PRESENT: McAllister, Jesinsk:i, Olson, Vail, Atkinson City Administrator, f:en Huber City Engineer, Howard Kuusisto City Clerk:, Mary Ann Creager McAllister made motion, Vail seconded, to approve the minutes for the regular City Council meeting of July 16, 1990 as submitted. All aye. Motion Carried. Vail made motion, Jesinski seconded, to approve the claims for August 6, 1990 in the amount of $53,486.29. All aye. Motion Carried. SPECIAL USE PERMIT - TEMPORARY CLASSROOM (SCHOOL DISTRICT #834) On behalf of the Stillwater School District (Independent 834), Mr. Dan Parker has made application to the City of Hugo for a special use permit to place a self-contained classroom on their property at 10158 122nd St. No., Hugo, Minnesota. The 24' X 40' temporary structure will be located west of the original school facility, and will be used for educational purposes only. The property in question is zoned agricultural and consists of approximately 9 acres. This will be the third addition to the original Withrow School facility, with other additions being built in 1965 and again in 1974. The applicants have indicated that it is their intent to use this facility throe.►gh the 1996 calendar year. They have been notified that construction and operation of this temporary facility must meet building code requirements for temporary public facilities of this nature. The structure in question appears to meet all setback requirements and other zoning requirements. The Planning Commission has recommended approval subject to special conditions. McAllister made motion, Olson seconded, to approve the request of School District #e34 for a Special Use Permit to place a 24' x: 40' self-contained classroom on their property at 10158 122nd Street. Approval is subject to the following special conditions: 1. The building in question must meet all state building code All aye. The structure in question shall be removed from the site within 6t) days of permit expiration. 4. The structure in question to be located at least 20' from the identified septic system on site. S. Page VAR.I HNCE RECIUEST (, QC1JR I FSE R )_ Mr. Randy Schriber has made application to the City of Hugo to construct 900 square foot attached garage at 15275 Elmcrest Avenue, Hugo, MN. The structure in question appears to meet all building setback requirements, and the request is consistent with the City's policy regarding over -sized garages in agricultural zoning districts. The applicant has indicated that the garage in question is to be used for the storage of his automobiles and lawn -maintenance equipment, and will be for residential purposes only. Jesinski made motion, McAllister seconded, to approve the variance request of Mr. Randy Schriber to construct a 900 square foot attached garage at 15275 Elmcrest Avenue. The garage shall be used for residential purposes only. All aye. Motion Carried. VARIANCE REQUEST i HUSN I F:: ) On behalf of 6 & H Builders, Inc., Mr. Paul Husnik: has made application to the City of Hugo for a variance to construct a 580 square foot attached garage on Lot 6, Block: 2. Bald Eagle Estates subdivision (aka 497 3 126th Street. North). The garage in question will be for residential use only. The site is zoned SFE, and consists of approximately one acre. The request in question is consistent with the City's policy regarding over -sized garages in an SFE zoning district. McAllister made motion, Vail seconded, to approve the variance request of G s, H Builders to construct a 990 square foot attached garage on Lot 6, Block: 2, Bald Eagle Estates (aka 4970 126th Street North) . Motion Carried. t1 I tdi )R_ St7Plj l: V I S I ClhljED l�li cUGH ) Mr. Ed Waugh has made application to the City of Hugo for a minor subdivision, and waiver of the formal platting requirement=_, to subdivide a 14.8 acre tract of land into two lots. The property in question is presently zoned RB, and is located at the southeast corner of Highway 61 and County Rd. SA. The primary purpose of the subdivision is to accommodate the sale of a two acre tract of land for the construction of a Tom Thumb Superette with gas -pumping facilities and a car wash. This development is subject to special use permit review. The minor subdivision proposed is effected by the following physical constraints: 1. County Rd. 8A on the north. 2. Trunt Highway 6.1 on the west. 5. A major drainage area and flood plain on the east. The drainage easement on site has been identified as per request of the Rices Creek Watershed District. Thr Washington County Highway Department - has requested that the City require the dedication of an additional 7 feet. City Council meetinq of AUnUSt b, 1990 Wage ._ of right-of-way on County Rd. 8A to help accommodate improvements to this roadway in the future. The county needs a total of 80 ft. of right-of-way and currently there is bb ft, of right-of-way in this area. The survey in question appears to meet the technical requirements of the City's ordinance. Additional property owned by Mr. Waugh has been attached to Parcel D so that said tract has direct access to a public roadway. Mr. Waugh has been notified that any future subdivision of the site would require formal platting. The applicant has now secured the required permits from the RCWD and Washington County Engineering Dept. Vail made motion, Olson seconded, to approve the final Certificate of Survey #8-6-90, and waiver of the formal platting requirements, as requested by Mr. Ed Waugh, to subdivide a 14.8 acre tract of land into two lots. The property to be divided is located at the south east corner of Highway bl and County Road 8A. Approval is subject to the following special conditions: 1. Any further subdivision of all or a part of this site shall be by formal platting. 2. The dedication of an additional 7' of right-of-way on County Rd. SA to accommodate future improvements to the road. 3. All lots shall have direct access to an improved public roadway and shall be served with municipal utilities. 4. All conditions of survey approval must be met prior to the stamping of any deeds for recording by the city clerk:. unless otherwise permitted by Council action. 5. The property lines on site must be identified by the applicants to assure proper setbacks when buildings are to be constructed if required by the building inspector. b. Proposed driveways or drainage areas within the development must include installation of a minimum 15" diameter corrugated metal culvert in a manner acceptable to the City. 7. No building permits shall be issued until the survey has been approved and recorded with Washington County. 8. All fees relating to this subdivision shall. be paid by the applicant including the cost of recording documents witi-Washington County. 9. Driveway access to highways or county roads will not be permitted until the necessary permits are secured from Washington County and the Minnesota Dept. of Transportation. 1U. Payment of fee in lieu of park:.land dedication shall be paid to the city prior to final plat approval. 11. This approval shall be granted with the understanding that said subdivision does not create any landlocked parcels by the petitioner and land owner. 12. No improvements, landscaping, or grading shall be permitted in the defined drainage areas without the express written authorization of the City and the approved watershed districts. 1._,. All property owners shall be responsible for maintenance of drainage areas within easements on their property. 14. Developer shall comply with all requirements and restrictions applicable to identified wetlands. 16. No significant deviations from the :approved preliminary survey shall be permitted unless reviewed by the Planning Commission prior to C;ourIcil approval. City Council meeting of August 6, 199C! Page 4 17. The developer shall permit access to the referenced site for periodic inspections to assure conformance with this subdivision approval. All aye. Motion Carried. SPECIAL USE PERMIT (ED WAUGH) Mr. Ed Waugh has made application to the City of Hugo for a special use permit to construct a superette, gas station, and car wash in an RB zoning district. The site in question is located at the southeast corner of the intersection of Highway 61 and County Rd. 8A and consists of approximately L acres. This request is being made contingent on approval of the minor subdivision approved earlier by the City Council. The building proposed will be approximately 18' in height and 7,000 sq. ft. in size. The City staff has requested that the developers give the City some indication of the hours of operation of this business. The proposal in question appears to be consistent with the City's comprehensive plan, and is permitted in an RAS district by special use permit. The City Engineer has indicated that the amount of water used by the car wash should not have a significant effect on water pressure serving the residential homes in this area. McAllister Heade motion, Jail seconded, to approve the Special Use Permit application of Mr. Ed Waugh to construct a. superett.e, gas pumps, and car wash at the south east corner of the intersection of Highway 61 and County Road 8A. Approval is subject to the following special conditions: 1. The buried gasoline tanks on site to be installed and maintained as per County Health Department and MPCA regulations. The pump island is to be no lower than 932.33 mean sea level. . The site be maintained on a regular basis and kept free of litter- and other on site nuisances. 3. All advertising signs and related lighting be in compliance with City regulations. 4. The site plan.approved be, and is, a part of this special use permit. 5. All refuse on site be stored in the screened area as identified on the site plan. 6. No exterior storage shall be permitted on site. 7. The parking areas are to provide for short-term parking of motor vehicles only. S. Driveway and road access permits must be secured from the MNDOT and Washington County before the building permit is issued. 9. All parking and drive areas shown on the site shall be of bituminous surface, and shall be installed as per requirements of the city engineer. 10. Submittal of all permits and drainage plans from the Rice Creel:: Watershed District. 11. Handicapped facilities and parking shall be provided. 12. The site in question must be plowed on a regular basis in the winter time. 10. Regular garbage and refuse service shall be pro•✓ided. 14. Bituminous curbing shall be installed on the north and western edges of the Eite near the buried gasoline tanks to prevent any spillage of gasoline into the ditch systems adjacent to the site. City CoUncil meeting of August 6, 1990 Page 5 15. All conditions of the special use permit must be met prior to issuance of the certificate of occupancy. 16. A building permit must be applied for within 1211 days from permit approval, and substantial construction of any building and improvements must be underway within 1270 days of permit issuance. 17. Property lines must be identified on site by owner to assure proper' setbacks when buildings are to be constructed, if required by the code enforcement officer. 18. No significant deviations from the approved site plan shall be permitted. 19. Encroachment into the designated easement on site shall be prohibited. 20. The applicant and/or owner shall permit access to the referenced site at reasonable times for periodic inspections to assure compliance with this permit. 21. On-site facilities shall be served with municipal sewer and water, as per City policy. ^?. No automotive repair or e-terior sales shall be permitted on site. All aye. Motion Carried. PARk" IMPROVEMENT PROGRAM As per Council direction, the City Engineer has prepared a part:: develop- ment plan, which would improve the ballfields on the part: north of City Hall. The plan involves the reorientation of the ball diamonds, upgrading of the facilities, and additional parking. The intent of the plan is to be establish a focal point for the athletic complex around the part:: shelter, the restrooms, and concession stand area iU=_.t north of the water tower. Cost estimates have been prepared, and submitted to the Council. for their review. It should be noted that Phase 1 of this improvement car, also be divided into two phases, as each ball diamond can be improved without an impact on the other. It would be our intent to fund all, or any portion of this plan, from the City's part -.-.land acquisition and development fund. Atkinson made motion, 'Fail seconded, to approve the part::./ballfields plan, as prepared by the staff, and authorize preparation of plans and specifications for the proposed part:: development plan, Phase 1, in the amount of approximately $46,000, to be started this fall and completed ne;:t spring. APPOINTMENT OF 1990 ELECTION JUDGES Atkinson made motion, Olson seconded, to adopt RESOLUTION 199(-_)-221 RESOLUTION APPOINTING ELECTION JUDGES FOR THE PRIMARY AND GENERAL ELECTION IN 1990. S . 1_F E QUES1__F OR FUtJi Ll ffjj The St. Croix: Valley Area Community Volunteer Service organization has requested an opportunity to appear before the City Council to explain their program, and request a financial contribution toward the services that they provide to the citizens of Hugo. Mr. Bruce Abercrombie and Mr-. Bob Colombo were present at the meeting to explain their service and need for financial assistance from the City, in the amount of $700.00. The Council directed City staff to include this request in the City's 1991 budget proposal for further consideration. CIF' (ROADS FEASIBIL.IT`r REPORT) As per Council direction, the City Engineer has updated his cost estimates for Phase ? of the City's CIF' program. The Phase 2 program referenced is consistent with the original CIP program adopted by the City Council earlier. The only exception to this plan is the addition of Hilo and Henna Avenues, from 132nd Street south to 125th Street. If it is the intent of the City Council to pursue Phase 2 of the CIP program, it will be necessary to order the appropriate feasibility report so additional design and cost information can be developed. Initially, it would be the intent of the City to pursue this project based on current Council policy for collector streets..
