HomeMy WebLinkAbout2015.07.06 RESO 2015-34RESOLUTION 2015-34 APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR OP3 PRAIRIE VILLAGE, LLC FOR "WATERS EDGE 5TH ADDITION" LOCATED NORTH OF 159TH STREET AND WEST OF ONEKA PARKWAY WHEREAS, OP3 Prairie Village, LLC, has requested approval of a final plat and development agreement to plat 13 lots to be known as "Waters Edge 5th Addition" located north of 159"' Street and West of Oneka parkway and is legally described as follows: OUTLOT H, WATERS EDGE NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat and development agreement to OP3 Prairie Village, LLC, for "Waters Edge Stn Addition" subject to the following conditions: 1. The final plat is approved to allow the construction of 13 single family homes and, in accordance the final plat plans received by the City and dated May 24, 2015, February 13, 2015, February 24, 2015, and April 28, 2015, except as amended by this resolution. 2. The final plat shall be subject to the preliminary plat approval granted by the City Council on December 15, 2003, and as amended. (Resolution # 2003-65). 3. Development is subject to the Waters Edge PUD standards and setbacks as followed. Minimum Lot Width 70 feet Minimum Front Yard Setback 25 feet Minimum Side Yard Setback 10 feet Minimum Rear Yard Setback 30 feet 4. The development shall comply with the comments in the Engineer's memo dated July 1, 2015. 5. The applicant shall construct Oneka Parkway to the north property line of the plat, as shown on the plans, including trails and sidewalks. 6. The applicant shall install the landscaping along Oneka Parkway and within the median per plans dated May 27, 2014. 7. The maintenance for the landscaping and irrigation for Oneka Parkway to be constructed shall be maintained by the Prairie Village Home Owners Association. 8. The landscaping planned for the development shall be installed all at the same time during each phase per approved plans. The developers shall take proper precautions to protect the trees as the homes are being built. Resolution 2015-34 Page 2 9. Each home shall include a minimum of 2 parking spaces within the driveway. The driveway widths shall be a maximum of 24 feet at the right of way line. 10. The plans shall be revised to have the same street name for the cul-de-sac on all plans. 11. Park dedication requirements have been stratified with previous phases of the development. 12. The developer shall obtain all necessary local, state, and federal permits. 13. The following conditions shall be timet prior to the Final Plat being recorded: a. The developer must obtain all necessary stormwater management and WCA permits from the City. b. A landscape plan for the development shall be reviewed and approved by staff. c. Documents incorporating the lots within the Prairie Village Home Owners Association shall be reviewed and approved by staff. The documents shall be recorded with the Final Plat and Development Agreement. d. Parkland dedication requirement has been satisfied with previous phases. e. The developer shall pay the sewer and water trunk fees for each lot at final plat. The City's SAC and WAC fees will be paid at the time building pennits issued. f The developer shall enter into a development agreement, shall agree to complete all improvements, and pay all fees as required by the agreement. 14. The following conditions shall be met prior to the issuance of building permits: a. The applicant shall file the final plat, development agreement and associated documents with Washington County. Proof of recording shall be provided to the City. b. The applicant shall submit one full set of approved final plans to the City. c. If a sales trailer is located in the property, a site plan and building elevations shall be submitted for City review and approval.
