APPROVING A VARIANCE TO ALLOW CONSTURCTION OF A HOUSE
ABOVE THE MAXIMUM STRUCTURE HEIGHT ON HORSESHOE LAKE
FOR PROPERTY LOCATED SOUTH OF 174TH ST AND GREYSTONE
AVENUE NORTH
WHEREAS, Christopher and Tonic Johnson, have requested a variance is to allow a
building height of 35 feet, where 25 feet is required by the ordinance on the property legally
described as:

WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at
a duly called public hearing on Thursday, April 2, 2015; and recommended approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO, MINNESOTA, that it should and hereby does approve the variance
request to construct a house with a maximum height of 35 feet, where 25 feet is required
by ordinance, with the following findings:
1. The requested variance is from the dimensional requirement of the ordinance and
is permissible'by law.
2. Because of circumstances unique to the property there are practical difficulties on
meeting the ordinance.
3. The granting of the variance would be in keeping with the spirit and intent of the
ordinance.
4. The applicant is proposing to use the property in a reasonable manner and
construction of a house is allowed in the FUS zoning district.
The proposed variance would not alter the character of the area.

The subject property is not within a floodplain.
8. The subject property is proposed to be served by individual well and septic
systems.
