RESOLUTION 2013-12 <br />APPROVING A CONDITIONAL USE PERMIT FOR CHRIST LUTHERAN <br />CHURCH TO ALLOW A CHURCH USE ON THE PROPERTY LOCATED AT <br />4970 ROSEMARY WAY NORTH <br />WHEREAS, Christ Lutheran Church has requested approval of a conditional use permit <br />to a place of worship use on the property located at 4970 Rosemary Way North and is <br />legally described as follows: <br />Lot 1 and 2, Block 2, Frenchman Place <br />WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly <br />called public hearing on April 25, 2013, and recommends approval subject to the <br />conditions listed in the conditional use permit. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit for Christ Lutheran Church to place of worship use on the property <br />located at 4970 Rosemary Way North with the following findings: <br />1. The proposed use is allowed by conditional use permit. <br />2. The proposed use is allowed in the R-5 zoning district and will keep with the <br />spirit and intent of the ordinance, which is intended to allow a place of worship by <br />a CUP as long as they comply with the regulations. The proposed use is <br />compatible with the surrounding development and will not alter the character of <br />the area. <br />3. The proposed use as adequate drainage, water supply, and utilized to the site. <br />4. The applicant is proposing access of Rosemary Way and a future access onto <br />Everton Ave. The two proposed accesses are in reasonable locations as Rosemary <br />Ways is designated as a collector street on the City's Comprehensive Plan and <br />Everton Avenue is planned as a commercial street. <br />5. The applicant is not proposing to impact any floodplain. <br />6. The proposed use would not obstruct the floodplain or increase the potential for <br />flooding. <br />7. The proposed use would not damage or reduce the benefits from any public <br />waters. <br />8. The proposed use would not involve the use of watercraft on public waters. <br />9. The proposed use would not be visible from public waters. <br />
