HomeMy WebLinkAbout1974.06.11 PC Minutes MINUTES OF PROCEEDINGS OF THE`HUGOPLANNING COMMISSION • JUNE 11, 1974 PUBLIC HEARING - MINIATURE GOLF COURSE Vile public hearing was opened at 7:40 P.M. by Ohairaan Larry Ehret. Mr. Ehret read the public bearing notice published in the Forest Lake Times. He also read a letter submitted from the owners of the Hugo A & W which listed their proposed lighting plan. The plan is as follows: 1. 6 poles 30 feet in height - quartze lights 4' poles need 4 fixtures each with:11500 watts/fixture. 1 pole needs 2 fixtures with 1500 watts per fixture. , 1 pole needs 3 fixtures with 1500 watts per fixture. 2. Slant of fixtures will be aimed at the playing area. . 3. Diameter of the poles is 7 inches. 4. The higher the pole is, the more the fixture cam be slanted ' toward the playing area so that the light-glare is not aimed at 'the resident' s homes. A letter was submitted 'from Howard Kuusisto the City Engineer. • David. Rirsobt from the David A, Kirscht Assoc. , Inc. , Landscape Architects gave an explanation of :what is being proposed. - 17 parking. spaces in the miniature golf course area and a total of '33 spaces-all together. - Six foot high redwood fence along back side and 16 feet along the north and south sides. The remaining area will be enclosed with chain link fence. A honeysuckle hedge will be planted along the back side and will grow to a height of 10 feet. - Hours Early aid late season 9:30 P.M. Week nights' 9040 and 11:00 P.M. on weekends. June - August 10:00 week sights and 11:00 P.M. on weekends. Traffic will be directed all in one direction. The meeting was °pened'to the public for comment. Greg Gruber - 14918 Foxhill Mr. Gruber -had a contour map which showed the backshadows from street lights and said the'backshadows from the . miniature golf course. would be 50 feet. Mr. Kirscht explained that this was different type of lighting and it will be directed onto the course and- the overspill wouldn't be that great. Susan Hunt-14770 FoxHill - Ars. Hunt wanted- to know what kind of maintenance and guards they plan on having. Mr. Kirscht stated that this hadn't been determined. • •2- Louis Charpeatier Mr. Charpentier complained about the back- splash of the hockey rink. Mr. Kirscht said there is considerable increase- with snow cover and the reflectors might be different. The miniature golf course will be opened during the summer hours when the daylight hours are longer. Dr. Chapman - 12833 Goodview -- Dr. Chapman stated that there was no drainage plan, rest-room facilities or traffic survey. Mr. Kirscht explained that he didn't realize there was a problem and that they will work out a draiaageAplaa. In regards to restroom facilities, they have contacted the State Departmsat` of Health - Hotel, Motel and Restaurant Division and they will come out and check out the facilities. There is one restroom sad room for another. The traffic will be very inter- mittent, not any more than an- intersection in Hugo. Dr. Chapman.waated to go on record as apposed to this plan because of inadequate drainage plan, lighting plan, traffic nuisance and lighting nuisance. Until such time as this data is provided it should not be granted. No name = Wanted to know if there was another way of lighting other than 30' poles. Mr. Kirscht stated that there was less°spill from - 30' poles than shorter poles. Someone stated that'4they checked and were told that:lights-shine onto their property and devalues their prepertyj they could take them to court. • Carl Christiane•n - Mr. Christianson wasted to know what they were going to do for bug control - lights =would draw a- lot of bugs.. Nothing was contemplated. Bill Schwab Wanted to know about maintenance of the 6' fence. Mr. Kirscht said the fence could be moved two or three feet so the backside : . could be maintained. Jerry Gunderson - Mr. Guaders'on stated that he felt that all objections were valid and the Planning Commission should take this into consideration; He also stated that water is a great problem. Mr. Kirscht said he could - channel the water with grading. William Beaman 14749 Foxhill - Mr. Beaman wanted to know if this would devalue their properties. This could not be answered at this time.' Dr. Chapman - Dr. Chapman wanted to know if they would be willing to - limit their hours' to 9:30 all week long? Were they planning to be open • until 11:00 oa Sunday. evening. They will only be open until 11:00 on Friday and Saturday sight. Dr. Chapman wanted a show of hands who objected to the miniature golf course. The Commission stated that-this was not .a proper action. Public hearing was closed at 8:35 P.M. r • .3 PUBLIC HEARING - DONALD TAUER " Mr." Ehret read the public hearing notice published in the Forest Lake Times. Mr. Ehret read letter from- Robert Olson., Ingersoll Avenue. No. Mr. Olson was apposed to multiple dwellings and objected . to sewer, fire and parking facilities. • Kenneth Rolander, Attorney for Mr. Tauers . explained Mr. .Tauer's situ • ation. Mr. Rolanderexplained that he tried to contact Mr. Schwab on several occastaas and could not reach him to inspect" the percu lativn -testas request at the last- meeting. Mr. Rolander emplained thatthe sewer system was installed .for ten or nore people. As .to the letter submitted by Mr. Olsol, ,he felt that he was misinformed. Mr. Granger, Fire Chief, 'has not submitted hie report en his inspection of the Tauer residence. . Thomas Crever,.,- Mr. Crever apposed to this apartment. . He stated that there were 9 homes with walkout basements and this would sit a press-' deuce. • • Ronald Reichstadt 12768 Trish Avenue No. - Mr. Reichstadt: wanted to know what procedure to follow so he could put in an apartment in tie basement.. He obtained a Special Use Permit application from the City Clerk. Theodora Peltier - `'Mrs. Peltier wanted to know how many rooms were in the apartment. Mr. Tauer stated that there were two - one 13x36 and another 10x30'6. • Howard Schletty - Mr. Schletty wanted to know how many people would. be living in the apartment. The answer was two. Thomas Crever - Mr. Crever asked if the stairway had been closed off. The answer was yes... Mrs. Thomas. Craver - Mrs. Crever said that the sewer system should be checked . out. - They had problems with a single family.. IIte.Rilaanderdsaid that this` was an elaborate system and that Mr. Tauer..had checked with • the` University 'of Minnesota and that it was engineered by them`. • Public hearing ..closed at- 8:55 P.M. • The Meeting was called to order at 8:55 P.M. by Bhairman Larry Ehret. _, ' Members present were Schletty,': Spitzer, Johnson, Ehret and Peloquin. Also present were Bill Schwab,=`.City Planning Consultant, and Irene Leroux, City Council Member. • • Motion lade by Spitzer, seconded by Peloquin, to dispense with the 'reading and approve the minutes of the May 14 ,meeting. DONALD T&U3R - SPECIAL -USE PERMIT Mr.` Spitzer stated that it was still necessary to conduct a percula- ...tiez test. • Motion made by Spitzer, seconded by Schletty, to table the matter of .the Tauer Special Use Permit and that'he bring his test in the first . :meeting. of July - July 9th. .. Members for: Schletty,_ Peloquin, Ehret, Spitzer, and Johnson. Motion carried: • • MINIATURE GOLF COURSE . Mr. Hirscht was told that they would need a_ total drainage plan and that he should ;contact the City engineer. The commission also required :additional lighting data. Mr. Peloquim said that he would require two separate bathrooms. M . Hirscht was also told to pull the easterly eaoe :.back two feet so they would; be able to maintain the fence and the area .:behind. the Tense. . They 'were told to submit a proposal to. the Rice Creek Watershed on the drainage. Motion made by Spitzer, seconded by Johnson, that the matter 'of the . A&W Miniature Golf Course be tabled until the .9th of July and the applicantsbring data at that time as outlined at the public hearing. Members for: Schletty, Peloquin, Ehret, Spitzer and Johnson. Motion carried. Motion madó .b7-Spitzer, seconded by Peloquim, that the secretary be instructed to ask the City Attorney to attend the meeting of July 9th for. the purpose of -drafting Special Use-Permit contracts and - _ conditions. . Motion carried. • ROBERT•RICCI. .- VARIANCE Robert Burkard read the minutes of March 18th Council Meeting.. Mr. Ricci :was. told to file an application for a variance along with a . site plan to show property lines and parking. MARVIN .RBHBEIN CONSTRUCTION • Ehret read report from Kuusisto.regardimg mining permits and .special use permits for the following properties: Joe Gregoire, Jerry 'Riopel, Eugene LaCasse and Lavine Duraine, A public hearing is required`:.on all new mining permit .applications. If they want a variance from the -hours, they' should ,put it ikethe application. R. -5- Motion made by Spitzer, seconded by Johnson, to set a public hearing for the Rehbein Construction Company for June 26th at 8:00 P.M, The secretary request.. the:_City Attorney. and City Engineer be present at 'this meeting. Motion carried. ED WAUGH - TRAEGER/S ADDITION PLAT .'2: Ehret read application for subdivision. A discussion was held on the corner lot. Schwab stated that he felt that Lot 1 should be andoutlet and a grading plan will be required for Lot 8. Mr. Waugh was told he-would. have to contact the City engineer and the Ride Creek Watershed.'.. Motion made by Spitzer, seconded by Pelagian, to schedule a public hearing for July 24th and put Mr. Waugh on the agenda -for July 9th for further review. Notion carried. JIM OLSON - SPECIAL USE PERMIT & MINOR SUBDIVISION . Mr. Ehret read the application fora Special Use Permit to construct a Machine Shop and an application for a .minor subdivision. Motion made by Spitzer, seconded by Johnson, that a minor subdivision - be granted to Vern Peloquin and Peloquin Industrial Park to "sell the lot according' t.o the legal description (SW* of SE}, - S.ed. 17, Township '31, Range 21) subject to the..following conditions: The 152nd Street be extended 175 - and be brought up to grade. Members for: Schletty, Peloquin abstained, Ehret, Spitzer and Johnson. Motion carried.. • ' - Motion made by Spitzer that the Planning Commission notify' Vern• Peloquin that no further action in the Peloquin Park will be acted upon until the final plan is filed with the City Clerk' :Motion carried. Peloquin abstained. ' SPECIAL USE PERMIT Theapplication was changed to read to build and operate a machine shop. Percolation tests were done. There, are presently 7 people and he would not object to restricting:, the people to 12 people. . Motion made by Spitzer, - seconded by Johnson, to recommendapproval of the Special Use Permit as requested subject to the following . ' condition:a 1. Premises shall be used for Machine Shop operation. 2. Maximum number of employees shall not exceed 12 Unless municipal . sanitary sewer is available. 3.
