RESOLUTION DECLARING ADEQUACY OF PETITION ADOPTING ASSESSMENT
FOR THE ROSEMARY WAY IMPROVEMENT PROJECT
WHEREAS, pursuant to proper notice duly given as required by law or waived, the
council has met and heard and passed upon all objections to the petition and proposed
assessment for the construction of Rosemary Way between the western boundary of the
Frenchman Place 1st Addition Plat and Everton Avenue North.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUGO, MINNESOTA:
The Petition dated March 7, 2013 is hereby declared to be signed by the required
percentage of owners of property affected thereby and is declared to be adequate and the project
is ordered. Such proposed assessment, is hereby accepted and shall constitute the special
assessment against the lands named therein, and each tract of land therein included is hereby
found to be benefited by the proposed improvement in the amount of the assessment levied
against it.
2. Such assessment shall be as set forth in the Petition and Waiver Agreement, a
copy of which is attached hereto as Exhibit A.
3. The clerk shall forthwith transmit a certified duplicate of this assessment to the
county auditor to be extended on the property tax lists of the county. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.

This resolution was adopted by the City Council of the City of Hugo on the 3rd day of
June, 2013, by a vote of five Ayes and no Nays.
