PRESENT: Brunotte, Jesinsk:i, McAllister, Miron, Stolt man City Administrator, Ken Huber City Clerk:, Mary Ann Creager Miron made motion, McAllister seconded, to approve the minutes for the regular City Council meeting of August 5, 1991, as amended. All aye. Motion Carried. McAllister made motion, Brunotte seconded, to approve the minutes for the special City Council meeting of August 12, 1991, as submitted. All aye. Motion Carried. Miron made motion, Brunotte seconded, to approve the claims for August 19, 1991 in the amount of $52,613.34. All aye. Motion Carried. MINOR SUBDIVISION i'l?(D. VAL.ENTO- Mr. Don Valentto has made application to the City of Hugo for a minor subdivision, waiver of formal platting requirements, and variance from minimum lot size, to subdivide a 19.87 acre tract of land into two lot= of approximately 9.94 acres each. The parcel in question is located west of Everton Avenue, at the most northerly extension of said roadway. The tract is generally described as the S 1/2 of NE 1i4 of the SW 1i4 of Section 18, T31N, B21W, Hugo, MN., and is zoned agricultural. Everton Avenue is presently treated as a minimum -maintenance road, which serves large -lot agricultural uses in this area. The Planning Commission considered this request at their meeting of April 24, 1991, and unanimously recommended approval subject to special conditions. This matter was tabled by the City Council at their July 1" 1991 meeting, as a result of concerns raised regarding the ability to serve Tract i with on-site sewer, as well as access to Everton Avenue. The City Council reviewed a letter from the City Engineer regarding site -access. Mr. Kuusisto's letter indicates that the center line of the ' of dedicated right-of-way is the same as the east property line of Mr. Valento's property. Although the actual road alignment is not in the original right-of-way, there is no private property between the existing road surface and Mr. Valento's property, according to City records. The City Administrator reviewed the site plan as it relates to the roadway and access to Valento's property. Mayor Stoltzman and Councilman Miron felt that Mr. Valento and the Peltier family should attempt to settle their differences in this matter. The Council also -felt that the surveyors should provide written documentation substantiating their survey work:. Miron made motion, Jes.insk:i seconded, to table this matter until the=! meeting of September .?, 1991. All ave. Motion Carried. City Council meeting of August 19, 199.1. Page 2 POOL BUILDING INSPECTION (d UDD JACKSON As per City Council direction, the Building Inspector, the State Fire Marshal, the City Fire Marshal, the County Health Department, and the State Electrical Inspector conducted inspections of the Omni Fool building at 5118 130th Street, Hugo, MN. Copies of these reports were provided to the Council for review. In light of the number of violations cited in the information, Council direction on the City's next course of action would be appropriate. This matter was tabled from the August 5, 1991 regular meeting of the Hugo City Council. Stolt man made motion, McAllister seconded, that. Mr. Jackson be notified that the following violations be corrected within 90 days, or the time specified. At the end of the time period for making the corrections, the City's Building Inspector will perform, the necessary follow-up inspections, and report his findings to the Ordinance Violations Committee: 1.. Remodeling of the building without securing the required building permits. i'. The one hour fire rated construction has not been completed. 3. There is a gas line that does not meet the requirements of Section= 2208 and 213-F of the 1988 Uniform Mechanical Code. 4. Restroom facilities do not have mechanical ventilation, as required it Section 905-D of the 1988 Uniform Building Code. 5. Building owner has not applied for the required Special Use Permit to operate a welding shop in an industrial zone, as per Chapter 520-4, Subd . L. 6. No plans were submitted to the Building Department to verify that the walls installed as a result of remodeling in both bays are in compliance with City codes. 1. In bay C, the three doors into the office area do not meet the requirement of a 20 minute fire rating with self -closers. 8. The stairs leading to the mezzanine does not have 5/8" type :X sheetrock applied underneath, as required. 9. Approved fire extinguishers have not been placed in the shop area. 10. A hazardous waste generator- license has not been secured from Washington County, as required. 1.1. Over -head lights have not been wired to meet electrical code requirements. 12. Electrical outlets must be installed to properly service all appliances without the use of e?:tension cords. 13. All occupancy separation walls must be constructed to provide a one hour fire rating from floor to ceiling. 14. Some of the electrical wiring on-site does not meet requirements of the State Electrical Code. All Gaye. Motion Carried. C: I TY HALL_ PF RIK I NG Councilman Brunotte has requested that the Cit: Council consider and discuss the need to provide for designated parking around City Hall. City Council meeting of August 19, 1991 Page _ Currently, there is a great deal of traffic and pedestrian congestion around the City Hall facility during the summer months, particularly, when there are public meetings taking place the same time as Fire Department drills and athletic activities in the park. This matter was tabled from the August 5, 1991 regular meeting of the City Council. It was suggested that the ballfield parking be appropriately marked, and that ball players be asked, through the White Dear Recreation Department, to park: in the appropriate areas. VARIANCE REQUEST (QUADE) Dave and Joyce Quade of 1.x:9'6 Isleton Avenue North have made application to the City of Hugo for a variance to construct a 56' pole barn between the principal residence and Isleton Avenue North. The building in question will be located 20' off Isleton Avenue. The justification for this variance request has been provided by Mr. Cluade in his narrative letter dated August 81 1991. The property in question is zoned agriculture, and consists of approximately 18 acres. The proposed use of the structure is for personal storage and small animals. The building in questions is not to be used for commercial or industrial purposes. Miron made motion, McAllister seconded, to!approve the variance request of David Quade, 13936 Isleton Avenue, to construct a 22' x 56' pole barn between the principal residence and the road. The proposed building shall not be used for commercial or industrial purposes. All aye. Motion Carried. WHITE' BEAR CUMtiUN IT Y :,WNSEL. INS i PAYME NT REGIUgST ) White Bear Community Counseling Center has a formal request that the City of Hugo remit payment for services provided, in the amount $8,710.00, at this time. Although this is a budgeted item for the 1991 fiscal year, the City Council felt that they wanted to wait until the 1st part of September to see if the City Mould be receiving the revenues originally projected for this fiscal year. At a minimum, Ms. Williams is requesting a partial payment for services provided through August 30, 1991, in the amount of $5,809.00. McAllister made motion, Jesinski seconded, that the City make payment of $81713.00, to White Dear Community Counseling, for the 1991 contract. All ave. Motion Carried. McAllister made motion, Miron seconded, that the Cit: make payment of $2,760.000 to the Forest Lake Youth Service Bureau, for the 1991 contract. All aye. Motion Carried. PRQ. City Council meeting of August 19, 1991 Page 4 RESOLUTION ESTABLISHING COUNCIL PRIORITIES The City Council received a list of programs and projects reviewed by them at their previous priority workshops. The list reflects the Council's ranking of the various programs as community priorities. Brunotte made motion, McAllister seconded, to adopt RESOLUTION 1991-17, RESOLUTION SETTING 199-92 COUNCIL PRIORITIES. VOTING AYE: Brunotte, Jesinski, McAllister, Miron, Stoltzman VOTING NAY: None Notion Carried. The City Council directed the City Administrator to publish the results of the Community Development questionnaire. RESOLUTION ADOPTING PRE.L.IMINARY TAX LEVYiBUDGET As per the Truth -in -Taxation laws, the City is required to adopt a preliminary budget figure and tax levy, and have it certified with the County Auditor by September 3, 1991. Even though the Truth -in -Taxation hearings are not set until later in the Fall, and the final budget and tax, levy is not approved until December, the City Council is required to prepare a preliminary document. It should be noted that the Council has the latitude of reducing the tax levy and budget at its later hearings, but it cannot increase it above the amounts reflected in the submitted draft resolution. The numbers reflect the general tax levy equal to last year's levy, plus an amount to replace approximately $15,000 in lost local. government aid, and the necessary levy to fund the City's debt service. McAllister made motion, Stoltzman seconded, to adopt RESOLUTION 1991-14, RESOLUTION APPROVING PRELIMINARY 1992 BUDGET AND 1991 TAX LEVY COLLECTIBLE IN 1992. VOTING AYE: Brunotte, Jesinski, McAllister, Miron, Stoltzman VOTING NAY: None Motion Carried. McAllister made motion, Jesinski seconded, to adopt RESOLUTION 1991-15, RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT FOR CIP PROJECT, PHASE 2 STREET IMPROVEMENTS. VOTING AYE: Brunotte, Jesinski, McAllister, Miron, Stoltzman VOTING NAY: None Motion Carried. AP!lr )GE..'L CALENDAR I -.--.- The City Finance Director has prepared a tentative budget calendar for - your review. We are unable to finalize the various hearing dates, as the County and four school districts get first choice of the public hearing dates. The City cannot hold its hearings on the same days as the County or any of the school districts. City Council meeting of August 19, 1991 Page City Administrator Huber reported that we now have a schedule for the school district hearing dates, and the City Council may need to schedule a special meeting in November to have the budget hearing. Miron made motion, McAllister seconded, to approve the budget calendar as submitted by the Finance Director. All. aye. Motion Carried. BURLINGTON NORTHERN RAILROAD LETTER The City received a letter from the Burlington Northern Railroad regarding the unauthorized use of the discontinued railroad right-of-way within the Hugo area. Mayor Stoltzman stated that he will follow up on this matter regarding the posting of the right-of-way with NO TRESPASSING signs. HOWARD. KUUS I STO WATER; SUPPLY LETTER At the request of Mayor Stoltzman, City Engineer, Howard Kuusisto, submitted a letter regarding the future sites for a water tower east of Homestead Avenue and south of County Road 8A. This information is available to the Council for future consideration. MISCELLANEOUS The City received a letter from the Bald Eagle Sportsman Association regarding trespassing and illegal shooting taking place on their- property. City Administrator Huber reported that the meeting regarding the City's ambulance contract will be forthcoming. Mayor Stoltzman reported on the following: 1. Letter from Sonja Irlbeck regarding Dean Atk:inson's mining permit. 2. Letter from Chris Brown regarding the "almost" tennis league. 5. Notice from the RCWD regarding their upcoming budget hearing date. 4. Placement of Hank: Schnider's letter on the next Council agenda. 5. Retention of the City Administrator (contract).
