HomeMy WebLinkAbout2001.03.19 ORD 2001-348ORDINANCE NO. 2001- 348 AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, AMENDING CHAPTER 314 OF THE HUGO CITY CODE PERTAINING TO WATER SYSTEMS WITHIN THE CITY BY REQUIRING AN OWNER OF PROPERTY TO PERMIT THE CITY TO ACCESS THEIR PROPERTY TO INSTALL, INSPECT, REPLACE OR REPAIR WATER METERS AND PROVIDING FOR ESTABLISHMENT OF A SURCHARGE FOR NONCOMPLIANCE WITH THIS ORDINANCE. THE CITY COUNCIL OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. To existing City Code Chapter 314, add the following as "§ 314-11(A): Any owner of property or structure connected to the City water system shall allow access to the property by authorized City employees or agents to install inspect, repair or replace water meters on the property." Section 2. To existing City Code Chapter 314, add the following as "Section 314- 11(B): A surcharge as established by resolution of the City Council is imposed and shall be added to every water billing mailed on or after June 1, 2001, to properties not in compliance with this section. The surcharge shall be added to every billing until the property is in compliance. Compliance shall occur through inspection by authorized City employees or agents of all properties or structures connected to the municipal water system. Any person refusing to allow their property to be inspected shall immediately become subject to the surcharge and the surcharge shall continue thereafter and be added to every billing until the City confirms compliance." Section 3. If any portion of this Ordinance is for any reason held invalid or unconstitutional such portion shall be deemed a separate, distinct and independent provision and such holding shall not effect the validity of the remaining portions thereof. Section 4. This Ordinance shall be in full force and effect from and after its passage and publication according to law.
