HomeMy WebLinkAbout2006.07.05 ORD 2006-402ORDINANCE NO. 2006-402 AN ORDINANCE AMENDING CHAPTER 320 (COMPREHENSIVE LAND USE REGULATIONS) OF THE CITY CODE AMENDING SECTIONS 1125,1130, AND 1135 BY DECREASING THE MINIMUM SIDE YARD BUILDING SETBACK FROM 40 FEET TO A SETBACK EQUAL TO THE HEIGHT OF THE BUILDING, BUT IN NO CASE, LESS THAN TEN FEET FROM OTHER INDUSTRIAL ZONED PROPERTIES THE CITY OF HUGO ORDAINS: Section 1. The City Council of the City of Hugo does hereby amend Sections 1125, 1130, and 1135, Subdivisions 050. 1, Area Requirements and Construction Limitations, of the Hugo City Comprehensive Land Use Regulations by decreasing the minimum side yard setback in the Industrial zoning districts from 40 feet to a setback equal to the height of the building, but in no case less than 10 feet, from other industrial zoned properties. Minimum side yard setback from properties other than industrial zoned shall remain at 40 feet. Section 2. Severability. In the event that a court of competent jurisdiction adjudges any part of this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance not specifically included with that judgment. Section 3. Effective Date. This amendment shall take effect upon its passage and publication.
