APPROVING A VARIANCE FROM THE BUILDING HEIGHT REQUIREMENTS IN
THE MEDIUM DENSITY MUTIPLE FAMILY RESIDENITIAL (R-5) ZONING
DISTRICT FOR CHIRST LUTHERAN CHURCH ON THE PROPERTY LOCATED AT
4970 ROSEMARY WAY NORTH
WHEREAS, Christ Lutheran Church has requested approval of a variance to allow a building to
be 41 feet in height, where 35 feet is required by ordinance for the property legally described as
follows:
Lots 1 and 2, Block 2, Frenchman Place
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
on April 25, 2013, and recommends approval and;
NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the request by Christ
Lutheran Church a variance to allow a building to be 41 feet in height, where 35 feet is required
by ordinance based on the following findings:
1. The proposed variance is permissible by law.
2. The cross is the only area where the building exceeds the height requirements and it is typical for
crosses to be higher than the building for identification.
3. The applicant is requesting to use the property in a reasonable manner.
4. The property is uniquely located in an area that is in close proximity to several power poles and
lines that run through the site to the northeast of the proposed building and in front of the
property. The poles are an average height of 40-50 feet in height in that location. The cross on the
top of the building will likely blend in with the power poles.
5. The proposed use is compatible with the surrounding development and will not alter the character
of the area.
6. The granting of the variance will keep with the spirit and intent of the ordinance.
7. A church is allowed in the Medium Density Multiple Family Residential (R-5) district with
approval of a conditional use permit.
8. The property is not located within a floodplain.
9. The property is served with municipal sewer and water.
