AN ORDINANCE APPROVING A NINE MONTH EXTENSION OF THE INTERIM
ORDINANCE ESTABLISHING A TEMPORARY DEVELOPMENT MORATORIUM ON
RESIDENTIAL DEVELOPMENT WITHIN THE METROPOLITAN URBAN SERVICE AREA.
WHEREAS, the City Council is considering whether additional time is needed to address
and continue work on the items identified in the interim ordinance as adopted by the City Council
on August 2, 1999, as follows:
1. City Staffing Requirements. While the City recently hired a Community
Development Director, the existing City Staff cannot complete the update to the
Comprehensive Plan and other tasks identified in the Interim Ordinance if Staff's
time is being spent reacting to development proposals.
2. City Space. While the City has begun the process of evaluating space needs for
City Hall and other facilities, the City has not made any decisions on how to address
the shortage of space. The City has evaluated possible locations for a new City Hall,
but has not resolve the question of whether and how to acquire new space. As noted
in the Interim Ordinance, the absence of sufficient space negatively affects the
City's ability to administer its official controls.
3. Water Issues. The City is in the process of addressing its water needs. The City is
currently drilling test wells in order to find a suitable location for a new well.
Additionally, the City is in the process of finding a site in which to construct a new
water tower. Neither the well nor water tower will be operational within the next
year. Without the new well and water tower, the City's water supply and
distribution system may not be capable of providing adequate water pressure for fire
flows to new residential subdivisions. If new residential subdivisions are approved,
there may be uncertainty as to whether they can be properly served by water.
Establishment of a new well will eliminate these questions and ensure that the
public health, safety and welfare are met.
4. City Zoning and Subdivision Standards. The City has not had an opportunity to
re-examine its official controls to determine if changes are needed. Specifically, the
City is considering, among other things, changes to lot size and density criteria and
has not formalized its policies or changes in that respect. Any work on the official
controls should occur after the City completes the update to its Comprehensive Plan.
State law requires consistency between the City's official controls and its
Comprehensive Plan. While the City has submitted its Comprehensive Plan to the
Metropolitan Council for review, the plan is incomplete and there is still a
considerable amount of work that needs to take place before the Metropolitan
Council will conduct its official review. This work includes updating the City's
land use plan and finalizing other elements of the City's Comprehensive Plan as
described in the staff report dated August 2, 2000.

WHEREAS, extending the moratorium will provide the City with the opportunity to
complete its planning process, and the objectives specifically laid out in the Interim Ordinance in
order to effectively guide and manage future development in the City, and to make informed
decisions about infrastructure investments.
NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE
CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does
approve a nine (9) month extension to the Interim Ordinance establishing a temporary development
moratorium on residential development within the Metropolitan Urban Service Area, as specifically
set forth in the Interim Ordinance as adopted by the City Council on August 2, 1999. The
temporary development moratoirum will be in effect until May 18, 2001, unless further extended,
or unless earlier terminated by the City Council by Resolution.
WHEREUPON, said Ordinance was declared passed and adopted by the City
Council this 5-4 day of , 2000.
