USES AND PERFORMANCE STANDARDS
THE CITY OF HUGO ORDAINS:
Section 1. The City Council of the City of Hugo does hereby amend Article IV Zoning District
Regulations for deletion of the following Sections:
Sec. 90-95. Rural residential district (RR).
(d) Conditional uses.
(7) Cluster housing (refer to section 90-216)
Sec. 90-105. Restricted industrial district (II -1).
(b) Permitted uses.
(7) Ministorage.
(d) Conditional uses

Section 2. The City Council of the City of Hugo does hereby amend Article VI Requirements for
Specific Uses and Performance Standards for the deletion of the following Sections:
See. 90-224. Exterior storage.
(c) Exterior storage may be allowed as an accessory use in the restricted industrial district and
general business district by conditional use permit.
Sec. 90-251. Multifamily residential developments.
(b) Multifamily residential buildings may be allowed as a principal use in the central residential
zoning district by conditional use permit.
Section 3. The City Council of the City of Hugo does hereby amend Article IV Zoning District
Regulations to add the following to Sections:

Specific Uses and Performance Standards to read as follows in certain Sections:

Sec. 90-204. Accessory buildings
(o) Any property zoned R-1, RR, AG, or FUS that is less than 3 acres in size shall be allowed
two accessory buildings with a maximum combined size of 1,500 square feet, and shall not be
subject to the requirements as stated in the table outlined in subsection (f).

Accessory, enclosed retail, rental, or service shall not constitute more than 25 percent of the
gross floor area of the principal building.

(b) Commercial garages used only for the temporary parking of automobiles and light trucks for
people employed or conducting business in nearby buildings may be allowed as an accessory use
in the general business zoning district.

(b) Indoor riding arenas may be allowed in the agricultural, rural residential, and future urban
service zoning districts on parcels at least ten acres in size, subject to the following conditions:
Sec. 90-241. Livestock and poultry.
(b) Domestic livestock and poultry may be kept or maintained in the agricultural, long -tern
agricultural, future urban service, and rural residential zoning districts on parcels of land of five
acres or more in size. Two animal units shall be allowed for the first five acres ofland, and one
additional animal unit shall be allowed for each acre of land in excess of five acres. On parcels of
land less than five acres in the agricultural, long-term agricultural, future urban service, and rural
residential zoning districts, up to five chickens may be kept or maintained, all of which may not
be roosters. For the purposes of this subsection (b), the following conditions shall apply:

(c) Retail sales of materials brought in from off-site may be allowed.
Sec. 90-256. Plant nurseries, wholesale.
(b) The import, storage, processing, and distribution of plant materials grown off site may be
allowed.
See. 90-261. Seasonal outdoor retail sales.
(b) Seasonal outdoor retail sales shall be allowed for a period of time not to exceed a combined
total of 120 days in any 12 -month period. Outdoor retail sales shall not occupy an area exceeding
ten percent of a lot's area, and shall meet all yard setback requirements.
Section 4. The City Council of the City of Hugo does hereby amend Article IV Zoning District
Regulations and Article VI Requirements for Specific Uses and Performance Standards for
amendments as follows for certain Sections:
Sec. 90-109. Future urban service district (FITS).
(a) Purpose.
To revise the section to change ten acres to twenty acres
Sec. 90-232. Home occupations.
(c) (10) a. Add Future Urban Service to zoning districts in first sentence.
(k) & (m) Remove R-2 from list of zoning districts
(o) Add FUS to list of zoning districts in both places within subsection.
Section 5. Severability. In the event that a court of competent jurisdiction adjudges any part of
this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance
not specifically included with that judgment.
Section 6. Effective Date. These amendments shall take effect upon its passage and publication.
