PRESENT: McAllister, Jesinsk:i, Olson, Vail, Atkinson City Administrator, Ken Huber City Attorney, Charles Johnson City Clerk, Mary Ann Creager Jesinsk:i made motion, Vail seconded, to approve the minutes of the regular City Council meeting of August 20, 1990 as submitted. All ave. Motion Carried. Vail made motion, Olson seconded, to approve the claims for September 4, 19?0 in the amount of $25,491.35. All aye. Motion Carried. VARIANCE REQUESTER -SIZED GARAGE) Bob and Terry Brandt have made application to the City of Hugo for a variance to construct a 1,127 square foot attached garage on Lot Z, Block 1, Anderson Hills subdivision (aka 9110 152nd Street North). The property in question is zoned agricultural., and consists of 10 acres. The garage is to accommodate the parking of two motor vehicles., a boat, and other items of a residential nature. No commercial activity is to be conducted at this residence. The request in question is consistent with the City Council's current policy regarding over -sued garages in agricultural zones. McAllister made motion, Jesinski seconded, to approve the variance request. of Bob and Terry Brandt to construct a 1,127 square foot attached garage on Lot 3, Block: 1, Anderson Hills (aka 9110 152nd Street North). VARIANCE REQUEST (SLIPKA/THIESEN/MANKE) Arnold Mank:e, David Slipk:a, and Robert Thiesen have made application to the City of Hugo for a variance to allow for the construction of a single family dwelling in a location where the lot is only 185' in width at the building setback:: line. The minimum lot width at the building setback: line in an agricultural district is 100'. The structure in question {-could be located approximately 400' from the road. The property in question is .located south of 165th Street and west of Fenway Avenue approximately 1000', and is generally described as the NE 1/4 of the SE 1/4 of Section 7, T31N, R21W, Hugo, Minnesota (aka tax parcel #93007-2100). The site in question contains approximately 15.8 acres. Although the lot is approximately 685' in width at a point 600' from, 165th St., the applicants Have indicated that the site in question is not conducive to constructing a dwelling this far back: from the road. Because of the large area of wetlands, they feel they will be limited to where they can locate a septic system and put accessory buildings on the site in the future. City Cc.uncil meeting of September 4, 1.990) Page There is apparently an old foundation on the site at this time, and the applicants have indicated that it will be removed or demolished and covered up if this variance is granted. Percolation tests have beer-+ prepared to serve the proposed home location noted on the site plan. The proposed driveway will cross an identified ditch on site, as well as the road ditch on 165th St. Both crossings shall be permitted only if approved by the city engineer, utilizing the properly sized culverts installed in a manner acceptable to said engineer-. This matter was reviewed by the Zoning Board of Adjustments at their meeting of August 22, 1990, and they unanimously recommended approval of this variance request. McAllister made motion, Olson seconded, to approve the variance request of Arnold Mank:e, David Slipka, and Robert Thiesen for the construction of a single family dwelling in a location where the lot is only 135' in width at the building setback line rather than the required 300' width. The property is described as the NE 1/4 of the SE 1/4 of Section 7, T31N, R21W (Parcel #93007-2100). Approval being subject to removal of old building foundation and installation of the ditch culverts, as required. All aye. Motion Carried. OREST LAKE YOUTH SERVICE BUREAU PRESENTATION As per Council direction, a FLYSB representative appeared before the Council to explain their program in conjunction with their budget request. The City Council approved funding support of the Youth Service Bureau in the amount of $2,620 in 19?0, and the 1991 request is $2,760. SET BUDGET HEARING DATES Atkinson made motion, McAllister seconded, that the City Council set the formal budget hearing date for Monday, December 3, 1990, with an alternate date for December 1.1., 1990. All ave. Motion Carried. KENCO HOMES (SIGN REQUEST Representatives of Kenco Homes are requesting Council approval to install. a temporary sign at the intersection of County Road EA and Highway 61. (southeast corner) prior- to the Parade of Homes this fall. The applicant-.; will be formally applying for a Special. Use Permit to install a sign o7 a more permanent nature while they are building fomes in the Birch Tree Ponds subdivision. It is our understanding that the sign will be taken down if the SUP is not approved by the Planning Commission and Council. Because the City Council felt that the issuance of a temporary sign, prior to the holding of a public hearing would circumvent the public process, the following motion was made: McAllister made motion, Olson seconded, to deny the request of Kenco Home to install a temporary sign at the south east corner of County Road 8A an( - Highway 61, and the matter be referred to the Planning Commission fc-r• the required public hearing. Atkinson made motion, Jesi.nski seconded, that the Cit;: of Hugo hire Troy Anderson to serve as Hugo's compost site monitor from 9/5/90 until 11/19/90. VOTING AYE: Jesinsk:i, Olson, Vail, Atkinson ABSTAINED: McAllister Motion Carried. McAllister made motion, Atkinson seconded, to extend the internship of Scott Holm until October 31, 1990. All aye. Motion Carried. REPORTS OF OFFICERS The City Council went into executive session to discuss the status of various matters in litigation. Mayor Atkinson and Councilmen McAllister, Jesinsk:i, Olson, and flail were present, as well as Attorneys Richard Hocking and Charles Johnson, City Administrator Ken Huber, and City Clerk: Mary Ann Creager. Mr. Hocking and Mr. Johnson reviewed the status of these matters with the Council. At 9:45 PM, the executive session adjourned and the regular meeting was called back: to order. Atkinson made motion, flail seconded, that the City of Hugo attempt to enter into a Settlement Agreement with Stanford Krueger to prohibit illegal use of his pole building, provide for periodic inspections by the City's Building Inspector, and no later than June 30, 1991 to commence significant construction of a residence on his property. Upon satisfaction of these conditions, the Cit;: would drop legal action to have the building removed. All. aye. Motion Carried. McAllister made motion, Olson seconded, authorizing the City's legal staff to initiate civil proceedings against David and/or- Carol Schumann charging them with the following: 1. Operating an illegal auto -body business. __. Operating an illegal auto -dismantling yard. 0. Operating an illegal landfill. 4. Construction and maintaining of an illegal accessory building. 5.
