HomeMy WebLinkAbout1974.08.13 PC Minutes MINUTES OF PROCEEDINGS OF THE HUGO PLANNING COMMISSION AUGUST 13, 1974 The public hearing was opened by Veru Peloquix at 8:12 P.M. for the Hardwood Creek Estates subdivision. Robert Waller - Mr..:. Miler stated that the public notice in the Forest Lake Times was incorrect. It described a non-existing piece of land in the legal description. He also said that he came to City Hall to see the plans for Hardwood Creek Estates and it couldn't be located. He recommended that the Ordinance Committee amend the ordinance se plans are available for inspection by the public 10 days prior to the Public Hearing. He stated that the Ordinance says that adjacent communities have to be notified of a public hearing. He stated that Forest Lake had not been notified. Bill Schwab read the Ordinance for Hugo the clerk is operating with and it did not state what Mr. Waller mentioned. Spitzer suggested that the Secretary be instructed to add a sentence to the public hearing notice stating that plans are on file for public inspection and that all applicants be required to have their plans on file when the public hearing is scheduled. Vern Pel o quip read the public hearing notice. Bill Schwab read his report for the Hardwood Creek Estates. Mr. Mugg explained what his plans were: - 15 buildable lots - 177th Street can be completed. - Out lot A along Hardwood Creek will be left and a scenic easement for maintenance purposes. - An area will be left along Highway 61 for commercial development. - All lots are 300 feet wide except one. - They have spent a considerable amount of money on water control. - Rice Street Watershed has submitted a favorable report. - Kuusisto has inspected the area but has not submitted a report. - The gas company has come out and staked it and okayed the plan. Spitzer said they should obtain a written disclaimer from the Northern Natural Gas Company. Mr. Hult said that he would obtain this letter prior to going to Council. Spitzer suggested that there be 3 out lots. Lot 8 is less than 300 feet wide but is actually 10 acres. Spitzer stated that the subdivision ordinance has a section regarding street intersections. Schwab read that it could be a 60 to 90° angle. The pipe line forcep one of the driveway easements to be at an angle. Attorney Johnson asked if there is any restrictive covenants. Mr. Mugg stated that they will be using the same restrictive covenants they use in their other developments except for the side of the houses. His restrictions are stricter than the City Code. -2- They will build a 6" gravel, 7 ton base road, 36 feet wide. The public hearing was closed at 8:44 P.M. The meeting was called to order at 8:45 P.M. by Vern Peloquin, acting chairman. Members present were: Spitzer, Peloquix, Schletty,Ehret aid Johnson. Also present were Bill Schwab, Washington County Planning Coordinator; Irene Leroux, City Council Member; aid Charles Johnson, City Attorney. Motion made by Spitzer, seconded by Johnson, to dispense with the reading aid approve the minutes of the July 24th meeting. Motion carried. HARDWOOD CREEK ESTATES SUBDIVISION Motion made by Spitzer, seconded by Peloquin, recommending that the Hardwood Creek Estates plan, as submitted, be approved with the following conditions: 1. Engineer's report be submitted to the City Council prior toy:its apWin O ::the application. 2. That written permission Ftthe Northern Natural Gas Company for the construction of 177th Street on the eastern portion of the plat to the developer and be submitted to the City Council prior to its approval. 3. A portion of the property shown on the plan but not platted to the north of Hardwood Creek be designated as out lot A. That portion of the property shown on the plan but not platted on the westerly side of the plat line between Hardwood Creek and proposed 177th Street be designated Out Lot B. That portion of the property shown on the plan but-not platted on the westerly side of the property line between 177th Street and the southernly property line be designated as out lot C. All references to reservation for future of commercial development of above out lot B and C be removed from the plan. 4. That a scenic easement be granted to the City of Hugo over out lot A described above. 5. That a park land dedication in the amount of $1,500.00, in addition to the scenic easement, be made to the Oity of Hugo. 6. That all proposed restrictive covenances be submitted to and reviewed by the City Attorney prior to the consideration of the plan by the City Council. 7. That 177th Street, as proposed, shall be constructed by the developer; being a gravel surface road, 7 ton load, as approved by the City Engineer. -3- 8. A bond shall be required from the developer ix an amount to insure the construction of the proposed road. Said bond to be in accordance with the recommendation of the City Engineer, and shall continue in force until deemed acceptable by the City Engineer. 9. That all homes within the plat be constructed at a distance no more than 400' from the 177th Street North. 10. The right of access to each lot shall be dedicated to the City except to access to 177th Street North. Members for: Peloquin, Johnson, Schletty and Spitzer. Motion carried. Motion made by Spitzer, seconded by Schletty, to reverse the order of the agenda. Motion carried. LAMETTI CONSTRUCTION COMPANY - AMENDED SPECIAL USE PERMIT Lametti filled out an application and paid the fee. Percolation test report was submitted and was summarized by Spitzer. Motion made by Spitzer, seconded by Peloquin, recommending that the Amended Special Use Permit for the Lametti? property be approved with the following condition; That the office proposed shall not house more than four people. Members for: Peloquix, Johnson, Schletty and Spitzer. Motion carried. HORTON JUNK YARD - SPECIAL USE PERMIT AND JUNK YARD LICENSE RENEWAL On May 18, 1974 a committee went to the Horton's Junk Yard and examined the premises. The fence is deteriorated to the point that it is ineffective. The fire lane was winding and almost impossible to get a fire truck through. They would need to clear the fire lant and register it with the City Fire Department. Off street parking was one of the major problems. Harley Johnson read Item 11 regarding the parking area. Spitzer told Mrs. Horton that the Planning Commission would not act on this tonight and let them take care of these things. If the Commission acted on it tonight, they would have to deny it. Mr. Ehret advised Mrs. Horton that all things on the Special Use Permit would have to be done by September 7th and that someone would be out to examine it at that time. Johnson and Schletty objected to the fence that has been put up. They would rather see a more sightly fence such as a basket weave. This would be easier to maintain too. ♦, • _4_ Motion made by Johnson, seconded by Peloquin to amend Item 2 to read: A basket weave fence shall be constructed along the North line of the property described in Attachment "B", starting at the Westerly edge of said property, and running Easterly for a distance sufficient to completely block the view of any cars stored on the premises from the view of the house which is located immediately North of the Auto Dismantling Yard; such a distance not to exceed 250 feet. Motion carried. Attorney Johnson said that the D&R stated that the shoreline regulations would be done in two months, but Johnson felt that the amount of work they still have left it wouldn't be completed until the first of the year. Johnson felt that we should go ahead and draft au ordinance regarding shoreline. Motion made by Spitzer, seconded by Schletty, to adjourn the meeting at 10:20. Motion carried.
