PRESENT: McAllister, Jesinski, Olson, Vail, Atkinson City Administrator, Ken Huber City Clerk, Mary Ann Creager Jesinski made motion, Vail seconded, to approve the minutes for the regular City Council meeting of June 5, 1989 as submitted. All aye. Motion Carried. Vail made motion, Olson seconded, to approve the General Claims for June 19, 1989 in the amount of $5,620.44. All aye. Motion Carried. Mr. John Lannon, administrator for District Memorial Hospital, and Mr. Mike Perrault, Hugo's representative on the hospital board, introduced themselves to the City Council and stated their interest in serving the community and their availability to answer any questions. Mr. Perrault also wanted to emphasize, from a representative's standpoint, Hugo's lint-..- to inkto the hospital. There was also some discussion that the next City Newsletter include an article about the City's participation in the hospital district. ZONING ORDINANCE VIOLATIONS (KEVIN—MANN) As per Council direction, a notice was sent to Mr. Kevin Mann regarding zoning ordinance violations with regard to his property located at 5425 165th Street North. Mr. Mann had received a Special Use Permit from the City of Hugo a number of years ago to construct a pole barn in advance of his personal residence. Mr. Mann has since constructed his home on the site in question' Complaints from neighbors in the area indicated that Mr. Mann was operating his construction company out of his home and follow-up inspections by City staff confirmed this possibility' Mr. Mann has been sent the appropriate notices, and asked to appear before the City Council at 7:00 PM to discuss activities taking place on his property. City staff encouraged the City Council to take a look at the property in question as it appears most of the equipment has been removed, and Mr. Mann may be cleaning up the site and moving his business elsewhere. Arnold Kempe, attorney for Kevin Mann, referenced the alleged code violations as listed in the City's letter of May 30, 1989, and maintained that neither were pertinent for the Mann residence. Mr. Kempe stated that in light of what was allowed by Special Use in the conservancy district (gun clubs, auto dismantling yards, incinerators, etc.), and what was taking place on the Mann property, that the ordinance was not enforceable' Mr' Kempe stated that Mr. Mann was not running a business from his residence, only parking vehicles needed in the operation of his swimming pool business' Tara Arhip, an adjoining neighbor, stated that it was her opinion that Mr. Mann was not in violation of any City codes. Tony Penna stated that Mr' Mann is using the Dotte property, across the street from Mann's residence, to store sand needed in the operation of his pool business, and operating his equipment very early in the morning and late at night' The complaint received by the City did not make any reference to hours of operation of his equipment. Officer to inspect. the Kevin Mann property to determine if the code violations on site have been eliminated and report his findings to the Council. All aye. Motion Carried. ROAD €< BRIDGE MA I NTENANQ AGREEMENT A copy of the Road and Bridge Maintenance Agreement, along with the proposed rates and current rates, for the upcoming year between the City of Hugo and Washington County was provided to the Council for their - review. The agreement in question is basically the same as we have entered into in previous years; however, the Council was to note Attachment A which indicates the change in wage rates and equipment rates for the County. As discussed earlier, the new rates reflect what was anticipated as a result of tax levy limits, losses of local government aid, and how revenue -raising restrictions on the County will affect contracting agencies. Staff is hoping that the cost savings in road maintenance as a result of our CIF' will offset increases in the contract as proposed. Atkinson made motion„ McAllister seconded, authorizing the Mayor and Clerk: to sign the 1989 - 1990 Road and Bridge Maintenance Agreement between the City of Hugo and Washington County. All aye. Motion Carried. Mayor Atkinson suggested that the City Council consider the possibility of the City of Hugo maintaining a portion of its own roads. This issue should be discussed at 1??0 budget time. VARIANCE REQUEST (T. THIBAULT) Mr. William Thibault has requested a variance from the City's coning requirement of 720 sq ft to construct a 24' x 34' attached garage on his property located at 13 875 Goodvi.ew Avenue North, Hugo, MN. The garage in question is to be used for residential purposes only. McAllister made motion, Atkinson seconded, to grant a variance to William Thibault to allow for the construction of a 24' Y 34' attached garage to his residence at 13875 Goodview Avenue which exceeds the allowable 720 sq ft. All aye. Motion Carried. CITY ASSESSOR FEF AUJUS"I hiEhaT REQUEST Mr. Francis Langer has formally requested the City Council consider- an adjustment in his fee per parcel for assessment work: done in 1539, collectible in 1990. Mr. Langer is requesting an increase to $6.25 per parcel. The City budgeted $4.60/residential and $5.80/commercial for.. 1989 City Council meeting of June 19, 1989 Page •._ based on the information provided by the: City assessor- last fall.. Mr. Langer has indicated that the responsibilities of his job, as a result of State legislation, has increased significantly, and that the increase requested is justified and warranted. Mr. Langer was present at the meeting and stated that because his costs Have risen (insurance, schooling, etc), he has made the request for the increase. The Council is well satisfied with Mr. Langer's job performance, but did not feel it would be appropriate to increase his fee now for something budgeted for in 1999. Atkinson made a motion to deny the Mr. Langer's request for an increase in his 1989 payment, and that the Council consider his request at 1990 budget time. Because of the Council's motion for denial, Mr. Langer stated that he was uncomfortable starting this year's work without corning to an understanding with the City. Councilman Jesinski requested that Mr. Langer submit an itemization of additional costs. Mayor Atkinson withdrew his motion. Atkinson made motion, McAllister seconded, to table the request of Frank Langer for an increase in his 1990 assessment fee until after Mr. Langer and City Administrator, Ken Huber, meet to discuss this request. All aye. Motion Carried. CIF' ADMINISTRATIVE AUTHORIZATION On June 14, 1989, the City engineer and staff met with Valley Paving at a preconstruction conference to discuss the timing and activities that will take place this summer in conjunction with our CIF road project. It would appear from our discussions that this project is going to move very quickly as the contractor intends to be done with the paving of all streets by mid-August. In an effort to complete this project as quickly as possible, minimizing the inconvenience to Hugo residents, city staff is requesting Council authorization to make administrative decisions regarding the road project. Atkinson made motion, Jesinsk:i seconded, that the Council authorize the City Administrator to make the following administrative decisions regarding the City's CIF road project: 1. The City administrator, upon the recommendation of the City engineer, be authorized to approve change orders during the course of the CTP construction in an amount not to exceed 10% of the project cost. Said change orders to be ratified by formal Council action. 2. The City administrator, upon the recommendation of the City engineer, be authorized to designate temporary haul routes for trucks and equipment during the course of construction. 3. Laboratory testing of materials, and additional on-site inspections, be authorized during the course of project construction as deemed necessary by the City engineer. All aye. Motion Carried. Mr. Terry Granger has made application to the City of Hugo for a variance to construct an 832 sq ft attached garage on a new home located at 4900 Gallivan Court North, Hugo, MN. This request exceeds the 720 sq ft ordinance requirement. The garage in question meets all setback requirements, and is to be used for residential purposes only. Atkinson made motion, Vail seconded, to approve the variance request of Mr. Terry Granger for the construction of an 832 sq ft attached garage, at 4900 Gallivan Court North, exceeding the 720 sq ft ordinance requirement. All aye' Motion Carried. VARIANCE REQUEST ?T. CLYMER) Mr- Thomas Clymer has made application to the City of Hugo for a variance to construct a 789 sq ft attached garage at 5955 - 180th Street North, Hugo, MN. The garage in question appears to meet all setback requirements, and the applicant has indicated that said structure will be used for residential purposes only. Atkinson made motion, Vail seconded, to approve the variance request of Mr. Thomas Clymer for the construction of a 789 sq ft attached garage, at 5955 180th Street North, exceeding the 720 sq ft ordinance requirement' All aye' Motion Carried' CONSTRUCTION SCHEDULE FOR CIP The City has issued a NOTICE TO PROCEED to Valley Paving, Inc', indicating that staking and roadwork will begin on or before June 22, 1989, and the completion date for paving is August 15, 1989. The shoulder work and finish work on the project will be completed in a reasonable period after August 15th' Although the City has requested that Oneka Lake Blvd', Harrow Avenue, and Goodview Avenue be placed at the top of the priority list for construction, the contractors have indicated that they are going to bring a very large crew into Hugo, with a lot of equipment, and they intend to finish this project very quickly. This will result in most of the roads being under construction at the same time. Again, we will caution the City Council that many property owners will be inconvenienced during the course of project construction, and we can only encourage residents to be patient as it is our intent to get this project done as quickly as possible' CONSTRUCTION SCHEDULE ---OR_CABLE TV The City has been notified by Cable TV North Central that the construction plans are near completion for the laying of cable in the City of Hugo, and their construction start date is July 1, 1989. Construction will start at the south end of the community, and will move in a northerly direction to 177th Street. Most of the cable being installed will be overhead, although some underground will be laid in areas where underground electrical and telephone services currently exist. The deadline for completion of this project is September of 1989 although the contractors indicate they will be done much sooner than that date. City Council meeting of June 19, 1989 Page 5 When Washington County went to bids for its road paving projects in 1989, County Road 8A, from County Road 15 to Goodview Avenue, was included as an alternate project. As a result of the extremely low bids received by Washington County, this stretch of roadway was moved up the priority list and added to the contract. The Washington County Engineering Department has informed city staff that County Road 8A will be overlaid with a 1 1/2" mat and the shoulders improved with Class 2 limestone aggregate. Construction on this project is to start on July 20th, and is to be completed August 14th- Total length of this project is approximately four miles. The 145th Street (County Road 8) improvements at the railroad crossing downtown is scheduled for September of this year in conjunction with other railroad projects. Staff has been informed that the 146th and 147th Street crossings will be completed by the railroad during this same period. MISCELLANEOUS Atkinson made motion, Olson seconded, that the City of Hugo hire Mr. Scott Peiffer as a member of the Hugo Fire Department, subject to completion of the required probationary period.
