The oath of office was administered to the newly elected Councilmembers, Mike McAllister and Tom Jesinski. PRESENT: McAllister, Jesinski, Olson, Vail, Atkinson City Administrator, Ken Huber City Clerk, Mary Ann Creager Vail made motion, Olson seconded, to approve the Council minutes for December 19, 1988, as submitted. All aye. Motion Carried. Olson made motion, Vail seconded, to approve the General Claims for January 3, 1989, in the amount of $22,160.46. All aye. Motion Carried. Vail made motion, Olson seconded, to approve the Utility Claims for January 3, 1989, in the amount of $2,927.27. All aye. Motion Carried. CHARITABLE GAMBLING LICENSE Atkinson made motion, Vail seconded, that the City of Hugo has no objection to the renewal of the Gambling License for White Fear Boxing Club to operate at the Blacksmith Lounge, and waives the 60 day waiting period. All aye. Motion Carried. DESIGNATION OF DEPOSITORY OF CITY FUNDS Currently, the official depositories for city funds are the First State Bank of Hugo, the First National Banc; of St. Paul, all Twin City Federal offices, the 4M Fund, and Marquette Bank of Minneapolis. Atkinson made motion, Olson seconded, to designate the First State Bank: of Hugo, the First National Bank of St. Paul, all Twin City Federal office, the 44M Fund, and the Marquette Dank: of Minneapolis as the official depositories for the City of Hugo in 1989. All aye. Motion Carried. DESIGNATION OF OFFICIAL NEWSPAPER Currently, the official newspaper for the City of Hugo is the Forest Lake Times. Both the White Gear Press and the Forest Lake Times have requested that they be appointed official newspaper for the City of Hugo. Atkinson made motion, Gilson seconded, that the Forest Lake Time!!: be designated the official. newspaper for they City of Hc_igo irr 1909. All aye. Atkinson made motion, Vail seconded, to designa(te Howard Kuusisto as the city engineer for the City of Hugo in 1989. All aye. Motion Carried. APPOINT CITY ATTORNEY Currently, Mr. Charles Johnson serves as the city attorney for the City of Hugo. Atkinson made motion, Jesinski seconded, to designate Charles Johnson as the city attorney for the City of Hugo in 1989. All aye. Motion Carried. APPOINT CITY PROSECUTORS Currently, Mrs' Sarah Mardell and Mr. Richard Hocking serve as city prosecutors for the City of Hugo. Atkinson made motion, Vail seconded, to designate Sarah Mardell and Richard Hocking as the city prosecutors for the City of Hugo in 1989. All aye. Motion Carried. APPOINT CIVIL DEFENSE DIRECTOR Currently, Mr. Ron Istvanovich serves as the civil defense director for the City of Hugo. Atkinson made motion, Olson seconded, to designate Ron Istvanovich as the civil defense director for the City of Hugo in 1989. All aye. Motion Carried. APPOINT FIRE DEPARTMENT OFFICERS Currently, the Fire Department officers are as follows: Ron Istvanovich, Fire Chief, Jim Wisner, 1st Assistant Chief, and Jim Compton, 2nd Assistant Chief. Atkinson made motion, Vail seconded, to appoint the Fire Department officers for 1989 as follows: Ron Istvanovich, Fire Chief, Jim Wisner, 1st Assistant Chief, and Jim Compton, 2nd Assistant Chief. City Council meeting of January 3, 1989 Page 3 APPOINT ZONING ADMINISTRATOR Currently, the zoning administrator for the City of Hugo is City Administrator, Ken Huber, and the Deputy Zoning Administrator is Deputy City Clerk, Carole LaBelle. City staff is recommending that Mr. John Benson be appointed Deputy Zoning Administrator. ^ Atkinson made motion, Olson seconded, that City Administrator, Ken Huber, be appointed Zoning Administrator, and John Benson, Assistant Zoning Administrator, for the year 1989. All aye. Motion Carried. APPOINT CHAIRMAN AND SECRETARY TO PLANNING COMMISSION City ordinances require that the City Council appoint a chairman and secretary to the Planning Commission at the first regular City Council meeting in January. Currently, the chairman of the Planning Commission is Mr. Richard Sen[. --ler and the secretary is Carole LaBelle. Atkinson made motion, Jesinski seconded, to appoint Richard Sent. -.ler as Planning Commission Chairman and Carole LaBelle as PC secretary for the year 1989. All aye. Motion Carried. APPOINTMENTS TO PLANNING COMMISSION As of January 1, 1989, there are four vacancies on the Hugo Planning Commission. The terms of Gerald Sullivan and Chuck Henry both expired on 12/31/88. Both of those individuals have requested consideration for reappointment to the Planning Commission. Mr. Troy Sonnenfeld has resigned his position on the Planning Commission, and his term would expire on 12/31/89. Mr. Tom Jesinski has resigned his position on the Planning Commission because of the election to the City Council. Mr. Jesinski's term expires on 12/31/90. Atkinson made motion, Olson seconded, to reappoint Gerald Sullivan and Chuck Henry to serve 4 year terms on the Planning Commission, and appoint Bill Mezzano to the Planning Commission for a term to expire on 12/31/90. All aye. Motion Carried. APPOINTMENTS TO BOARD OF ZONING ADJUSTMENTS/APPEALS Currently, serving on the Board of Zoning Adjustments is Mr. Bob Ellman, who is the at -large citizen representative. The Planning Commission has recommended the appointment of Dick Senkler as their representative to the board. The City Council needs to appoint it's representative since former Councilmember, Art Potts, served as board member and it's chairman' City Council meeting of January 7%, 1989 Page 4 _ Atkinson made motion, Vail seconded, to appoint Richard Senkler as the Planning Commission's representative and Bob Olson as the City Council's representative on the board of Zoning Adjustments. APPOINTMENT OF ACTING MAYOR Annually, the City Council has appointed an acting Mayor to serve in the absence of elected Mayor, George Atkinson. Currently serving as acting Mayor is Councilmember, Deane Vail. McAllister made motion, Olson seconded, to appoint Deane Vail as acting Mayor for the year 1989. All aye. Motion Carried. RESOLUTION AUTHORIZING TRAFFIC REGULATORY SIGNS As per Council direction, the Washington County Sheriff's Office has reviewed potential traffic hazards on Ethan/Everton Avenues north of 121st Street. The sheriff's department did not feel that the current situation was extremely hazardous; however, they felt that providing curve signs, and reducing the speed limit in that area to 20 mph, may help to prevent future accidents. Any action by the Council regarding installation of traffic regulatory signs at this location should be done by Council resolution. Mayor Atkinson directed city staff to submit the appropriate resolution for Council consideration. REZONING REQUEST (HERITAGE DEVELOPMENT) Heritage Development of Minnesota, on behalf of Vern Peloquin, Mary Christianson, and Philip Greenwaldt, have made application to the City of Hugo for the rezoning of three parcels of land to single family urban. It is the intent of Heritage Development to assemble approximately 47 acres for residential development in an area southwest of Oneka Lake and east of Geneva Ave. on Oneka Lake blvd. The site in question is currently zoned SFE and Conservancy. The developers are desirous of ening SFU for development purposes. Parcel A abutts SFU zones to the east and south, Parcel b abutts SFU zones on the west and north, and Parcel C abutts SFU zones on the west. The developers understand that if the sites are improved to accommodate single family residentail dwellings, they will need to extend utilities and conform with the city's subdivision regulations at the time of plat review. The proposed sites are within the urban service area of the City of Hugo. In that part of the project area located within a floodplain :one b, we would wart to clarify that approving the rezoning of property does not necessarily imply that the city will allow subdivision of all of the tract: in question to 10,A00 sL ft. lots. The development in question appears to be consistent with the comprehensive plan and abutts on other districts; zoned for single f�imily urban. The Hugo Planning Commission unanimously recommended apprc:)v<--.6. of this rezoning request after holding the required r:;ublic hearing. City Council meeting -of January 3, 1989 Page 5 Councilman McAllister stated that the land west of Parcel "A" has a drainage problem and should be looked at closely at the time of application for subdivision. Mr. Dan Part%s, representing Heritage Development, stated that they are just starting to work: with Rice Creek and the DNR regarding drainage. Parcel "B" will be used for holding runoff from the development, and will not be used for building sites. McAllister made motion, Olson seconded, to adopt ORDINANCE 1989-253, AN ORDINANCE AMENDING CHAPTER 720 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY. VOTING AYE: McAllister, Jesinski, Olson, Vail, Atkinson Motion Carried. REZONING REQUEST (MARGARET DOERRER Margaret and Nancy Doerrer have made application to the City of Hugo for - the rezoning of a 20 acre tract of land from conservancy to agricultural. The property in question is located south of 165th St. approximately 1/2 miles west of Highway 61. The property abutts an industrial zone at it's east and south borders and abutts on conservancy zones on the north and west. Ms. Doerrer indicates that the ultimate intent is for the parcel in question to be subdivided into two 10 acre tracts for future development. It was pointed out to the applicant that a rezoning does not necessarily constitute an approval of the subdivision. To properly subdivide the property in question, an application for subdivision must be submitted and all of the provisions of our ordinance must be complied with. The Hugo Planning Commission unanimously recommended approval of the rezoning after holding the required public hearing. McAllister made motion, Atkinson seconded, to adopt ORDINANCE 1989-254, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY. VOTING AYE: McAllister, Jesinski, Olson, Vail, Atkinson Motion Carried. INDIVIDUAL SEWER TREATMENT ORDINANCE The city staff has completed it's draft of the proposed on-site septic system ordinance as per Council direction. The ordinance is being prepared from the Washington County ordinance, and is being revised to fit Hugo's needs and individual situations. All licensing, inspections, and certification would be handled by Washington County while the Board of Appeals would be the Hugo City Council. Th,e Council was provided with a draft ordinance for their review, and will be discussed at the Council meeting of 1/17/89. (0 City Council meeting of January 3, 1989 Page 6 MISCELLANEOUS The *- Council will consider "PRIORITIES" for the City of Hugo at the Council meeting of 1/17/89. The city received a letter from the American Legion regarding the piling of snow adjacent to their building and creating, a vision problem. The city administrator will investigate and determine if the city is responsible for the problem. PERSONNEL._ PERFORMANCE EVALUATION The city's contract with it's city administrator provides for periodic performance evaluations. The last time the Council reviewed the administrator's performance was in May, 1988, and a performance review is now warranted in that the city has entered into a new contract with the administrator on November 17, 1988. After a lengthy discussion regarding employee's performance, Councilman McAllister offered the following motion: McAllister made motion, AtE.inson seconded, to adopt RESOLUTION 89-1, RESOLUTION REVIEWING EMP'LOYEE'S PERFORMANCE AND ESTABLISHING SALARY FOR CITY ADMINISTRATOR.
