HomeMy WebLinkAbout2015.08.03 RESO 2015-38RESOLUTION 2015-38 APPROVING PUD GENERAL PLAN FOR D.R.HORTON, ICN IMMESOTA FOR "CLEARWATER COVE" ON PROPERTY LOCATED SOUTH OF FRENCHMAN ROAD (CSAH 9) AND EAST OF EVERTON AVENUE NORTH WHEREAS, D.R. Horton, Inc — Minnesota has requested approval of a PUD general plan to allow 89 single family residential lots and 7 outlots on the 40.5 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by D.R. Horton, Inc—Minnesota, subject to the following conditions: 1. A PUD general plan is approved to allow the creation of 89 single family residential lots and 7 outlets. The development shall be constructed in accordance with the plans and application received by the City on June 18, 2015, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested rezoning of the 40.5 acre property and preliminary plat. 3. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. The applicant shall comply with all conditions in the City Engineer's letter dated July 16, 2015. 5. PUD flexibility is granted to allow: a) Flexibility to allow a minimum lot size of 8,103 square feet, where 10,400 square feet is required. b) Flexibility to allow a minimum lot width of 65 feet, were 80 feet is required by ordinance. c) Flexibility to allow a minimum front setback of 25 feet, where 30 feet is required. d) Flexibility to allow a minimum side yard setback of 7.5 feet, where 15 feet is required. e) Flexibility to allow building coverage on each lot to be 35%, where 30% is required. Resolution 2015-38 Page 2 f) Flexibility from the shoreland district requirements as below: 6. The preliminary phasing plan is generally approved. a. Phase I shall include: i. A 110 foot wide roadway and utility easement shall be dedicated to the City for the portion of Oneka Parkway not within the plat for construction of the road. it. The park equipment shall be fully installed per plans approved by the City. The 0.47 acres (Outlot F) shall be dedicated to the City. iii. The 8 foot wide bituminous public trail connection from Victor Gardens as shown in phase 1 shall be installed. b. Phase 2 shall include: i. The entire length of Oneka Parkway, from CSAR 8 to the development, shall be constructed as an urban section roadway to City standard, with sidewalk and trail, with the first layer of bituminous prior to issuance of a Certificate of Occupancy for the 1 st building. ii. The 8 foot wide bituminous public trail as shown in Phase 2 shall be installed. c. Phase 3 shall include: i. The 8 foot wide bituminous public trail as shown in Phase 3 shall be installed. The trail shall end at the cul-de-sac connections. An escrow shall be established with the City to extend the trail to the south plat boundary at the time deemed necessary by the City. 7. The building setbacks for the PUD are as follows: Minimum Setbacks Front 25 feet Front (Lots 7-12, Blk 2 and 35 feet Required Proposed Minimum Lot Size 15,000 square feet 8,103 square feet Minimum Lot Width 80 feet 65 feet Maximum Build Height 25 feet 35 feet 6. A stormwater re -use system, as shown in the plans, shall be constructed with the development. The final plans shall be reviewed and approved by staff. The system will be installed by the applicant, and owned/operated/maintained by the homeowner's association. 9. The applicant has indicated that an HOA will be established for the development to own/operate/maintain community areas, landscaping, and the water re -use system. The HOA documents shall be reviewed and approved by staff prior to the recording of the final plat for the Phase 1. 10. The applicant must comply with the following, prior to Final Plat and Final PUD Plan application: Landscaping and Righting a. The landscape plan shall be revised to include the number, size, and type of trees and shrubs in each proposed location. b. The landscape plan shall be revised to show boulevard trees along Oneka Parkway to match the existing landscaping north on the parkway. c. The final landscape plans must be submitted for review and approval by staff. Signage d. Final design of the entrance signage for the development shall be reviewed and approved by staff. e. The applicant shall enter into an easement agreement for access and maintenance of the landscaping and signage with in Outlot B and D. f The applicant shall obtain an access and maintenance easement for the development pillar sign on Lot 1, Block 6. Streets/Access g. The plans shall be revised to show Oneka Parkway as an urban section road to street standards, including the 8 foot bituminous trail on the east side and the 5 foot sidewalk on the west side. The final plans must be submitted for review and approval by staff.
