Grundhoffer - McCullou:h - Public Hearin:
The public hearing was opened at 7:40 P.M. by Chairman Ehret.
Mr. Ehret read the public hearing notice published in the Forest
Lake Times.
A site plan and soil borings were submitted by the applicants.
A discussion was held on the road easements for the proposed road
on the site plan.
Mr. Chapman - Goodview - Mr. Chapman felt that the property owners
were not properly notified and that it wasn' t a Planning Commission
function to discuss road easements when the request was for a Special
Use Permit.
The applicants were upset because they were not told to get signatures
of adjoining property owners for the road easements.
Public Hearing was closed at 8:15 P.M.
Marvin Rehbein Construction - Public Hearin
Mr. Ehret read the Public Hearing notice published in the Forest Lake
Times and also a report submitted from the Planning Coordinator.
Peloquin asked the City Attorney i,.f a letter of credit was faster
to obtain than a bond. Mr. Johnson said yea and he suggested that
they require a letter of credit and a bond for a backup. Peloquin
felt the bond was to small for the maintenance of the haul routes.
Mr. Chapman - Goodview - Mr. Chapman objected to more gravel pits in
Hugo - Irish Avenue already has a lot of traffic - No limit of time
for traffic to take place. Gravel pits are dangerous for children
and gravel pits should be completely fenced. Mr. Chapman was told
that time limits and fencing were covered by City Ordinances.
Owner North Oaks Kennels - 15939 Ingersoll Ave - Mr. Wanderlio stated
that he has had bad experience in the past with gravel trucks kicking
gravel off the road and not putting it back and causing a lot of dust.
Wanted to know if the roads would be oiled in front of the homes.
He would like to see stipulations on the drive$ as to speed. Mr.
Kuusisto said they do not want dust to be a problem and they will watch
the contractor closely. Mr. Johnson suggested that they put the
speed control as a condition.
Mr. Chapman - Goodview - Mr. Chapman said there was no stipulation
as to when the land has to be restored. He was told that it was
stuplated as September 30, 1975.

Tony Niemczyk - Mr. Neimczyk said he already had a complaint against
the contractor because there was a seven foot ditch in front of his
brothers property and there was no access in or out. He was told
to contact the County Engineer.

The meeting was called to order at 9:02 P.M. by Chairman Larry Ehret.
Members present were: Spitzer, Ehret, Peloquin and Leroux. Also
present were Irene Leroux, City Council Member, and Bill Schwab,
City Planning Courd&kator.
Motion made by Spitzer, seconded by Peloquin, to -approve the minutes
of the June 11, 1974 meeting. Motion carried.
GRUNDHOFFER & MCCULLOUGH - SPECIAL USE PERMI T
Mr. Spitzer asked Mr. Johnson if it was feasible to ask for a easement
for the roadway. Mr. Johnson said if the City asked for an easement,
the city would have to pay for it. Johnson said there should be a
city road map for proposed roads.
Mr. Johnson said this property should be platted. He also said that
they do not need signatures of the other property owners for a
preliminary plan. The applicants agreed to plat their property before
they get issuance of a Special Use Permit for a second building.
Motion made by Spitzer, seconded by Leroux, that the Special Use
Permit be granted for McCullough to construct a commercial building
at the following location: All of that part of the NEL, Section 17,
Township 31N, Range 21W, Washington County, Minnesota described as
• follows: Commencing at the intersection of the easterly right of way
_ line of Minnesota State Trunk Highway #61 and the east and west quarter
line of said section 17 thence northerly along said easterly right of way

line 766' 0: be the point of beginning of the parcel to be described;
thence continuing along said right of way line, 600 feet; thence an a
deflection aigle of 770 and 45' to the right, 464.92 feet; thence on a
deflection angle of 1Q2° l' to the right, 600 feet; thence on a deflec-
tion angle of 770 45' to the right, 464.92' to the point of beginking
and containing 6.24 acres more or less. :
1. To be set back a minimum of 80 feet from the Highway 61 right-of-
way.
2. Shall be occupied by no more than 10 people.
3. Shall be dedicated for the purpose of contracting and masonry
contracting. Exterior storage of heavy machinery and building
equipment will be expressly prohibited.
4. Said building shall be a cement and brick construction in accor-
dance to the Plan A submitted by the applicant.

5. Building shall be constructed to face northerly aid shall access
Highway 61 by means of a private driveway in accordance with Site
Plan B submitted by the applicants.
6. Special Use Permit shall be contingent upon the applicant obtaining
access to Highway 61.
7. The owner or applicant will supply a septic system to consist
of a 1,000 gallon septic tank and three lines 75 feet each for
drain field.
8. Applicant shall furnish proof of ownership to City Council prior
to issuance.
9. It is further stipulated that all aoaditioYsidf this Special Use
Permit will be met viz months after issuance of the permit or the
permit shall become void.
10. Surface water drainage plan shall be filed with the City Building
ISspector prior to issuance of the Building Permit.
Members for: Peloquin, Ehret, Spitzer and Leroux. Motion carried.
REHBEIN CONTRACTING COMPANY - MINING & SPPQIAL USE PERMITS
A discussion was held on increasing the bond for the haul roads.
Kuusisto stated that damage will be taken care of as it happens.
Attorney Johnson asked if they should 8pecifyuthe type of grass seed
to be used. The Planning Commission didn't feel this was necessary.
Mr. Johnson had a question about contours. A contour map was submitted.
Rice Creek Watershed report was submitted.
Mr. Spengler stated that they had submitted a new application to
change the hours for the Riopel and Gregoire pits from 5:00 A.M.
to 11:00 P.M.
Mr. Spengler felt that 45 MPH would be a reasonable speed for the
gravel trucks.
Motion made by Leroux, seconded by Spitzer, to recommend approval
of the Rehbein Mining Permits and Haul Routes and Special Use Permits
for Gregoire, Riopel, Duraine and LaCasse subject to the conditions
layed out by the Washington County Planning Coordinator with the
following conditions:
Special Use Permits for the Gregoire, Riopel, LaCasse & Duraine properties
1. This special use permit is issued for the removal of gravel in
accordance with the plans submitted and any deviation from these
plans shall require an amendment to this special use permit.
2. All existing trees and natural vegetation bordering the pit area
shall be left undisturbed.
3. All top soil in the pit area shall be stockpiled, and at the time
the operation is completed, the top soil shall be replaced and
seeded to grass cover.

4. If sewer facilities are to be provided, they shall be of the por-
table,
or-
table, chemical holding tank type.
5. A bond in the amount of $3,000.00 shall be posted for each of the
three borrow pit sites, and a bond in the amount of $5,000. 30
shall be posted for the Duraine property. The bonds shall be
performance bonds in the form approved by the City Attorney and
written to insure compliance with the provisions of this special
use permit.
6. The conditions of the special permit issued by the Rice Creek
Watershed District for each of the sites shall be made a con-
dition of this special use permit.
7. Inspection of the site shall be by the City Engineer and the bonds
shall be released only after he 1has certified that the provisions
of the special use• permit have been complied with.
8. Any violation of the condtions of this special cial use permit t shall
p
be gro4nds for termination of the permit, and final grading,
sloping, and seeding shall then be at the direction of the City
Engineer.
9. The special use permit shall.expire on September 30, 1975, and all
conditions of it shall have been complied with by that date or it
may be extended due to conditions beyond the contractors control
to include labor relations or acts of God.
10. Dust shall be controlled on the haul roads by the contractor in
accordance to the recommendations of the City Engineer.
Additional conditions for the Durable Property:
1. As part of this special use permit, the applicant is authorized
to operate a hot--mix asphalt plant. This plant shall be operated
in compliance with the Minnesota Pollution Control Agency's
Operating Permit Number 1022-73-0-1.
2. The bituminous hot-mix plant shall be placed in such a location
that it has the least visual impact from the surrounding properties.
The following conditions should be applied to the mining permits issued
to Rehbein Contracting Company. There would be two mining permits, one
covering the borrow pits and one for the mining and hot-mix plant on the
Durkine property.
1. All applicable provisions of the City of Hugo ordinances governing
mining shall be complied with.
2. This permit is issued for the purpose of removing borrow material
of gravel for use on the job under contract with Washington County
for work on County Road 4 and County Road 56.
3. No top soil or overburden shall be removed from the site.

4. Haul roads shall be those designated in the application which
have been approved by the City Engineer and the Washington
County Engineer.
5. Dust control on all city streets shall be by the use of oil,
(crankcase oil) as directed by the City Engineer. Dust control
on all roads under the jurisdiction of Washington County shall
be by calcium chloride as directed by the Washington County
Engineer.
6. The inspection fee shall be based on the amount of the material
removed from the site. The charge shall be fixed at a rate of
one cent per cubic yard of material removed. The amount of the
fee shall be computed based on estimates submitted by the applicant
and confirmed by the Washington County Engineer. X2,000.00 shall
be paid immediately to the City of Hugo for prepayment for
inspection fees and shall be finally settled at completion of the
highway construction project.
7. The contractor shall provide a X40,000.00 bond and a $10,000.00
irrevocable letter of credit for the maintenance and/or recon-
struction of the haul roads.
8. Recommendations of the Washington County Engineer, dated May 30
1974, and those of the City of Hugo Engineer, dated June 11, 1974
shall be made a part of this permit.
9. Inspection to insure compliance with this permit will be done by
the City of Hugo Engineer. He may request the assistance of the
Washington County Engineer in providing such inspection. This
permit shall expire on September 30, 1975.
10. Any violations of the terms or conditions of this permit shall be
grounds for immediate termination in accordance with the City
Ordinance.
11. Haul routes shall be periodically inspected by the City Engineer
and maintained by the contractor in accordance with his recommen-
dations.
12. A speed limit of a maximum of 45 miles per hour be maintained by
contractor gravel trucks when operating on the haul roads on
City streets.
13. Any additional limitations or specifications which shall be
deemed necessary by the City Engineer and City Attorney.
14. The hours of mining operations at the Gregoire and Riopel opera-
tions shall be extended to 5:00 A.M. to 11:00 P.M.

HARDWOOD CREEK ESTATES- SUBDIVISIOPT
Mr. Muggs explained that they had completely changed their plan and
that they had constructed a pond. Mr. Hult, a representative of
Mr. Mugg, described the plan as follows:

) - 22 Lots - Minimum of 200 feet wide.

No external driveways for safety reasons.
t - Borings were done again this Spring and they didn't vary more
than foot.
-- They will cluster the homes where the soil is good, with no
subdivision in the future.
- Road had 60' right-of-way.
- In School District 831.
- Road would be 6" classified gravel.
- They would like to extend the road out and not make the ditches
so deep so it would be easier to mow.
- Houses would have full basements.
- Setbacks would be 40' from the right-of-way.
Leroux said he would like to seethe right-of-way off the Northern
Natural Gas line. Schwab said it wouldn't hurt to have it in the
shoulder, but that they should get a letter from Northern Natural.
It was stated that the City requires blacktop roads in their Ordinance.
There are 35 acres back of the creek.
Kuusisto said he Would like to see them get a map from HUD on flood
control.
This area is in conservancy.
The Planning Commission didn't like the deep lots and would like to
see them cut-off. Schwab suggested that they leave the back part as
an out lot that would be divided among the property owners.
It was also suggested that he sell the back part as a whole unit.
Spitzer said it didn't matter to him which way they went but he would
not like to see it go tax-title.
Mr. Muggs felt the best way to do it is shorten the lots and make an
out lot and probably sell it to one of the lot owners.
Motion made by Spitzer that a public hearing be held on July 24th
for the Hardwood Creek Estates at 9:00 P.M. Motion carried.
FISCHER CONSTRUCTION CO. - MINING PERMIT RENEWAL
Motion made by Spitzer, seconded by Peloquin, recommending that the
City Council approve the Fischer Mining Permit. Motion carried.
Motion made by Peloquin and seconded to adjourn the meeting at 11:30 P.M.
