HomeMy WebLinkAbout1998.03.02 ORD 1998-318ORDINANCE 1998-318 AN ORDINANCE REPEALING THE EXISTING CHAPTER 263 IN ITS ENTIRETY AND ADOPTING A REVISED INDIVIDUAL SEWAGE TREATMENT SYSTEM ORDINANCE CHAPTER 263 - INDIVIDUAL SEWAGE TREATMENT SYSTEM 263-1. PURPOSE AND INTENT This Ordinance is adopted for the purpose of protecting the health, safety and welfare of the residents of Hugo through regulating the location, design, installation, use, and maintenance of individual sewage treatment systems so as to prevent contamination of surface and ground waters. 263-2. REPEAL OF INCONSISTENT ORDINANCE Chapter 263 - Individual Sewage Treatment Systems, as it existed at the time of adoption of this ordinance, is hereby repealed in its entirety and replaced with this ordinance. 263-3. ADOPTION OF WASHINGTON COUNTY INDIVIDUAL SEWAGE TREATMENT SYSTEM ORDINANCE Chapter 4 of the Washington County Development Code entitled "Individual Sewage Treatment System Regulations" as dated October 20, 1997, is hereby adopted by reference in its entirety as if herein printed in full, except as specifically changed in paragraphs 263-4 and 263-5 below. 263-4. LOCAL MODIFICATIONS OF COUNTY ORDINANCE Subd. A. Where reference is made to The Washington County Board of Commissioners, it shall be changed to read, "The Hugo City Council". Subd. B. Where reference is made to the Washington County Public Health Department, it shall be changed to read, "The City of Hugo Code Enforcement Officer". Subd. C. Where reference is made to the Washington County Board of Adjustment and Appeals, it shall be changed to read, "The City of Hugo Board of Adjustment and Appeals". Subd. D. Where reference is made to the Washington County Planning Advisory Commission, it shall be changed to read, "The Hugo City Council or designated agent'. Subd. E. The permitting authority under the Ordinance shall be the Hugo City Council. 263-5. REQUIRED INSPECTIONS Subd. A. The owners of Individual Sewage Treatment Systems shall have their system serviced at least once every three years. Such service shall include the removal of effluent from the holding tanks and a visual inspection of system components to determine if they are functioning adequately. The service must be performed by a person licensed to perform such work by the Minnesota Pollution Control Agency. Subd. B. A complete and accurate report of the inspection shall be provided to the City by the person performing the work. Such report shall be provided on forms provided by the City. Ordinance 1998 - Page 2 Subd. C. After January 1, 2001, where (1) the City has not, in any three-year period, received an inspection report as required in subpart B above for any Individual Sewage Treatment System; (2) after the City has deposited in the U.S. Mail, at least ten days apart, two written notices to the property owner of record stating the requirement to perform the required inspection; and (3) at least thirty days has elapsed since the mailing of the last notice, the City may direct any suitably licensed person to perform the inspection and service required. The cost of the inspection and service, plus a twenty-five percent administration fee, shall be assessed against the property on which the septic system was located. Such assessment is to be paid with the next year's property tax. Subd. D. The City Council shall, by resolution, adopt a fee to be charged for the reporting forms provided by the City. Such fee is to reimburse the City for its expenses in administering inspections of Individual Sewage Treatment Systems. Upon roll call, members voting AYE: Arcand, Barnes, Goiffon, Leroux, Miron Voting NAY: NONE Whereupon said ordinance was declared passed and adopted this 2nd day of March, 1998.
