HomeMy WebLinkAbout2015.08.03 RESO 2015-39RESOLUTION 2015-39 APPROVING PRELIMINARY PLAT FOR CLEARWATER COVE ON PROPERTY LOCATED SOUTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF EVERTON AVENUE NORTH WHEREAS, D.R. Horton, Inc — Minnesota, has requested approval of a preliminary plat to allow construction of 89 single family lots and 7 outlots on the 56.6 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by D.R. Horton, Ino-- Minnesota, for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 89 single family home lots and 7 outlots, in accordance with the plans and application received by the City on June 18, 2015, except as amended by this resolution. 2. Approval is contingent upon City Council approval of a rezoning to PUD for the 40.5 acre portion of the site. 1 The preliminary phasing plan is generally approved. a. Phase I shall include: i. A 110 foot wide roadway and utility easement shall be dedicated to the City for the portion of Oneka Parkway not within the plat for construction of the road. ii. The park equipment shall be fully installed per plans approved by the City. The 0.47 acres (Outlot F) shall be dedicated to the City. iii. The 8 foot wide bituminous public trail connection from Victor Gardens as shown in phase 1 shall be installed. b. Phase 2 shall include: The entire length of Oneka Parkway, from CSAR 8 to the development, shall be constructed as an urban section roadway to City standard, with sidewalk and trail, with the first layer of bituminous prior to issuance of a Certificate of Occupancy for the 1 st building. Resolution 2015-39 Page 2 it. The 8 foot wide bituminous public trail as shown in Phase 2 shall be installed. c. Phase 3 shall include: i. The 8 foot wide bituminous public trail as shown in Phase 3 shall be installed. The trail shall end at the cul-de-sac connections. An escrow shall be established with the City to extend the trail to the south plat boundary at the time deemed necessary by the City. 4. The building setbacks for the PUD are as follows: Minimum Setbacks Front 25 feet Front (Lots 7-12, Blk 2 and Lots 1-6, Blk 3) 35 feet Side 7.5 feet Rear 30 feet 5. Outlot Use and Ownership a. Outlots A and C are unplanned but, proposed for future development and will retain the current ownership (LaValle). The outlots are unbuildable until a plan and new plat have been approved by the City. b. Outlets B and D are proposed for stormwater ponding and shall be deeded to the City. c. Outlet E is unplanned and will retain the current ownership (LaValle). The outlet is unbuildable until a plan and new plat have been approved by the City. d. Outlot F is proposed for a public park and shall be deeded to the City. e. Outlet G is unplanned, but proposed for future development and D.R. Horton will retain ownership. The outlot is unbuildable until a plan and new plat have been approved by the City. i. A 10 foot access easement shall be dedicated through a lot to access the outlet or it shall be absorbed into the residential lots. 6. The developer shall comply with the City standards for street lighting within the public right-of-way. 7. Prior to the release of the final plat for recording, the developer must comply with the following conditions. a. The developer must comply with all conditions outlined in the City Engineer's memos dated July 16, 2015. b. The developer must comply with Resolution 2015-38, for the PUD. The development shall comply with the Fire Chefs requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. d. The developer must obtain all necessary stormwater management and WCA permits from the City. e. The developer shall obtain all necessary local, state, and federal permits. f A permit shall be issued by Washington County for the connection to CSAR 8 for the construction of Oneka Parkway in Phase 2. This shall be complete prior to the recording of the Final Plat for Phase 2. g. The developer shall provide the Homeowners Association documents for review and approval by staff. h. The City's development fees will apply to this project. The fee amounts will be calculated and included as part of the Development Agreement. A development agreement shall be executed and all fees shall be paid. i. Park Dedication shall be paid for each lot platted at the amount of $2,400 per lot. j. A formula has been developed to determine the amount that the water hunk fee can be reduced based on the water re -use system, which would result in a 40% reduction in the hunk fee. This provision can be included in the Development Agreement. 8. Prior to the issuance of building permits, the developer must comply with the following conditions. a. The applicant shall record the final plat, development agreement and all other documentation at Washington County and provide the City with proof of recording. b. A Letter of Map Revision will need to be prepared and submitted for FEMA approval so that the existing floodplain boundaries and elevations can be revised per the plans.
