HomeMy WebLinkAbout2015.08.03 RESO 2015-40RESOLUTION 2015-40 APPROVING A PUD GENERAL PLAN FOR FRAUENSHUH COMMERCIAL REAL ESTATE FOR PARK DENTAL COMMERCIAL BUILDING ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (csah 8) AND EAST OF ELMCREST AVENUE NORTH WHEREAS, Fraueshuh Commercial Real Estate has requested approval of a PUD General Plan to allow construction of approximately 8,100 square feet of commercial building on 1.09 -acres of the property legally described as follows: Outlot A, Victor Gardens North Village 3' Addition, Washington County, Minnesota. WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Fraueshuh Commercial Real Estate for a PUD general plan, subject to the following conditions: 1. A PUD general plan/site plan is approved to allow development of 1 lot for a commercial building, in accordance with the application received by the City on June 18, 2015, and revised on July 13, 2015, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested extension of the final plat. 3. The development shall be consistent with the Victor Gardens North 3' Addition approvals (Resolution # 2006-19), except as otherwise noted herein. 4. Prior to issuance of building permits, the applicant must comply with the following conditions: a. All development fees shall be paid. b. The final plat shall be recorded at Washington County. Architecture a. Rooftop equipment shall be screened by parapet or roof forms. Material for screening shall be the same materials as the primary structure. b. Commercial building materials shall be revised and shown on the plans. The materials and colors shall be reviewed approved by staff. c. All building elevations shall receive nearly equal treatment and visual qualities. d. All building materials shall be of high quality and constructed of durable materials. Resolution 2015-40 Page 2 of 4 1) All block within the development shall be integral colored. No painted CMU will be permitted. 2) All stone on the building shall be Owens Corning Southern Ledgestone Chardonnay, which is consistent with the building materials elsewhere in the Victor Gardens North Village. 3) A revised material sample board that reflects the approved building materials and colors shall be submitted for City review and approval. 4) The applicant shall have an approval letter from the Victor Gardens Architectural Review Committee (ARC) for the building. e. Parking lot lighting shall be consistent with the fixtures used in the Victor Gardens North Village. Lights standards in parking lots shall be a consistent 30 -foot maximum height as specified in the Victor Gardens North Village Architectural Design Criteria. Details and cut sheets shall be submitted for city review and approval. f Downspouts or gutters are shown on the building. The plans shall be revised to clearly show locations and colors of gutter system. The plans shall be reviewed and approved by staff prior to installation. Signage g. The applicant is not showing signage on the north and south elevations. Signs are not approved in on these elevations. If the applicant's desire is to include signage on the north and south elevations, the building should be redesigned on those elevations to include a place for signage. This would require approval by the Planning Commission. h. The Victor Gardens North Village includes one monument on the shared property line between this site and Kwik Trip. One sign panel has been reserved for this property. No other freestanding signage is allowed. 1) Tenant signage shall only be allowed on that tenant's space. 2) Only one tenant wall sign per tenant per fagade is allowed. i. A sign permit is required for all signs. Tenants must submit a sign permit application to the city for review and approval prior to installing any signage. Parks and Trails j. The applicant has satisfied all park dedication requirements with previous phases of this development. No additional dedication is required. k. The applicant shall dedicate a 10 -foot public trail easement over Outlet B (the private street) for a future trail. Resolution 2015-40 Page 3 of 4 1. The applicant shall pay for and construct the public sidewalk that connects Rosemary Way to the private drive and the sidewalk on the north side of the private street. The maintenance of this sidewalk is the responsibility of the association or shall be detailed in the maintenance agreement between the three property owners. in. The private sidewalk shall be constructed with this phase. Construction details shall be submitted for city review and approval. Streets, Access and Parking n. No parking is permitted on the Private Road. o. Cross access and maintenance agreements to include this property shall be recorded with the final plat for the shared private street. ,Landscaping and Open Space p. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for review and approval by the City. q. The applicant shall be responsible for maintenance of the landscaping and irrigation systems on the property. Miscellaneous r. The applicant shall comply with all conditions from the City Engineer's memo dated July 16, 2015. s. A complete set of revised plans addressing the conditions of approval shall be submitted for city approval. Outstanding Victor Gardens North Village 3'd Addition Issues t. The applicant must provide proof that the final plat and all associated documents have been filed at Washington County. u. The following documents must be submitted reviewed and approved by the City Attorney. Upon City approval, the applicant shall file these documents at Washington County: 1) Articles of Incorporation of Victor Gardens Third Association 2) Declaration of Covenants, Conditions and Restrictions of Victor Gardens Third Association 3) Private Road, Easement And Maintenance Declaration 1. An alternative form of a maintenance agreement will be considered by City staff. Review and approval by City staff is required prior to the recording of the document. Items 1-3 above would be satisfied in this case. Resolution 2015-40 Page 4 of 4 4) Amendment to the Declaration of Easements (Signage, Roadway, Access—North Village) 5) Trail Easement Documents. 6) Deed from the landowner to the City of Hugo for Outlot A and Outlet C, Positive. v. The applicant shall obtain all necessary local, state, and federal permits. A permit from Washington County shall be issued for the CSAR 8 trail connection. w. One development identification sign (with no tenant signage) was approved for the east side of the Kwik Trip site as shown on the Master Sign Plan. The property owners have the right to install this sign upon receipt of a sign permit. 5. Prior to issuance of a certificate of occupancy, the applicant must comply with the following conditions: 1) All landscaping shall be fully installed. 2) All proposed sidewalks shall be installed.
