HomeMy WebLinkAbout1974.07.09 PC Minutes • t MINUTES OF PROCEEDINGS OF THE HUGO PLANNING COMMISSION JULY 9, 1974 The meeting was called to order at 8:08 P.M. by Chairman Larry Ehret. Members present were Spitzer, Ehret, Peloquix, Leroux (9:12) , Schletty, Rosenquist and Johnson (9:00) . Also present was Dennis Welch from the Washington County Planning Department. Motion made by Spitzer, and seconded to dispense with the reading of the minutes of the June 26, 1974 meaning. Motion carried. Motion made by Spitzer, seconded by Peloquix, to approve the minutes of the June 26, 1974 meeting. Motion carried. TAUER SPECIAL USE PERMIT Mr. Ehret read letter subj*itted from the Sanitary Engineering Laboratories, Inc. who conducted anCanalysis of the existing Tauer sewer disposal system. Mir. Ehret also read report submitted from the Planning Department. An attorney representing Mr. Tauer said he takes acception to many of the things ix Schwab' s report: Mr. Tauer was not asked to furnish any specific plans and he did furnish everything he was asked. Original plans included the apartment. The comprehensive land use Plan is not in effect yet. He felt Schwab' s report was totally inadequate and unfair and it should be disregarded. Mr. Welch discussed the reasonings of Mr. Schwab' s report. Spitzer explained the Comprehensive Plan and the background of the Tauer's request for a Special Use Permit. The real problem is do they want a multiple family dwelling ix a rural area. Tauer's Attorney - The basic purpose of the Comprehensive Plan is for future uses, and this is something that is in existanee. He feels they haven't destroyed anything in this area and doesn' t think its going to destroy the Comprehensive Land Use Plan. Motion made by Spitzer, seconded by Rosenquist, that the Tauer Special Use Permit be recommended for denial as it does not conform to the Comprehensive Plan and none of the purposes contemplated by the Comprehensive Plan would be served by this request. Members for: Peloquix, Ehret, Schletty, Rosexquist and Spitzer. Motion carried. MINIATURE GOLF COURSE SPECIAL USE PERMIT Ehret read letter from the Rice Creek Watershed approving their permit to pond the water in the picnic area. He also read letter from the Planning Department. David Kirscht from the David A. Kirscht Assoc. , Inc. Landscape Architects represented the owners of the A&W. -2_ Mr. Kirscht stated that they had done a field survey of the property and they had contacted Mr. Kuusisto's office and they furnished the information requested. He worked with the Rice Creek Watershed and they came up with a plan to drain the water into a low area and then depend of percolation. The plan has not been submitted to the City Engineer. Twenty percent at the :;most would be paved in the golf course area. Shallow ditches could be used for drainage and catch basins could be put in xt1 a .lateT;Alate. Schletty didn't go along with their drainage plan. Kirscht said they could keep the water on their property by grading. . A new lighting proposal was submitted which would be double the cost bt 1/3 the operating cost. The light bulb is in the housing, g' no refractors, with adjustable reflectors. They will guarantee that the neighbors will not see the light source. There will be 25' poles on the sides with a 40' pole ix the center. A question was asked whether they were going to have security lighting. They haven't considered this aspect but they would do what the City required. They would like to stage this development. A discussion was held on delineated turf or crushed rock versus asphalt walk. No fill will be used, just grading. Welch said they needed a detailed plant list because landscaping was recommended to be within one year and there would not be any way to check to see that it was completed. Kirscht said they didn't have a list because with the new lighting the shrubbery plan is changed. g S Motion made by Spitzer, seconded by Rosexquist, recommending issuanc& of a Special Use Permit to the A&W subject to the following conditions: 1. Hours of operation shall be confined to the hours of 9:00 a.m. to 10:00 p.m. weekdays and 9:00 a.m. to 11:00 p.m. Friday and Saturday June through August and to the hours of 9:00 a.m. and 9:00 p.m. weekxigbts and 9:00 a.m. and 11:00 P.m. Priday and Saturday for the balance of the year. 2. Lighting shall be installed in accordance with the planp resented to the Planning Commission and ix no instance shall cause an illumination shall not exceed 5 foot candles at the exterior of the golf course. 3. The complete grading and drainage plan be submitted and approved by the City Engineer. -3_ 4. Adequate sanitary facilities providing for two separate toilet facilities shall be installed. 5. The six foot high redwood fence proposed on the east end of the property shall be set back from the property line not less than three feet. 6. All tke exterior screening ands , site preparations required for surface drainage shall be completed within one year following issuance of the Special Use Permit. 7. In addition to the screenking shown on the plan, additional screening shall be provided on the north property lime east of the existing garage on the adjacent property. 8. All driveway aid parking surface areas shall be blacktopped. All walkways within the miniature golf course shall be delineated turf or gravel and shall not be blacktopped or concrete. 9. The applicant shall be required to post a bond in the amount of $5,000 to insure compliance with the exterior screening, surface water drainage site preparation, and parking area surface requirements. 10. This permit shall be reviewed,in a period not more than 18 months after its issuance,by the Planning Commission to assess the degree of compliance with the plan as submitted. Permission for all improvement not installed as of that date shall be revoked. Members for: Peloquim, Johnson, Ehret, Rosenquist, Spitzer and Leroux. Schletty voted no. Motion carried. EDWARD WAUGH - TRAEGER'S SUBDIVISION Mr. Ehret read letter from Kuusisto and Schwab. Mr. Waugh submitted a new proposed plat and a letter from the Rice Creek Watershed. A representative for Mr. Waugh made the following statements: - Lot one is an out lot. - Lot 8 (7 on the new plat) increased in size. - Grading plan on their plat. - Discussed 17' easement along the south for a roadway. y A discussion was held on the term flood proofing mentioned in the letter from the Rice Creek Watershed. Ehret felt they meant the main floor of the building would have to be above 930. Mr. Welch was directed to contact the Washington County Engineer to get a written report on right,-of-way for County Road 8A and submit a copy to Mr. Waugh. p STEVE INOTT Mr. Inott waited to know if they needed a variance or subdivision to deride a tea acre parcel into two five acre parcels. They were told they would have to go through a subdivision because a road was required. They were told to get a copy of the subdivision code and contact Bill Schwab or Dennis Welch. LEN NO ACK Motion made by Spitzer, seconded by Johnson, recommending that this Junk Yard Special Use Permit be granted with all the previous conditions with the date of Item 3 be changed from June 30, 1973 to. September 1, 1971, and subject to the condition that Mr. Noack file the proper application. Members for: Peloquin, Johnson, Ehret, Schletty, Leroux and Spitzer. Motion carried.
