Olson made motion, Vail seconded, to approve the minutes for the r-egu.lar.
City Council meeting of June 19, 1989 as submitted.
All ave. Motion Carried.
Vail made motion, Jes.insF= i seconded, to approve the General. Claims for
July 5, 1989 in the amount of $10,154.=0.
All aye. Motion Carried.
Vail made motion, Olson seconded, to approve the Utility Claims for July
51 1989 in the amount of $3,707.56.

Recently, it was brought to our attention that the DNR still has not
approved the City's adopted shoreland management ordinance. Even though
the ordinance text was prepared by the DNR, and the City is enforcing said
ordinance based on Minnesota Statutes, the DIN has pointed out some
discrepancies regarding the shoreland overlay district map. The shoreland
overlay district has been identified on the official wetlands map of the
City; however, the ordinance text references the official zoning map of
the City rather than the official shoreland overlay district map. The
City's map has been amended pursuant to Minnesota Statutes, and staff has
made a number of minor- changes in the ordinance deleting the
terminology "underlying shoreland overlay district".
McAllister made motion, jesinski seconded, directing city staff to prepare
an ordinance adopting the official shoreland overlay district map and
amending Chapter :20-43 r"..:nd 320-44 of municipal code as it deals with
shoreland management:..

Ji.m and Sherron Kelliso:, have made application to the City of Hugo for the
rezoning of a 6.7 acre tract of land from conservancy to R::._''. Mr.
Kel.lison purchased 7 11...6 acre 't:.r.act. of Land from Mr. Dave Potter earlier
this year. Part of the property in C:ji..tr::'stion is zoned c:`si"se!'"•.ancy, and
part is zoned Si=d.. The prf:'vio1_t!:'s CJ!PJner., Mr. Dave Pott.erappear, ed before
the City Council on February 16, 1988 to request a rezoning from
conservancy to SFE. This request l-J<is [_tfri'r1a.c5d by .the Council., but l•3as

encouraged to reapply for a rezoning to an RR:1. or.. RR2 zoning district.
The City's comp pian calls for a minimum :tot size of five gross acres per
dwelling unit outside the Urban Service Area. Mr. Ke:•llison would like to
get this property rezoned to RR2 so that a single family residence} can be
built on the site in question. . T his matter- was reviewed 1-,y the Hugo
Planning Commission at their dune 25, 1929 regular meeting at which time
said Commission unanimously recommended approval of the rezoning to RR2.
The site is located on the wast side of Elmcrest Avenue approximately 500'
north of 19th Street.
McAllister- made motion, Vail seconded, to adopt. ORDINANCE 1959-259, AN
ORDINANCE AMENDING CHAPTER .320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY
AMENDING THE ZONING DISTRICT CLASSIFICATION OF THE DESCRIBED REAL
PROPERTY.

VARIANCE REQUEST - GARAGE tJ. HEHNj
Mr. James Hehn has made application to the City of Hugo for a variance to
construct a 4' x 32' accessory building/garage closer to the road than
his principal residence. The property in question is located at 5920 Egg
Lake Road. The lot has a steep drop off in the rear of the property, and
is partially located in the floodplain. This prevents Mr. Hehn from
locating the building behind the house. The building will be used for
residential purposes only, and he has indicated there are no other
accessory buildings on the site. Noting the location of the floodplain
and the steep grade at the rear of this property, the Hugo Board of Zoning
Adjustments unanimously recommended approval of the variance to construct
a 24' x .32' accessory building within 32' of Egg Lake Road Consistent with
the submitted site plan on file.
Vail made motion, Olson seconded, to approve the application of James
Hehn, 5?20 Egg Lake Road (Parcel i"•.lo. 35029-0025), for a 12' variance to
construct a 24' x 2' accessory building/garage, for residential purposes,
within .38' of Egg Lake Road, consistent with the site plan on file.
Building to be used by Mr. Hehn for his personal storage only.

rap aluminum, newsprint, and beverage canes. Copies of the old
.,reement, and the new proposed agreement by the boy scouts, were
submitted to the City Council for their review. With regard to the Item
#7 in the Memorandum of Agreement, city staff feels it is important to
note that the City's eligibility for the grant monies from Washington
County is dependent on the amount of recycling that is done and the
records that are kept by the Boy Scout Troop.
McAllister made motion, Vail seconded, authorizing the Mayor and City
Clerk to sign the Memorandum of Agreement between the City of Hugo and Boy
Scout Troop #151. Term of Agreement shall be from 1/1/89 through
12/31/89.

VISITORS TO BE HEARD
Mrs. Theodora Peltier was present at the Council meeting stating her
concern that water from the newly installed culverts on Goodview Avenue,
in conjunction with the CTP, not be directed to her field located at the
southwest corner of 1 Oth Street and Goodview Avenue. Administrator Huber
informed Mrs. Peltier that the culverts were replacing existing culverts,
and a low area west of the road would channel water between the culverts,
'iverting the water to an existinq ditch on her property, per the city
gineer's office. The culverting across 13(-)th Street at Goodview would
installed as per Mrs. Peltier's request. Mr. Huber stated that the
-i.ainage pattern, after road construction, will be similar to the current
situation. He informed Mrs. Peltier. that there are no guarantees that
water won't run onto her property following a heavy rainfall. Mrs.
Peltier was also concerned that blacktop not be installed on her property
at the 130th Street,/Goodview intersection. She was informed that the
blacktop will be installed only in City right-of-way.
MISCELLANEOUS
City Administrator Huber reported on the followinq matters:
1. The 199C-) budget calendar would be availabe for Council review shortly.
2. A City Newsletter/Bulletin informing residents of construction in Hugo
will be ready soon.
Referenced a letter received from MNDOT statinq that, after reviewing
the geometries, traffic volumes, and accident history at the
intersection of T.H. 61 at CSAR 8, traffic control is not justified at
this time. However, they will continue to study the feasibility of
the realignment of the intersection slightly to the west to alloy, for
the development of a full width northbound bypass lane along the east
side of T.H. 61.
