All Ayes. Motion carried. Approval of the Minutes for the August 20. 2015 HBA Networking Meeting Petryk made motion, Klein seconded, to approve the minutes for the Hugo Area Business Association networking meeting on August 20, 2015 as presented. All Ayes. Motion carried. Approval of the Minutes for the August 24. 2015 Midvear Budget Workshop Klein made motion, Miron seconded, to approve the minutes for the Midyear Budget Workshop on August 24, 2015 as presented. All Ayes. Motion carried. Approval of the Agenda Weidt made motion, Miron seconded, to approve the agenda as presented. All Ayes. Motion carried. Recognition of Rick Gwvnn as Former Planning Commission Member At its July 20, 2015 meeting, Council accepted the resignation Rick Gwynn from the Planning Commission and the Board of Zoning Appeals and Adjustments. Rick's involvement included work on the Shooting Ordinance and the South Ethan Avenue Street Project. Mayor Weidt and the Council presented Rick with a Certificate of Appreciation recognizing him for his six years of volunteer contribution to the City of Hugo. Approve Resolution Adopting Preliminary Tax Levy for 2016 All Ayes. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Appointment of Lvnette Andersen as Historical Commissioner At its July 6, 2015 meeting, Council approved the resignation of Historical Commissioner Kitty Cheesbrow and approved the advertisement for the vacancy. Lynette Anderson has submitted an application and met with staff and Historical Commission Chair Cynthia Schoonover. Adoption of the Consent Agenda approved the appointment of Lynette Andersen as the new Historical Commissioner to fill the vacancy with a term ending on December 31, 2017. Approve Pav Reauest No.2 to Arnt Construction for Rice Lake Meadows/Finale Ave Proiect Arnt Construction Company had submitted Pay Request No. 2 for the Rice Lake Meadows Street Reconstruction Project. Staff has inspected the project and found it to be satisfactorily complete for work done to date. Adoption of the Consent Agenda approved Pay Request No. 2 to Arnt Construction in the amount of $502,718.80. Approve Special Event Permit for Cruise for Troops on September 26, 2015 Russ Hanes had submitted an application on behalf of the Cruise for Troops for an event on September 26, 2015. Cruise for Troops pays tribute to fallen soldiers while raising money to help fund the education of the children who are left behind. The event is a combined car and motorcycle cruise beginning and ending at Running Aces in Columbus, MN. This requires a Hugo City Council Meeting Minutes for September 8, 2015 Page 3 of 6 Special Event Permit because over 800 cars and motorcycles are expected to participate in the run. The planned route is to use all County Roads; however, there is currently construction on the CSAH 7/8 Intersection. This construction is expected to be completed by September 24, 2015. If necessary, Goodview Avenue between CSAH8 and CSAH7 will be used at the detour. Adoption of the Consent Agenda approved the Special Event Permit for Cruise for Troops on September 26, 2015. Approve Purchase of Home at 14715 Forest Boulevard North Staff had negotiated a purchase agreement for the house at 14715 Forest Boulevard North, which is now available for purchase. The property is adjacent to other property the City owns along Highway 61 for future commercial redevelopment. The negotiated purchase price is $120,000. Adoption of the Consent Agenda approved the purchase of the home at 14715 Forest Boulevard North. Approve Hiring of Gary Birchem as Public Works Seasonal Emplovee Consistent with years past, seasonal help continues to be needed after the college -aged temporary employees return to school. Adoption of the Consent Agenda approved the hire of Gary Birchem to assist the Public Works Department in their seasonal needs into the fall of this year. Resolutions Declaring Cost. Assessment Role, and Hearing Date for Rice Lake Meadows Proiect The City Council Ordered the Rice Lake Meadows street improvement project on March 2, 2015, and awarded a construction contract to complete the project on June 1, 2015. The improvements are substantially completed, and staff is recommending that the Council move forward with the assessment process for the project. Adoption of the Consent Agenda approved RESOLUTION 201542 CALLING FOR THE PUBLIC HEARING ON THE PROPOSED ASSESSMENT FOR THE RICE LAKE MEADOWS STREET IMPROVEMENT PROJECT and RESOLUTION 201543 A RESOLUTION DECLARING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENTS FOR THE RICE LAKE MEADOWS STREET IMPROVEMENT PROJECT. All Ayes. Motion carried. Approve Resolution Adopting Preliminary Tax Lew for 2016 At its August 24, 2015 midyear budget workshop, the City Council listened to a presentation from Finance Director Ron Otkin highlighting revenues and expenditures to date as well as projections for the 2016 fiscal year. It was the consensus of the Council that the 2016 preliminary tax levy provide for no change in the urban tax rate. The total proposed 2016 property tax levy of $5,634,328 keeps the urban tax rate at 36.320% of tax capacity while the rural tax rate will decline by .012%. Adoption of the Consent Agenda approved RESOULTION 2015-44 APPROVING PRELIMINARY TAX LEVY PAYABLE IN 2016. Hugo City Council Meeting Minutes for September 8, 2015 Page 4 of 6 Public Hearing on the Easement Vacation for Petronack at 12997 Elmcrest Ave. N. Community Development Assistant Rachel Leitz explained the request from Michael and Debra Petronack to vacate the existing drainage and utility easement located over two properties that have recently been combined into one lot. The applicant has received approval of a variance for the location of an accessory structure with the condition that the two lots be combined. Now that this process has been completed, the existing drainage and utility easement needs to be vacated for the accessory structure to be built in the approved proposed location. Leitz explained that staff has reviewed the application and is comfortable with the request to vacate the drainage and utility easement. Mayor Weidt opened the public hearing. There were no comments, and Mayor Weidt closed the public hearing. Miron made motion, Klein seconded, to approve the notice to vacate the drainage and utility easement on property located at 12997 Elmcrest Avenue North. All Ayes. Motion carried. National Recvcling. Inc. CUP Amendment and Zoning Ordinance Text Amendment Rick Mark, owner of NRI, had applied for a zoning ordinance text amendment to revise the language in the performance standards for recycling centers. The applicant also requested a Conditional Use Permit (CUP) amendment to revise the site plan and conditions listed in the permit that allows for a recycling center on the property. City Administrator Bryan Bear provided a comparison of the current conditions of the site to the way it existed prior to the CUP approval in 2011 for a recycling center. The site was to be cleaned up following an approved transition plan. NRI had a site in Cambridge to aid in this plan; however, the site did not work how it was intended and is no longer a part of NRI. Bryan presented photos showing a vast majority of the scrap removed in 2013 and improvements to the site more recently. A pile of scrap still remained on the ground to be sorted. Bryan reminded Council that at the May 18, 2015 Council meeting, Council encouraged the applicant to proceed with an application to the Planning Commission for an amendment to the CUP and an Ordinance text amendment to allow the City to approve alternates for the storage, addressing the visual and noise impacts related to recycling materials on the ground. This would amend a current condition of the CUP that states no storage shall be on the ground. Staff is comfortable with allowing sorting and processing of scrap on the ground in a designated area to be surrounded by concrete bunkers. Revised landscaping and screening will keep the area out of view from Highway 61. Bryan explained that the Planning Commission held a public hearing at their meeting on September 24, 2015 and unanimously recommended Council approve the request. Bryan recommend that, if Council was comfortable with approving the ordinance text amendment and amended CUP, they should further terminate enforcement hearings and action earlier initiated by the Council. Hugo City Council Meeting Minutes for September 8, 2015 Page 5 of 6 Council discussed the importance of the service NRI provides to residents and agreed there has been improvements on the site. Klein made motion, Petryk seconded, to approve ORDINANCE 2015472 AMENDING CHAPTER 90, ARTICLE II, SECTION 90-257, RECYCLING CENTERS. All Ayes. Motion carried. Klein made motion, Petryk seconded, to approve RESOULTION 201545 APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR RICK MARK TO ALLOW RECYCLING CENTER USE ON THE PROPERTY LOCATED AT 15717 FOREST BOULEVARD NORTH. All Ayes. Motion carried. Petryk made motion, Miron seconded, to terminate enforcement hearings and action earlier initiated by the Council. All Ayes. Motion carried. Beaver Ponds Water Reuse Neighborhood ODen House City Engineer Jay Kennedy provided Council an update on the Beaver Ponds Water Reuse Project and requested that Council schedule a neighborhood open house with residents surrounding the park and pond. Kennedy explained that the last direction from Council was to proceed with the design work, and the cost is estimated to be $200,000. Met council had approved a grant for $50,000, and $100, 000 was estimated in future credits leaving $50,000 to be paid through City funds. Bids would be obtained in early October and the project would be completed by mid-May, 2016. Kennedy proposed a neighborhood open house to be held on September 24, 2015 from 6-7:30 at the Beaver Ponds Park pavilion. Petryk made motion, Klein seconded, to schedule a meeting for the Beaver Ponds Neighborhood open house on Thursday, September 24, 201 from 6-7:30 at the Beaver Ponds Park Pavilion. All Ayes. Motion carried. Approve Letter to Metroaolitan Council Suauorting Grant Funding At the Northeast Metro Water Summit held on July 16, 2015, participants requested information on grants available to fund storm water reuse projects. The Met Council provided this information and, after reviewing, the Rice Creek Watershed District sent a letter to the Met Council requesting they expand their grant program. Council agreed that increasing the funding was important to encourage and support all projects and to encourage others to be progressive in this area. Hugo City Council Meeting Minutes for September 8, 2015 Page 6 of 6 Weidt made motion, Klein seconded, to direct staff to write a letter to the Met Council supporting an increase in funding for the stormwater reuse grant program in 2016-2017 and thank them for their past support. All Ayes. Motion carried. Yellow Ribbon Network Report Council Member Klein reported to Council on the Yellow Ribbon Network activities held recently. Last month's Hamburger night was sponsored by Xcel Energy and there was a great turnout. The next hamburger night Wednesday, September 23, 2015. Tour de Hugo on Saturday. September 12. 2015 City Administrator Bryan Bear reminded Council of the Tour de Hugo bike event to be held on Saturday, September 12, 2015 beginning in Lions Park at 7:00 a.m. Riders can choose between a 6, 20, or 48 mile route. More information is available on the City's website. Fire Department Open House on Saturday. October 3, 2015 City Administrator Bryan Bear informed Council that the Hugo Fire Department will hold their annual Hugo Fire Department Open House on Saturday October 3, 2015 from 11 a.m. — 3 p.m. at the Hugo Fire Hall. A Fun Run will precede the Open House at 9 a.m. Petryk made motion, Klein seconded, to schedule the Fire Department Open House as a meeting on Saturday, October 3, 2015. All Ayes. Motion carried.
