TRUTH IN TAXATION .f..AXATIC.IN HEARING Pursuant to Minnesota Statutes, the Hugo City Council has scheduled its mandatory truth -in -taxation hearing, prior to budget approval., on November 1.9, 1991, at ?:OOPM in the City Hall Council chambers. The:: appropriate legal notices were published in the paper, and other statutory requirements have been islet. City Administrator- Huber- reviewed the 1992 general fund budget and tax levy proposals, and further explained the actual percentage of tax increase paid by residents to City of Hugo. The Council proceeded to balance expenditures with; anticipated 1.992 revenues by reducing the following item -line budgets: ambulance service, brush - - e„l_It'i=a.l'ig, ��-tr�•:: maintenance, water management study, roads,r��('it.i 1:atr't_.et: materials. The first is to replace lost local government aid in the amount of $34,915.00. The second factor, which accounts for the remaining 5.8%, is to retire the additional debt incurred in both phases of the capital improvements program. The City Council previously adopted the proposed tax levy, which called for a 13.7% increase; however, the special assessments recently levied for the second phase of the capital improvements program, were used to reduce the total increase to 10%. it was noted that the truth -in -taxation regulations required that the City publish a notice in the official newspaper to taxpayers that the City originally proposed an increase of 18.3%' Stoltzman made motion, Brunotte seconded, to adopt RESOLUTION 1991-22, RESOLUTION APPROVING 1991 TAX LEVY COLLECTIBLE !N 1992. Annually, the City of Hugo certifies special assessments to the Washington County Auditor. These are assessments to benefiting property for various public improvements made pursuant to Chapter 429 of the Public Improvement Code. These special assessments are for the following: 1974 Improvement Bonds, 1988 Improvement Bonds, 1988 Series A Improvement Bonds, and 1991 Improvement Bonds. Barnes made motion, Brunotte seconded, to adopt RESOLUTION 1992-23, RESOLUTION CERTIFYING SPECIAL ASSESSMENTS FOR COLLECTION IN 1992' VOTING AYE: Barnes, Brunotte, Jesinski, Miron, Stoltzman Motion Carried. B.E.��QLUTMN CERTIFYING PAID T.LIT' BILLS Pursuant to Chapter 314-21 of the Municipal Code, the City staff is recommending that unpaid utility bills be placed on the tax rolls as liens against the properties identified herein, and collected purspant to the procedures outlined in the municipal code. The property owners affected in this resolution have been noLified ^hat these unpaid utility bills will be placed as liens against their property. Miron made motion, Jesinski seconded, to adopt RESOLUTION 1991-24, RESOLUTION DECLARING UNPAID UTILITY BTLLS BE FLACED ON THE TAX ROLLS. VOTING AYE: Barnes, Brunotte, Jesinski, Miron, Stoltzman Motion Carried. SPECIAL USE PERMIT --.-GUI-1 ROSSE, Mr. Louis Rosse, Jr., Donovan Heggestad, and Audrey Larson, have made application to the City of Hugo for a special use permit to construct a City Council meeting of November 19, 1991 Page ._ 48' X 72' pole shed prior to construction of a principal residence. This request was discussed in detail by the City Council at its November 4, 1991 regular meeting. Mr. Rosse appeared before the Council questioning why he needed this special use permit in that all his property is homesteaded, and the building was going to be used for farming purposes. There was a lengthy discussion regarding ownership of the roadway allowing Mr. Rosse access to his property, construction of agricultural buildings, and commercial businesses in pole buildings. It was agreed by the Council that if Mr. Rosse held fee title to the roadway connecting all of the lots he owns in this area, the Council would consider his property contiguous and one parcel for development purposes. Mr. Rosse was to provide the City staff with proof -of -fee ownership to the roadway. The Hugo Planning Commission recommended approval of the special use permit request to use the building for agricultural or residential purposes only, subject to the following special conditions: 1. The structure in question shall be used for agricultural or residential purposes only, and no commercial or industrial use of the property will be permitted. 2. The property owner has ___ months (to be determined by City Council) from time of special use permit approval to construct a principal residence on site. 3. A financial deposit, in the form of a letter of credit or cashier's check::, be provided to the City, in the amount of $0,000, assuring compliance with this permit. 4. The City staff be permitted access to the site at reasonable times for inspection to assure compliance with this permit. 5. This permit and approvals shall run with the land and shall be placed can file in the office of the County Recorder. S. f=ailure to comply with all conditions of the Special. Use Permit shall be grounds for revocation of same and forfeiture of the financial security required. This matter was tabled from the November 4, 1991, City Council meeting until such time as Mr. Rosse can provide more information on the ownership of the private roadway providing access to his residence. Mr-. Rosse indicated that he would like to be placed on tonight's agenda and have his request considered by the City Council. Mr. Rosse stated that Washington County now holds title to the easement., because Gerald Dabe failed to pay taxes on the property. He stated that he was not interested in having any conditions placed on his use of the building, and because his property wns homesteaded, and the building was to be used for agricultural purposes, the Council should just issue him a permit. Councilman Barnes stated that she was not ready to ignore the existing ordinance, and allow construction of the building without a special use permit. She felt that the real issue is whether- the Council wants to nhange the ordinance to allow accessory buildings on land that has no principal structure. Councilman Miron agreed, and stated that review of this ordinance= should be a top priority for the Council. Mr-. Rosse agreed to tabling his request until May of 1991, to allow the Council t.ir,e to review, and possibly amend, this ordinance. Miron nude motion, Barnes seconded, to table the Louis Rosse application for a SUP until the :1st meeting in May, 1992, to allow for Council City Council meeting of November 19, 1991 Page 4 discussion of the ordinance regarding construction Df accessory buildings without a principal structure. Kurt and Jean Melancon of 1054 Conway St., St. Paul, have made application to the City of Hugo for a variance to construct an oversized garage on their property identified as 6480 125th 8t. No., Hugo, MN. The property is located on 125th St. just east of Goodview Ave. The parcel is zoned agricultural and consists of approximately 10 acres. The applicant is requesting an attached garage, not to exceed 858 square feet, which nxceeds the 720 sq. ft. allowed' The request in question is consistent with the policy regarding oversized garages in agricultural districts. Stoltzman made motion, Miron seconded, to approve the variance request of Kurt and Jean Melancon to construct an attached garage, not to exceed 858 square feet, on their property located at 6480 125th Street. The proposed garage is to be used for residential purposes only. All aye. Motion Carried. COUNCIL OLICY-RECOMMENDATION The City Council received a copy of a letter from Mr' David Schumann recommending Council policy regarding the renewal of service contracts an' reinstatements. He indicates that the current situation for the Council is frustrating, and does not give the City Council adequate time to evaluate current services and benefit from competitive alternatives, where available. He also suggests that competitive bids be considered for services, which he feels would be a benefit to the taxpayers. He also suggests that the Council members and the official newspaper be notified three meetings prior to upcoming service contract renewals so that bids can be taken. In recommending this policy, Mr. Schumann states, "Adoption of this sort of policy would allow better thought-out decisions, it would allow the Council to be more fiscally responsible to our public, and the City of Hugo would be assured of superio.' services". Councilman Miron agreed with Mr. Schumann, and Councilmember Barnes suggested the Council Le provided with a list of service contracts that require annual renewal. Miron made motion, Brunotte seconded, directing the City staff to pstabiish a calendar o7 services and contracts requiring annual review, and that these matters be placed on Council agendas three meetings prior tc agreement expiration. COUNCI_ AGENDA FARATION'��JCY Councilmember Debra Barnes has requested Council consideration of a chang' of policy with regard to preparation of the Council agenda and cutoff dates for same. Administrator Huber stated that administratively there would be problem in getting Council packets out a couple days earlier. City Council meeting of November 19, 1991 Page 5 The inconvenience would be placed on the applicants in that they might experience further time delays because of the earlier cutoff. Councilmember Barnes withdrew her suggestion from consideration. REDISTRICTING PRESENTATION Pursuant to Minnesota Statutes, the City of Hugo is required to complete a redistricting plan that more evenly distributes population within its wards. In reviewing this redistricting, the City has to take into account handicapped accessible polling places, legislative district boundaries, and physical features. The Council received a copy of the current ward boundaries and the breakdown of population distribution by wards. Consistent with Minnesota Statutes, we have prepared two alternatives for Council consideration. Both Plan A and Plan B divide Ward 3 into two precincts in an effort to reflect a portion of Hugo being added to legislative district 56-A. Administrator Huber reviewed both plans as they define changes in ward boundaries. The Council stated that they preferred Plan A because of fewer changes in the existing ward structure. Stoltzman made motion, Miron seconded, to adopt RESOLUTION 1991-25, RESOLUTION APPROVING REDISTRICTING FOR ESTABLISHMENT OF MUNICIPAL WARD AND PRECINCT BOUNDARIES. VOTING AYE: Barnes, Brunotte, Jesinski, Miron, Stoltzman Motion Carried. ' APPOINTMENTS TO PLANNING COMMISSION The Planning Commission terms previously held by Gail Thoreson and Debra Barnes expire on December 31st of this year. Debra Barnes has resigned her position to serve on the City Council, and Ms' Thoreson has indicated she will not be attending any more Planning Commission meetings this year. She has also indicated she does not want to be reappointed to the Commission. With the two immediate vacancies on the Planning Commission, the City staff is recommending that appointments be made for the balance of this year, and for four-year terms beginning January 1, 1992. Stoltzman made motion, Brunotte seconded, appointing Ken Rubenzer and Brian Olson to fill vacancies on the Hugo Planning Commission. Both terms will expire December of 1995. All aye' Motion Carried. APPOINTMENT TO BOARD OF ZONING ADJUSTMENTS As a result of Ms. Debra Barnes's appointment to the City Council, there is a vacancy on the Board of Zoning Adjustments. As per City ordinance, the replacement on the Board of Zoning Adjustments must come from the Hugo Planning Commission membership. The City Council asked that this matter be discussed by the Planning Commission at their meeting of November 26, 1991 to see if a member will volunteer to fill the position' City Council meeting of November- 19, 1991 Page 'V- ACCEPTANCE OF RJDL_.IC ROADWAYS Three roadways have now been permanently sur;aced and built to City specifications. City Engineer Howard Kuusisto is recommending their acceptance as public roadways for snow plowing and maintenance purpc,ses. Miron made motion, Stolt man seconded, to azcept the following streets for snow plowing and routine maintenance only: 1. Farnham Avenue from 1130th Street south to 128th Street. 2. 121st Street and Isleton Avenue, in the plat of Round Lake Addition. _. Freeland Avenue, 135th Street, and Geneva Avenue, in the Flat of Birch Tree Fonds, 2nd Addition. All aye. Motion Carried. MINING PERMIT RENEWAL_ - (G._ INDYF-:IEWICZ� Mr. George Indykiewicz of 1920 Highway 96, New Brighton, Minnesota has made application to the City of Hugo for the mining of black dirt and sand fill on his property located west of Highway 61 and north of 152nd St. The property is zoned agricultural and consists of approximately 165 acres. Mr. Indykiewicz has secured an annL•al mining permit for a number of years. Mr. Indyk:iewicz has requested renewal of the mining permit, as previously approved, with the exception that conditions 7 and 9 be deletec from the permit. Mr. Indykiewicz stated that these conditions removed because they were completed approximately 10 years ago. Administrator Huber stated that if these items were removed, the legal description for- the orthe mining permit should be changed by deleting the property affected by these conditions. Mr. Indykiewicz agreed to the leave the existing permit as approved for 1991. Drunotte made motion, Jesinsk.i seconded, to renew the dining Permit for George Indykiewicz until November 1, 1992, subject to the previous 28 conditions noted therein. All aye. Motion Carried. SET SPECIAL... MEETING DATE. .:special Prosecutor Jeff Carson has requested a meeting with the Ci.tV Council to discuss matters of litigation regarding the prosecution of Mr. David Schumann. He has requested a meeting on Monday, November- 25, 1991, at 7:OOPM, in the ,ity Hall Council chambers. Mr. Carson has indic.ted he will also try to arrange to have Ms. Barbar -:a Hatch present that evening. CITY ADMINISTRATOR Administrator reported on the following: Only two roads in CIF 2 did not receive fianl bituminous surfacing prior to winter setting in. The City received an appeal of an assessment for the CIF, Phase 2 from Mr. Dan San tann i . MISCELLANEOUS Councilmember Barnes requested she be provided a status report of the water management study. Administrator Huber- stated that the report is being prepared.
