HomeMy WebLinkAbout2004.10.18 ORD 2004-394ORDINANCE NO. 2004-394 AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, AMENDING HUGO CITY CODE CHAPTER 120 REGULATING AND LICENSING THE COLLECTION, STORAGE AND DISPOSAL OF GARBAGE, OTHER REFUSE, RECYCABLES AND YARD WASTE TO PERMIT BI -WEEKLY COLLECTION OF RECYCLABLES. The City Council of the City of Hugo, Washington County, Minnesota, does hereby ordain as follows: WHEREAS, the City has been advised of a new recycling program that provides for single -sort residential recycling. Single -sort recycling allows customers to mix targeted recyclables in one collection bin. The mixed recyclables are collected and taken to a recycling center for sorting. Single -sort recycling is made possible through the use of various mechanized screens and optical sorting technologies in the recycling plants; and WHEREAS, the City has been advised residential single -sort programs have greatly increased the recycling rates, recovering as much as three times the amount of recyclable materials. The increase in the recycling occurs because single -sort recycling is easier for individuals because paper items, bottles and cans are commingled in the recycle cart on site and later sorted at the recycling center; and WHEREAS, single -sort residential recycling programs utilize large recycling carts on wheels that do not require weekly recyclable pick up; and WHEREAS, the City's current recycling ordinance, Ordinance 1994-293, Chapter 120, Section 12 of the City Code provides for weekly collection of recyclables; and WHEREAS, the City Council desires to amend the recycling ordinance to allow for bi- weekly collection of recyclables which will allow residents to participate in the new single -sort residential recycling programs that utilizes bi-weekly collection of recyclables. NOW THEREFORE, it is hereby ordained by the City Council of the City of Hugo, Washington County, Minnesota as follows: Section 1. Chapter 120, Section 12 of the City Code of the City of Hugo is hereby amended to delete the following language, "Each licensed MSW hauler shall provide its customers with an opportunity to recycle through weekly collections of targeted recyclables" and replace it with the following language: "Each licensed MSW hauler shall provide its customers with an opportunity to recycle through weekly or bi-weekly collections of targeted recyclables." In the event that a court of competent jurisdiction adjudges any part of this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance not specifically included within that judgment. Section 3. Effective Date. This Ordinance shall be in full force and effect upon its passage and publication according to law.
