HomeMy WebLinkAbout2002.10.21 ORD 2002-364ORDINANCE NO. 2002-364 AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, AMENDING SECTION 1195-365 OF THE HUGO COMPREHENSIVE LAND USE REGULATIONS BY ESTABLISHING STANDARDS FOR INDOOR RIDING ARENAS Section 1. The City Council of the City of Hugo does hereby amend Section 195-365 of the Hugo Comprehensive Land Use Regulations by adding the following: 1195-365.1 INDOOR RIDING ARENAS. It is unlawful for any person to construct or operate a indoor riding arena, except in conformance with this ordinance. Subd. 1. Indoor riding arenas shall be allowed as a permitted use in the Agricultural, Rural Residential, and Future Urban Reserve zoning districts on parcels twenty (20) acres or more in size. Subd. 2. Indoor riding arenas may be allowed by conditional use permit in the Agricultural, Rural Residential, and Future Urban Reserve zoning districts on parcels at least ten (10) acres in size, subject to the following conditions: (A) The riding arena may not exceed 8,400 square feet in size. Other agricultural and accessory buildings may be constructed on the property or attached to the riding arena provided the size of the structures do not exceed the permitted square footage outlined in Section 1195-030.1 of this ordinance. (B) The riding arena may not be located between the home and a public street. (C) Not more than 25 percent of the structure can contain a concrete floor or other similar surface. (D) The riding arena shall be a minimum of 40 feet from the side lot line and meet all other applicable setback requirements. (E) If the use of the riding arena is discontinued in the future, the building may not be used for the operation of a business, including the storage of business related materials and equipment. (F) The keeping of animals and construction of other horse related facilities shall comply with Section 1195-340 and 1195-420 of the ordinance. Section 2. Severability. In the event that a court of competent jurisdiction adjudges any part of this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance no specifically included within that judgment. • Ordinance 2002-364 Page 2 Section 3.
