APPROVING A CONDITIONAL USE PERMIT FOR CHRIST LUTHERAN
CHURCH TO ALLOW A CHURCH USE ON THE PROPERTY LOCATED AT
4970 ROSEMARY WAY NORTH
WHEREAS, Christ Lutheran Church has requested approval of a conditional use permit
to a place of worship use on the property located at 4970 Rosemary Way North and is
legally described as follows:
Lot 1 and 2, Block 2, Frenchman Place
WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly
called public hearing on April 25, 2013, and recommends approval subject to the
conditions listed in the conditional use permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
conditional use permit for Christ Lutheran Church to place of worship use on the property
located at 4970 Rosemary Way North with the following findings:
1. The proposed use is allowed by conditional use permit.
2. The proposed use is allowed in the R-5 zoning district and will keep with the
spirit and intent of the ordinance, which is intended to allow a place of worship by
a CUP as long as they comply with the regulations. The proposed use is
compatible with the surrounding development and will not alter the character of
the area.
3. The proposed use as adequate drainage, water supply, and utilized to the site.
4. The applicant is proposing access of Rosemary Way and a future access onto
Everton Ave. The two proposed accesses are in reasonable locations as Rosemary
Ways is designated as a collector street on the City's Comprehensive Plan and
Everton Avenue is planned as a commercial street.
5. The applicant is not proposing to impact any floodplain.
6. The proposed use would not obstruct the floodplain or increase the potential for
flooding.
7. The proposed use would not damage or reduce the benefits from any public
waters.
8. The proposed use would not involve the use of watercraft on public waters.
9. The proposed use would not be visible from public waters.

10. The proposed use does impact wetlands. The applicant has submitted a wetland
replacement plan that has been reviewed by the Technical Evaluation Panel
(TEP).
11. The applicant would be responsible for obtaining all state and local permits.
12. The proposed use is compatible with the adjacent developments. Landscaping will
be installed with each phase of the development.
ADOPTED by the City Council this 6"' day of May, 2013.
