AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA,
AMENDING SECTION 1195-720.1 OF THE HUGO COMPREHENSIVE LAND USE
REGULATIONS ON WIND -POWERED GENERATORS
Section 1. The City Council of the City of Hugo does hereby amend Section 1195-720.1
Wind -Powered Generators, of the Hugo Comprehensive Land Use Regulations by adding the
following:
1195-720.1 WIND -POWERED GENERATORS
Subd. 4
(J) All wind -powered generators shall be constructed as monopoles.
(K) All wind -powered generators shall be kept in a condition of good repair at
all times.
(L) If at any time the equipment produces an unusual amount of noise or
vibration not commonly associated with the normal operation of the equipment,
the generator shall be turned off until such time as repairs are made.
(G) At the time of approval of a wind -powered generator, the City may require
the owner to submit a right -of -entry agreement, allowing the City the right to enter
the property in order to turn off any malfunctioning equipment via the manual
shut-off device that is required to be installed by subsection (B).
Section 2. Severability. In the event that a court of competent jurisdiction adjudges any
part of this Ordinance to be invalid, such judgment shall not affect any other provision of this
Ordinance no specifically included within that judgment.
Section 3. Effective Date. This Ordinance shall be in effect from and after its passage
and publication according to law.
