The meeting was called to order by Mayor Atkinson at 7:00 PM.

Olson made motion, Vail seconded, to approve the minutes of the regular
City Council meeting of October 1, 1990, as submitted.
All aye. Motion Carried.
McAllister made motion, JeinsE::i seconded, to approve the claims for
October 15, 1990, in the amount of $23,796.69.
All aye. Motion Carried.
CHARITABLE GAMBLING
Atkinson made motion, Vail seconded, that the City of Hugo has no
objection to the issuance of a charitable gambling license to the National
Multiple Schlerosis Society at Ricci's Saloon, 14777 Forest Blvd., and
waiver of. the 60 -day waiting period.

SPECIAL USE PERMIT (B. BERNIN)
Mr. Bruce Bernin has made application to the City of Hugo for a special
use permit which would authorize the seasonal sale of Christmas trees on
his property at 6540 Greene Ave. No., Hugo, Minnesota (aka Gov't Lot 5,
Sec. 16, T31N, R21W, Washington County, MN). The property is located at
the southwest end of Oneka Lake, adjacent to the public access. The site
plan submitted shows that there are six, different Christmas tree fields,
in addition to the home and out buildings, owned by Mr. Bernin. The
method of operation would involve customers driving to the site, choosing,
and cutting their own Christmas trees. This request is for a seasonal
operation running from November 23 to Dec. 24 of each year. Mr. Bernin is
requesting authorization to install signs on his property at two locations
as reflected on the site plan. He is also requesting that other signs be
authorized on the property of others. In reviewing this request, the City
staff can see no problem with the plan as submitted, as long as activities
on site are limited to those requested by the applicant. With regard to
the off-site signs proposed, the applicant has not indicated the size or
location of the signs, so it is difficult for the City staff to comment on
whether or not they would be in compliance with City ordinances. The
permanent sign locations do not appear to present a problem. It should be
noted that temporary signs are allowed in residential districts if they do
not exceed 12 sq. ft. in size, and are not left for a period that exceeds
30 days. It should also be pointed out that advertising signs are not
permitted within 100 ft. of a residential zoning district. The Hugo
Planning Commission recommended approval of this SUP for the sale of
Christmas trees at 6540 Greene Avenue North, subject to special
conditions.

McAllister made motion, Olson seconded, to approve the request of Mr.
Bruce Bernin for a Special Use Permit, authorizing the seasonal sale of
Christmas trees on his property at 6540 Greene Avenue (aka Gov't Lot 5,
Section 16, T•31N, R21W, Washington County, MN). Approval is subject to
the following special conditions:
1. The permit allows for the sale of trees from November 23rd to December
24th of each calendar year.
2. Sales on site be limited to Christmas trees.
.3. Off-street parking be provided for all customers.
4. Failure to comply with conditions of the permit shall be grounds for
revocation of same.
5. The site plan submitted be and hereby is a part of this permit.
6. The permanent signs to be installed on the site in question must be in
compliance with the city's sign and setback regulations.
7. The hours of operation shall be from 6:00AM to 6:00PM during the
business period.
B. This permit will expire on December 24, 1997.
9. Signs on property will be 4' in diameter.

The action of the Planning Commission did not include the off-site signs.
The request for off-site signs is to be handled as a separate issue.
SITE PLAN APPROVAL (REGAL PLASTICS)
Richard and Arlene Olson have made application to the City of Hugo for a
site plan approval to construct a 4(--)' x 60' pole building in the Peloquin
Industrial Part: at 15195 Freeland Avenue North, Hugo, MN. The purpose of
the building is to store miscellaneous equipment and plastic resins. The
applicants have emphasized that there will be no hazardous materials
stored in the building. The property is zoned industrial, and consists of
approximately 2.4 acres. A permit has been secured from the RCWD, and the
applicants have indicated that the building location and proposed driveway
will not affect the existing site grades. The 20' driveway will be
constructed of Class 5 gravel, and the pole barn will be constructed
without a concrete slab at this time. The proposed building appears to
meet all setback: and height requirements. If the building is to be used
for a cold storage facility as proposed, the City staff can see no reason
for denial of this site plan.
Jesinski made motion, Vail seconded, to approve the request of Richard
Arlene Olson for a site plan approval to construct a 40' x 60' pole
building in the Peloquin Industrial Part:: at 15195 Freeland Avenue, for the
storage of miscellaneous equipment and plastic resins. There will be no
hazardous materials stored in the building.

CIP PHASE 2 (FEASIBILITY REPORT)
As per previous Council resolutions 199>-2•' and 1990-25, the City Engineer
has completed a feasibility report for the City's Capital Improvements
Project 1990-1, Phase 2. The project involves bituminous surfacing and

related drainage on 125th St. from Goodview Ave. east to Homestead Dr.;
132nd St. from Goodview Ave. east to County Rd. 8A; Inwood Ave. from 180th
south to 175th St.; 175th St. from Inwood Ave. west to Ingersoll Avenue;
Ingersoll Ave., from 175th St. south to 170th St.; Homestead Ave. from
132nd St. north to 147th St.; Henna Ave. from 132nd St. south to Hilo
Ave.; Hilo Ave. from Henna Ave. south to 125th St.; 130th St. from
C.S.A.H. 8A west to Irish Ave.; and Irish Ave. from 130th St. south to
C.S.A.H. 7. This improvement is to made pursuant to Chapter 429 of the
Public Improvement Code. The total estimated cost of this project is
$1,483,540. It is proposed to finance this improvement with the sale of-
public
fpublic improvement bonds. The estimated duration of the City's debt
service liability for this project would be 15 years, and the City staff
would propose to assess 21% of the actual construction cost, or $4.95 per
front foot, whichever is greater, against the benefitting property
owners. The cost estimate reflected in the enclosed feasibility report is
up from the original estimate of 1.2 million, as a result of the
following:
1. Anticipated increase cost in oil for bituminous surfacing'
2. Additional fill needed for road beds that cannot accommodate a 24 ft.
wide bituminous surface.
3. 130th St. and Irish Ave. improvements have been added to this
proposal.
The improvement of the proposed 8.53 miles of roadway, as reflected in the
feasibility report, is to be done consistent with current Council policy
on assessments and the City's approved capital improvements program. An
informal, technical hearing on this project will be held during the-
afternoon
heafternoon and evening of October 31, 1990, and the improvement hearing
will be held at 7:00PM on Monday, November 26, 1990 at the Withrow
Elementary School. If the City Council wishes to proceed with this
project, the appropriate action would be to adopt the resolution accepting
the feasibility report and ordering the public improvement hearing.
Councilman McAllister questioned the total estimated cost of the project
($1,483,540), stating that this would probably not be a good time to
advertise for bids, in light of the current world situation. It was
determined that it would be wise to go ahead with the public hearings at
this time.
Atkinson made motion, Olson seconded, to adopt RESOLUTION 1990-30,
RESOLUTION RECEIVING REPORT AND CALLING FOR HEARING ON IMPROVEMENT FOR
PHASE 2, CIP #1990-1.

Earlier this month, the City was contacted by MNDOT regarding the
availability of grant funds for implementation of a safety -signing program
for the City of Hugo. The program would evaluate the City's road signs,

and make recommendations for changes to bring the City's overall traffic
devices into compliance with the Minnesota manual on uniform traffic
control devices for streets and highways. The Federal Highway Safety Act
of 1973 provides for reimbursement of up to 90% of the eligible material
costs for implementing this program. The City's obligation would be for
10% of the cost of implementation, labor, and agreeing to maintain such
material installations in a satisfactory condition. The City would have
to remove, replace, or install all regulatory and warning signs,
delineators, and object markers necessary to comply with Minnesota
standards. It should be noted that this grant covers only non -electrical
traffic devices. If the City would like to proceed and participate in
this program, the appropriate action would be to pass a resolution of
intent to participate, and designate the City or county engineer as the
individual responsible for the making of necessary studies and inventory
of signs for this project. Approval by the various governmental agencies
is subject to approval of the field inspection, materials certification,
and satisfactory review of claims documents.
Atkinson made motion, McAllister seconded, to adopt RESOLUTION 1990-31,
RESOLUTION OF INTENT TO PARTIPATE IN THE OBTAINING OF GRANT FUNDS FOR THE
IMPLEMENTATION OF A SAFETY -SIGNING PROGRAM FOR THE CITY OF HUGO.

Atkinson made motion, McAllister seconded, that the City Engineer be
appointed as the individual responsible for the making of necesary studies
and inventory of signs.

Atkinson made motion, McAllister seconded, to drop Items 5, 7, 8, and 10
of Resolution 1190-27, pending the approved grant funding of the
traffic -control devices.
All aye. Motion Carried.
As per Council direction, the City has received a quote for the
installation of a cul-de-sac at the termination of 125th St' just east of
Fiona Ave. This improvement was to be made by the developer in
conjunction with the approval of Nicholson's minor subdivision. If the
City wishes to proceed, based on the fact that Mr. Howard Nicholson has
not completed the work by October 16, 1990, the appropriate action would
be to direct the making of this improvement and award the quote to the
lowest bidder, with financing of this improvement by the financial deposit
provided by the developer. The original estimated cost of this
improvement by the developer was $8,198.

Forest Lake Contracting, in the amount of $7,745, for the installation of
a cul-de-sac at the terimination of 125th Street, just east of Fiona
Avenue. Financing of this improvement will be made with the deposit
provided by the developer.

JUNK_AUTO COMPLAINT,
As per council direction, the City staff has conducted the necessary
inspection of the junked autos mentioned in a complaint received by the
City Council at their last meeting. The City's Code Enforcement Office
conducted an investigation, and found no violations of the City's
municipal code. A letter is to be sent to the complaintant.
BUILDING PERMIT REPOR
The City Council received a copy of the building permit report, prepared
by the Code Enforcement Officer, showing construction activities in the
City of Hugo from January 1990 to date. It should be noted the number of
accessory buildings and pole barns constructed during the 1990 calendar
year. The City staff thought this information to be interesting in light
of community rumors being spread indicating that the City Council no
longer allows pole barns to be constructed in the rural areas of the
community.

Because of the installation of natural gas in the City of Hugo, the
Building Inspection Department is realizing a large volume of inspections.
Mr. Scott Holm's internship with the City is due to expire the end of
October, and City Administrator Huber requested Council authorization to
employ Mr. Holm until the building department workload decreases.
Atkinson made motion, McAllister seconded, to extend the employment of Mr.
Scott Holm until the City's Building Inspection Department workload
decreases.

Mayor Atkinson informed the Council that he had held a personal press
conference on Wednesday, October 10th, responding to the cartoons
appearing in a local newspaper.
Councilman Jesinski reported that he had attended the Hugo Fire Department
Open House, and suggested that the City send a letter thanking them for
their efforts.
Mrs. Joyce Seever addressed the Council, and stated that she had talked to
Mary LaPlant, and the speed limit signs installed on Oneka Lake Boulevard
vary, depending on whether or not its good weather conditions or its
raining. Mrs. Karen Duraine addressed the Council, and inquired as to
whether or not the City "checked out" developers who do work in the City.

She indicated that Kenco Construction, residential home builders, was in
trouble in other cities, and wanted to know if the City checked them out.
Mayor Atkinson and the City Administrator responded. Mrs. Kathy
Schowtchan addressed the Council, and stated that she had a letter at home
from Mary LaPlant, dated early last spring, which recommended speed limits
and signs be installed on Oneka Lake Blvd. She stated that the action by
the City Council to have these signs installed did not follow the
recommendations of Mrs. LaPlant. Mrs. Schowtchan also stated that she has
a letter at home from the City Building Inspector condemning her
fireplace. She stated that there was a contractor in Hugo who had built a
large number of faulty fireplaces in the City, and the lives of
firefighters would be endangered by this individual. She wanted to know
what the City was going to do about it. The City Administrator suggested
that if Mrs' Schowtchan wanted to pursue this matter, she should do so in
writing, with specifics, to the local and state fire marshal, with proper
documentation to substantiate her allegations. He then stated that he
would check on this matter with the Building Inspector'
