AN ORDINANCE REGULATING THE LOCATION, DESIGN, INSTALLATION,
USE AND MAINTENANCE OF INDIVIDUAL

. / SEWAGE TREATMENT SYSTEMS WITHIN THE CITY OF HUGO.
The City Council of the City of Hugo, Washington County , Minnesota, hereby
ordains:
263-1 . PURPOSE AND INTENT. This Ordinance is adopted for the purpose of
protecting the health, safety , and welfare of the residents of
Hugo through regulating the location , design , installation , use,
and maintenance of individual sewage treatment systems so as to
prevent contamination of surface and ground waters.
263-2. REPEAL OF INCONSISTENT ORDINANCE. That certain ordinance
entitled "An Ordinance Regulating the Location , Design ,
Installation , Use and Maintenance Requiring Permits and
Inspection of Individual Sewage Treatment Systems within the City
of Hugo" , Chapter 263 of the Hugo Municipal code, is hereby
repealed in its entirety and replaced with this ordinance

263-3. ADOPTION OF WASHINGTON COUNTY INDIVIDUAL SEWAGE TREATMENT SYSTEM
ORDINANCE. That certain ordinance of Washington County ,
Minnesota, entitled "An Ordinance Regulating the Location ,
Design , Installation , Use and Maintenance of Individual Sewage
Treatment Systems Within the Unincorporated Areas of Washington
County" , adopted by the Washington County Board of Commissioners
on November 3, 1992, is hereby adopted by reference in its
� entirety as if herein printed in full , except as specifically
changed in paragraph 263-4 below.
263-4. LOCAL MODIFICATIONS OF COUNTY ORDINANCE.
Subd . A. Where reference is made to The Washington County Board
of Commissioners, it shall be changed to read "The Hugo City
Council " .
Subd . B. Where reference is made to the Washington County Public
Health Department, it shall be changed to read , "The City of Hugo
Code Enforcement Officer" .
Subd . C. Where reference is made to the Washington County Board
of Adjustment and Appeals, it shall be changed to read , "The City
of Hugo Board of Adjustment and Appeals" .
Subd . D. Where reference is made to the Washington County
Planning Advisory Commission , it shall be changed to read , "The
Hugo City Council or designated agent" .
Subd . E. The permitting authority under the Ordinance shall be
the Hugo City Council .
Subd . F. An exception shall be added to paragraph 5. 1 (3)
stating : "The City Code Enforcement Officer may grant a variance

of up to twelve ( 12) inches to the minimum amount of existing
soil required for installation of mound systems where suitable
- technical information is provided by qualified individuals that

such variance will not be hazardous to the public health or the

environment . "
263-5. EFFECTIVE DATE. This Ordinance shall become effective after its
adoption and publication .
Upon roll call , the following members voting AYE: Barnes, Brunotte,
Leroux , Miron , Stoltzman
Voting NAY: NONE
Whereupon said ordinance was declared passed and adopted this 21st day of
June, 1993.
