PRESENT: McAllister, Jesinski, Olson, Vail, Atkinson City Administrator, Ken Huber City Attorney, Charles Johnson City Engineer, Howard Kuusisto City Clerk, Mary Ann Creager Jesinski made motion, Vail seconded, to approve the City Council minutes for March 6, 1989 as submitted. All aye. Motion Carried. Vail made motion, Olson seconded, to approve the General Claims for March 20, 1989, in the amount of $97,751.07. , All aye. Motion Carried. Atkinson made motion, Olson seconded, that the City of Hugo has no object- ion to the issuance of a Gambling License to the Forest Lake Lions for the operation of pulltabs at RJ's, and waives the 60 days waiting period. In lieu of publishing the detailed ordinance regulating individual sewer systems, Minnesota Statutes provides for publication of a summary ordinance if authorized by the City Council. City staff prepared a draft ordinance summary for publication with said draft being patterned after other summaries published by the city previously. City staff feels this ordinance summary adequately reflects the content of the detailed ordinance, and would recommend it's publication. Atkinson made motion, Vail seconded, that the City of Hugo publish a summary of the ordinance regulating individual sewer systems (1989-256) rather than publishing the ordinance in it's entirety. All aye. Motion Carried. Mr. Ken Wilson has made application to the City of Hugo for a site plan aniroval providing a comprehensive drainage, grading, and erosion control ; in to accommodate expansion of the Wilson Tool Company. The property in C .stion is located in an industrial zoned area with a mailing address of 1,412 Farnham Avenue, Hugo, MN. The site contains approximately 23.2 City Council meeting of 3/20/89 Page 2 acres of which a part is developable, and a portion is protected wetlands. The city engineer is currently in the process of reviewing the site plan, and has indicated he will have a report for presentation to the City Council Monday evening. In addition to the comprehensive drainage plan, the staff also requested that Mr. Wilson prepare a tentative development plan for the area indicating what property Wilson Tool owns, and a projection on their phasing of development for the area. Phase 1, Area A involves the construction of a bituminous surfaced parking lot to accommodate 137 vehicles south of the existing Wilson Tool building. This proposal also involves a drainage plan to ultimately serve Phase 2 as identified on the site plan. The developers note that access to the parking lot from 130th Street will be via a 28' wide concrete paved area east of the Wilson Tool building. It should be noted that the access area in question is currently a parking lot, and it is the intent of the developers to channel their traffic through an existing parking area to get to the proposed new parking area. We have advised the applicant that this is not a good practice from a safety standpoint, and they should consider elimination of the parking on at least one side of the proposed south parking lot access. Area B in Phase 1 calls for the installation of a one-year ponding area with rate control and baffle/skimmer as per RCWD standards. The L-shaped pond is to provide storage and an outlet to control the future rate of runoff equal to the existing rate. The developers have indicated that the pond is sized to provide rate control, under full development, for all of Wilson Tool property as well as the area at the southeast corner of 130th Street and Farnham Avenue. Area B involves the grading and borrowing of soils from the southwest to construct pond dikes. Area C of Phase 1 involves the filling of the existing pond and grading it to a level elevation for a proposed building site in Phase 4 of their development plan. The existing Wilson Tool building drain is to be extended westerly to the existing ditch. This area is to receive topsoil and seeding. The applicants have informed us that their drainage plan has been approved by the RCWD although copies of the permit have not been provided to the city. In addition to the comments forthcoming from the city engineer, the staff would also like to note the following with regard to this plan: 1. The applicant refers to the proposed ponding area 1-B as a one-year ponding area. We are not familiar with that term nor do we understand what it's capabilities are with regard to handling the runoff during a heavy rainfall. 2. The access to the large parking lot in Phase 1-A is marginal, at best, and may result in major internal traffic problems for Wilson Tool. 3. The developers should look to the possibility of improving Farnham Avenue in the near future to serve it's future development needs' 4. The City Council should consider concept approval only for the overall site plan. 5. Subject to the city engineer's recommendations, and securing other required permits, we can only recommend approval of Phase 1 improvements at this time. It was noted in the letter from Comstock & Davis that they identify the wetlands to the south of the site in question as the primary area for City Council meeting of 3/20/89 Page 3 1torage of runoff during a 100 -year storm event. This wetland area also tccommodates runoff from other areas to the south and east of the site, nd appears to have no outlet' City Engineer, Howard Kuusisto, reviewed his report of 3/20/89 with the Council and Wilson Tool's representatives, Mark Jones and Julian McAllister made motion, Olson seconded, to table Wilson Tool's application for site plan approval providing a comprehensive drainage, grading, and erosion control plan to accommodate expansion so that city staff can further review this proposal with the applicant to address the following: 1. Consider pond outlet to south pond currently being used. 2. Consider outlet for 100 year flood storage area in wetland to the south. 3. Parking on only one side of access to south parking lot. 4. No more development after Phase 1 without Farnham Avenue and Falcon Avenue being improved' 5. Is 128th Street important to future roadway system for this area? 6. Fill not to be removed below 932' elevation' 7. Pond outlet to dump into street right-of-way? B. Storm sewer pipe in south parking lot is too close to the surface and will freeze. ll aye. Motion Carried. ,OE STANEK- EQU ST The city received a letter from Lloyd Grooms regarding a request for the city to provide access to Joe Stanek's property via the road right-of-way alledgedly running south of 180th Street down the section line between Sections 1 and 2. The city administrator reviewed the history of this case dating back to 1970. He noted there were hard feelings between Mr. Stanek and his neighbors. He also referenced previous communications with Mr. Stanek regarding possible solutions to his problem. It was noted that in December, 1988, the city attorney sent Mr. Stanek a letter requesting a response to ten questions regarding his earlier proposal to the city. This letter was never responded to by Mr. Stanek. In conclusion, the city has taken a position that the road right-of-way leading to Mr. Stanek's property exists based on the best records available to the city. The city has suggested that if Mr. Stanek is desirous of having the court's decide the issue of the right-of-way existence, then it should be done at his expense. If, however, his desire is to improve the roadway to provide access to his property, the city has given Mr. Stanek several options to pursue this under Chapter 429 of the Public Improvement Code. The city has also suggested the possibility of vacating the right-of-way in question and retaining a driveway easement -llowing for the type of access he has requested in his previous letters. he city has recommended numerous options for Mr. Stanek to pursue this issue; however, he chooses to reject those options as said options would involve a financial commitment on his part. 3? City Council meeting of 3/20/89 Page 4 In 1987, the City Council took: formal action directing the staff to send a letter to Mr. Stanek: informing him that if he wishes to provide permanent access to his property, he can do so by petitioning the city for the improvement of the roadway under Chapter 429 of the Public Improvement Code. Mr. Lloyd Grooms, representing Mr. Yoe Stanek:, was present at the meeting, and asked that two issues be addressed: 1) affirmation of the right-of-way, and ) physical accessibility to Stanek's property. Mr. Grooms stated that they do not want a roadway, and that petition for a roadway is not being requested. Mayor Atkinson stated that he takes issue with Mr. Grooms' letter implying that the city has been unwilling to resolve this matter. Councilman McAllister asked Mr. Grooms if Mr. Stanek: understands fully his option to petition for installation of this roadway. Mr. Groom responded in the affirmative. The possibility of vacating the right-of-way and retaining an easement for driveway purposes was discussed. Mr. Grooms said he would discuss that option with his client, and would get back: with the city. Mayor Atkinson said the city would respond to a petition for roadway improvements or to vacate the roadway. Other than those options, Mr. Stanek: would have to reaffirm the existence of the right-of-way on his own. Mayor Atkinson said he would like to move on to the next item on the agenda. CAEiLE TV GF... i NAN( E A public hearing has been scheduled for April 3, 1989 at 7:05 PM, to discuss the Franchise Ordinance. TEMPORARY BUILDING The newly purchased trailer- will be used by the Fire Department as a training facility and for storage of their records. Ars April 1st completion date is anticipated. PLANNING I NTEN:RI City Administrator Huber will be interviewing a candidate to fill this position on March 27th. Hopefully, he will be ,joining city staff =_..c:me time in early April.. RUAD CONDITION COMPLF :l: t 7`-' Administrator Huber stated that City Hall has received numerous road complaints in the last few weeks (Elmcrest Avenue). Washington Count; Public Works is unable to rectify the problems until the fro5t is out of the ground. Councilman Vail asked that city staff make an inspection of 142nd Street., east: of Highway 61 ( Giese' s driveway) to determine what can be done alleviate the problem of standing water. City Council meeting of March 20, 1989 Page 5 he RCWD is in need of a temporary meeting place for approximately 12 to 18 months. Assuming there will be no conflict with regular City of Hugo business, and they pay their "fairshare", the Council had no problem with offering the use of Hugo City Hall until they find a permanent meeting place.
