Joint Planning Commission and Village Council Meeting to review revisions of the proposed zoning ordinance and proposed zoning I map. Village Council Members presents Oarlson, LaValle, Leroux, Iljorum and Lease. , Planning Commission Members present: Johnson, Kuntz, Bhret, t Paulson, Rosenquist, Leroux (arrived at 9s10 P.M. ) and Spitzer (arrived at 9:40 P.M. ). ' Charles Johnson, Village Attorney, and Carl Dale, Planning Con- sultant, were also present. • Carl Dale, Planning Consultant, presented the following recom- mendations for revisions to the proposed zoning ordinance and map: , I. ORDINANCE RBVISION4 A. Expand definition of "Permitted Uses" in residential area: 1. Expand permitted Uses to include semi-public recrea- tional uses facilities owned by two or more home owndrsi . 2. Cover-all Clause - The Council may permit things that are similar to and compatable with permitted uses. # It. Noise Clause - I , -I Add noise performance standards to this ordinance or adopt G',C a separate ordinance. Suggested that the village look at , Minneapolis' noise control standards; obtain equipment and go out and measure noise levels and set standards that the ,‘ village will permit and tolerate. 0. Mobile Homes - Recommended mobile homes be permitted in a . residential area by a special Use Permit" and be controlled k by the following: 1. Standard control ordinance restricting how mobile home * areas can be developed. 2. Resolutions. ,-. 3. Answer - - They would be allowed in other areas on a temporarybasis. (INemergency . x cases such ,`+ i as homes burning, etc. , or for• summer farm help) . ! D. rive Acre Minimum Residential Zone - - Recommended that their be an addition to the ordinance of a five acre residential district to the proposed zones. Mr. Dale said there is a large gap between one acre and twentyacres. This would provide an intermediate zone. .. E. Industrial - f • Referred to a petition received from business owners in a five block area north or 170th Street to 175th Street who wished to be zoned commercial instead of agricultural. • A decision was made to leave this area agricultural until the business men in this arearov dhow p i e a plan. on they are going to develop this area. The village will help them with this plan if they wish. • Mr. .Dale recommended an addition to the ordinance of a }4. i ¶Oonditional Use Permit" for Industrial Area. It's for requests that cannot be denied but which you can put !p.• restrictions on, * such as requiring development plans. li: ` P. It was decided to change the ordinance to consider sod farming the same .as farming so it doesn't get phased out under the non- ,. conformance use • of open land. f. Commercial feed lots of 15 cattle per acre for confined feeding .c was discussed. Under the present' wording, dairy farmers would yti not be allowed to confine their cattle in the winter. The fol- ` lowing additions were suggested s 1. Any feeding or inclosure operation that .pro•duces a polution *� problem, the village has the right to request a "Special Use Permit. 2. Provide •proof that it is detrimental to general public situ- ation. • Mr. Johnson, Village Attorney, is working on. new wording. 4 • { 3 II. MAP REVISIONS • A. South end of Goodview Avenue - Carlson readp a ti tion from land owners on south end of Goodview Avenue. Petition read that they wished to be zoned Agricultural instead of SPE. Spitzer said they were zoned SPE because of sever possibly being in in thirty years. It was discussed whether to zone them rural residential if a rural residential area was established. Harley Johnson recommended as long as all the big land owners want to be rezoned agricultural, let them be. The Planning board recommended that the south end of Goodview be rezoned Agricultural. • t B. Business Districts - 1. The area west of the Hugo School should be changed to SFE. 2. The block east of the Village Hall from 146th Street to 147th Street between Highway 61 and Fitzgerald be zoned Concentrated Business. It is currently zoned SPE. Y: C. Intermediate Zone - Rosenquist recommended establishment of an intermediate size zone. Spitzer outlined the problems of five acre lot sizes such as being outside subdivision, and recom- •i - mended three acres- with 200 foot road frontage. Said . . withou f r acre lots you have problems with roads. COMMENTS Members of the audience restated their opposition to a twenty y acre :. minimum. They wished to be more flexible. • • Jerry Moore read a4 petition from 250 people. Bjorum asked what would be required for rezoning. Carl Dale stated that persons requesting rezoning would probably be required to hire .$. an attorney and planner. Jia Leroux asked if there was any problem to rezoning from Conser- vanoy to usable land. Answer - -- No. tx SUMMARY Don Lease recommended that the Planning Commission revise the prost - posed ordinance and map. Agricultural - 20 More Minimum • 2. Rural Residential Area - (Intermediate lot size) . Spitzer requested that the Planning Commission be able to work over the comprehensive plan. Not to close the door on public •• opinion. Rosenquist suggested that Planning Commission phone numbers be published and the public phone them with any questions or recommendations. Spitzer proposed that the Public Hearing be reconvened on Tuesday, September 25th, and p n the people be told that there are problems and that the Planning Commission will drawup a new ordinance with our ideas and input from the public and present it to the Council.
