unanimously. . JUNE SMITH - DAY CARE CENTER Ix the original Special Use Permit request it was found that the present sewer system was 'inadequate and the Smith' s were required to add additional septic task and drain field. Mrs. Smith said this was a hardship at this time but planned to put ix additional sewer system within nine months and would like to limit the number of children to ten until the additional sewer system is installed. Motion made by Spitzer, seconded by Peloquin, recommending approval of this Special Use Permit with the following conditions. 1. A current copy of the license for a child care center be on file with the City Clerk. 2. The present sewer disposal drainfield system be expanded by September 1, 1975 by adding an additional 1000 gallon septic task ix series with the existing tank and two additional drain- field lines be added, each one being ?5 feet ill length placed in trenches 24 inches wide. 3. This special use permit shall be null and void if at any time these facilities do not have a current license from the State Public Welfare Office for the operation of a child or day care center. • • • -5- 4. Prior to starting the day care center operation, the owner shall meet with the City Building Inspector to make sure the structure meets all requirements of the State Building Code. 5. The owner shall provide at least five (5) off-street parking spaces. 6. Not less than".two, 2-A rated ABC type portable fire extin- guishers must be provided within the home, one on the upper level in the kitchen and one en the lower level outside the furnace room. 7. Provided at least one product of combustion fire alarm detector for the lower level, to be installed as per manufacturers require- ments. equire- ments. 8. Install not less than two automatic sprinkler4heads within the furnace room. The door opening into this room must also be equipped with a door hook so as to keep the children from entering freely. 9. Fireplace on lower level not to be used during the hours Day Care Center is in service. 10. The Fire Department emergency number must be posted on all telephones within the home. Supervisory personnel must be familiar with the necessary procedures in case of an emergency. 11. Playground area shall be fenced. 12. The maximum number of children permitted to be enrolled in the day care center shall be ten until the sewer system expansion is effective. 13. This Special Use Permit shall be reviewed when the sewer systen, expansion is completed on or before September 1, 1975, which ever occurs first. LEN HOAOK - JUNK YARD RENEWAL Mr. Ehret read the Inventory & Evaluation report for Len's Auto Junk Yard. Mr. Burkard was asked if he had any complaints on this dunk yard and he stated no. Mr. Spitzer suggested that an inspection group go to theunk � yards and make an on-site inspection before any decision is made. Motion made by Spitzer, seconded by Leroux, to table this Junk Yard Renewal mot to exceed 60 days. Motion carried. -- -6- A BIESANG - MINOR SUBDIVISION A Variance was recommended for approval by the Planning Commission on April 9, 1974, subject to submission of proof of ownership of property and the proper recording of the necessary easement of the private road. The Village Council directed Mr. Biesang to go through a minor subdivision. Mr. Biesang was told to talk to the City Engineer and Planning Coordinator and fill out an application for what they really need. Spitzer - let the records show that the request was inappropriate. GRUNDROFFER CONSTRUCTION COMPANY Mr. Ehret read the application for a Special Use Permit to construct two 40'X100' buildings for rental purposes. The buildings will be concrete block with two units per building. The Planning Commission requested a proposed layout of the whole area. They will also need the following: Percolation tests and soil borings for all five lots, proof of ownership, what t tey'll rent the buildings for, site plan which includes adjacent laid owners, and furnish names of property owners for a public hearing. Motion made by Spitzer, to table the Special Use Permit and a public hearing be scheduled for 7:30 P.M. June 26th and that it be published in the official news paper and the applicants furnish names of all adjacent property owners and they be notified; that a site plan for adjacent property owners be furnished and percolation tests and soil borings be furnished. Motion carried unanimously. Motion made by Spitzer, seconded by Leroux, that we omit the second meeting in May. Motion carried. Motion made by Spitzer to adjourn meeting at 11:45 P.M. Motion carried.
