HomeMy WebLinkAbout2001.03.19 ORD 2001-349CITY OF HUGO WASHINGTON COUNTY, MINNESOTA ORDINANCE NO. 2001 — 349 AN ORDINANCE AMENDING CHAPTER 320 (ZONING ORDINANCE) OF THE CITY CODE BY ALLOWING RETAIL AND WHOLESALE GREENHOUSES IN THE GENERAL BUSINESS ZONING DISTRICT (Sixth Amendment to Chapter 320) THE CITY OF HUGO ORDAINS: Section 1. Amendment of Cites. Hugo City Code, Chapter 320, Section 6.52 and 6.53 is hereby deleted in their entirety and replaced with the followimg: 6.52 Plant Nurseries, Retail. It is unlawful for any person to construct, operate, or maintain a retail plant nursery, except in conformance with this ordinance. A. Retail plant nurseries are permitted as accessory uses in the Central Business and General Business Zoning Districts. Plant nurseries may be allowed as a principal or accessory use in the Agricultural Zoning District, or as a principal use in the General Business Zoning District by Conditional Use Permit. B. Retail sales of the plants grown on-site are permitted, except that retail sales in the Agricultural Zoning District will only be allowed if the principal road access to the site is a state highway, county road, or City collector street. C. Retail sales of materials brought in from off-site are allowed in the Central Business and General Business Zoning Districts. Such sales may be allowed in the Agricultural Zoning District by Conditional Use Permit. 6.53 Plant Nurseries, Wholesale. It is unlawful for any person to construct, operate, or maintain a wholesale plant nursery, except in conformance with this ordinance. A. Wholesale plant nurseries that do not include the import, storage, processing, and distribution of plants and materials grown off-site are a permitted principal and accessory use in the Agricultural and Rural Residential zoning districts. The import, storage, processing, and distribution of plant materials grown off-site may be allowed in the Agricultural zoning district by Conditional Use Permit, and are allowed as a principal or accessory use in the Industrial zoning district. B. Wholesale plant nurseries that do not include the import, storage, processing, and distribution of plants and materials grown off-site are a conditional use in the General Business zoning district, subject to the following conditions and standards: 1) The City Council may require a greater front yard setback in order to insure that that the proposed greenhouse structures are compatible with the City's Comprehensive Plan and adjacent land uses. 2) Adequate parking and truck loading and maneuvering areas shall be provided on the site. 3) On site storage and use of pesticides and fertilizers shall meet the standards of the Minnesota Department of Agriculture. A chemical storage plan shall be provided to the Zoning Administrator at the time of application for a conditional use permit to provide the City with the location, type, amount, and storage method of pesticides, chemicals, and fertilizers kept on the site. C. Operation of a landscaping business is not incidental to operation of a wholesale plant nursery, and only equipment and machinery actively used and maintained for the principal purpose of cultivating plants grown on site, or as allowed by the principal use of the property, may be stored or maintained on the site of a plant nursery. D. It is the intent of this section to allow landscaping plants, shrubs, trees, etc., to be grown as an agricultural activity. Section 2.
