HomeMy WebLinkAbout1989.11.20 CC MinutesMINUTES FOR THE REGULAR' CITY COUNCIL MEETING OF NOVEMBER 20, 1989 i -he meeting was called to order by Mayor Atkinson at 7:03 PM' PRESENT: McAllister, Jesinski, Olson, Vail, Atkinson City Administrator, Ken Huber City Clerk, Mary Ann Creager Administrative Intern, Stu Schmeling Jesinski made motion, Vail seconded, to approve the minutes for the regular City Council meeting of November 6, 1989 as submitted. All aye. Motion Carried. McAllister made motion, Olson seconded, to approve the claims for November 20, 1989 in the amount of $32,182.72. All aye. Motion Carried. MINOR SUBDIVISION - (JAMES KELLISON) Mr. and Mrs. James Kellison have made application to the City of Hugo for a minor subdivision to divide a 11.6 acre tract of land into two parcels' Currently, the parcel of land in question is in two different zoning districts, the north portion being zoned RR2, and the south portion zoned 9FE. The north portion was rezoned from Conservancy to RR2 by the City :ouncil earlier this year, and Mr. Kellison is now desirous of splitting Lhe property into two separate parcels. This request was reviewed by the Planning Commission on June 28, 1989, at which time said Commission recommended approval subject to compliance with special conditions. The necessary permit from the RCWD has been secured, and the City Code Enforcement Officer has indicated that the percolation test results are within the requirements of our current septic ordinance' Based on the information provided, City staff can see no objections to approval of this minor subdivision and waiver of the formal platting requirement. Vail made motion, Olson seconded, to approve the final certificate of survey #11-20-89 for James Kellison and waiver of the formal platting procedure, for the following described property: Part of Govt Lot 1, Section 31, T31N, R21W, Washington County, Minnesota (aka 93031-0300) lying east of Elmcrest Avenue and north of 129th Street' Approval is subject to the following special conditions: ' 1' The final survey must be filed with Washington County within 90 days of survey acceptance' 2. All conditions of survey approval must be met prior to the stamping of any deeds for recording by the City Clerk unless otherwise permitted by Council action' 3' The property lines on site must be identified by the applicant to assure proper setbacks when buildings are to be constructed, if required by the building inspector' 4. Proposed driveways or drainage areas within the development must include installation of a minimum 15" diameter corrugated metal culvert, in a manner acceptable to the City' 5. No building permits shall be issued until the survey has been approved and recorded with Washington County. City Council meeting of November 20, 1989 Page b. Securing the required permits from the watershed district, DNR, and the Army Corps of Engineers is required prior to final survey approval. 7. All fees relating to this subdivision shall be paid by the applicant including the cost of recordinq documents with Washington County. S. Payment of fee in lieu of parkland dedication ($350.00) shall be paid to the City prior to final. plat approval. 9. No improvements, landscaping, or grading shall be permitted in the defined drainage areas without the express written authorization of the City and the approved watershed district. 10. All property owners shall be responsible for maintenenace of drainage areas within easements on their property. 11. The developer shall comply with all requirements and restritions applicable to identified wetlands. 12. No significant deviations from the approved survey shall be permitted unless reviewed by the Planning Commission prior to Council approval. 13. The developer shall permit access to the referenced site for periodic inspections to assure conformance with the minor subdivision. 14. Legal descriptions of all parcels to be subdivided shall be included. 15. Road easements for the Elmcrest Avenue road alignment shall be deeded to the City. All aye. Motion Carried. MINING PERMIT RENEWAL EG. INDYKIEWICZ Mr. George Indykiewicz of 1920 Highway 96, New Brighton, MN., has made application to the City of Hugo for renewal of a Mining Permit to mine black: dirt and sand -fill from his property generally described as the W 1/2 of N 1/2 of Section 17, T31N, R21W, in the City of Hugo. The property in question is located in both Conservancy and Agricultural zoning districts, and consists of approximately 165 acres. Dating back to the early 1970's, Mr. Indykiewicz has been mining black dirt and other fill materials from the site in question, and the City has renewed this application on an annual basis subject to compliance with the special conditions of the Mining Permit. In reviewinq the existing Mining Permit, City staff would comment as follows: 1. Item #5 seems to be inconsistent with the application itself. Mr. Indyk:iewicz is requesting to remove the topsoil from the site, yet Item #5 says the topsoil shall be replaced and the area seeded. 2. Item #8 of the permit has not been complied with as is the case for Item #14. As of the time of this memorandum, the City has not been provided with proof of liability insurance as per Item # of the permit. In light of inquiries by Mr. Indyk:iewicz earlier this year for constructing buildings on the site in question, City staff would like to make special note of Item #6 of the Mining Permit, and the City's zoning ordinance which prohibits other types of commercial or industrial activities in Conservancy and Agricultural zones. City staff can see no problem with the request before the City Council regarding removal of black: dirt and 7ity Council meeting of November 20, 1989 ,age 3 sand from this area; however, any efforts to intensify the use of this property or provide for industrial or commercial use of same, would be inconsistent with the City's comprehensive plan at this time. In that the City has no contour map on file with regard to the activities taking place on site by Mr. Indykiewicz, City staff recommends that prior to issuing a permit in 1990, Mr. Indykiewicz prepare a topographic map showing the existing contours and proposed final elevations for the site. Atkinson made motion, McAllister seconded, to renew the Mining Permit for George Indykiewicz until November 1, 1990,, subject to the previous conditions as amended and set forth by the City. Mining permit not to be renewed until current certificate of insurance submitted as identified in Condition #22 of the permit. All aye' Motion Carried. TEMPORARY MOBILE HOME PERMIT (KEYSTONE BUILDERS) This matter was withdrawn from the agenda at the request of Mr. Bob Kiewel on behalf of Keystone Builders. 8.2 SISTER CITY MEMBERSHIP Donsistent with previous Council discussions, the City staff is -ecommending that the City of Hugo apply for membership in Sister Cities International which will provide with assistance and guidance in pursuing the Sister Cities Program for the City of Hugo. Sister Cities International gives the community a central clearing point to which it can turn to obtain assistance and information about programs. It provides direct access with embassies, government agencies, and organizational resources in the United States and throughout the world. Communities, such as Hugo, simply do not have the resources to pursue this type of effort, but in cooperation with other communities, and with the resources of the National Association, the City's goals could be accomplished. Sister Cities International is a membership organization, and charges a minimum fee to cover the expenses of publications and consulting services to assist U.S. communities in forming new affiliations. Membership dues are usually paid by the city. The city pays half the annual dues as a service fee during the initial stage of program formation. Based on the current population of the City of Hugo, are initial application fee would be $100.00 of which the City would have to pay $50.00 up front' The annual dues for membership, after initial membership, would be $100.00 per year. After a lengthy discussion regarding the pro's and con's of this project, and with the understanding that the City could withdraw should a lack of interest be shown, the following motion was made: Atkinson made motion, McAllister seconded, that the City of Hugo apply for membership in Sister Cities International, for an initial application fee of $100.00. City COUricil meeting of November 20, 1989 Paqe 4 CITY ENGINEER (CIF SATUS) This matter will be addressed by the City Engineer at the next regular City Council meeting of December 4, 1989. MISCELLANEOUS McAllister made motion, Jesinsk::i seconded, to adopt ORDINANCE 1989-2-62, AN ORDINANCE AMENDING CHAPTER 150 OF THE HUGO CITY CODE BY REESTABLISHING SUNDAY HOURS FOR THE SALE OF LIQUOR. VOTING AYE: McAllister, Jesinsk:i, Olson, Vail, Atkinson VOTING NAY: None Motion Carried. STANFORD KRUEGER City Administrator, Ken Huber, made an impromptu inspection of the Krueger property located at 6909 1'4nd Street North, and discovered violations in the Special Use Permit issued to him 8/x/87. Mr. Krueger will need to request an extension from the deadline of 12/71/89 for construction of a residence at which time the City will discuss these violations. LUTHERAN HOME -SHARE PROGRAM The 1990 proposed share for HUgo to continue participation in the Home -share Program is $158.CDO. Mayor Atk::inson reviewed the statistical matchups for the past two -to -three years, and discovered that Hugo had little to no participation in this program. McAllister made motion, Olson seconded, that the City of Hugo withdraw from the Home -share Program, and that a letter be forwarded to the interested parties stating the lack: of participation of HUgo residents the reason for withdrawal. CITY -WIDE -REFUSE HAUL_ I NG Councilman Vail inquired as to the possibility of contracting with one trash hauler in the City of Hugo to eliminate the volume of heavy truck: using City streets. Vail was ask. -:ed to list this matter on his 1990 priorities list for discussion at a future time. City Administrator, Ken Huber, reported on the status of the improvement Of County Road J/120th Street, east of Highway 61, and the Washington County Light Rail Transit Board meetinq held at City Hall on 11/14/89.
