PRESENT: Vail, Olson, Jesinski, McAllister, Atkinson City Administrator, Ken Huber City Attorney, Charles Johnson City Clerk, Mary Ann Creager Olson made motion, Vail seconded, to approve the minutes for the regular City Council meeting of December 4, 1989 as submitted. All aye. Motion Carried. Jesinski made motion, Vail seconded, to approve the claims for December 18, 1989 in the amount of $23,797.72. All aye. Motion Carried. FINAL PLAT - ST. SAUVER'S WESTVIEW ADDITION Mrs. Lorraine St. Sauver has made application to the City of Hugo for the subdivision of a 60 acre tract of land into six lots of approximately 10 acres each. The property in question is located at the northwest corner of Homestead Avenue and 132nd Street, and is currently zoned agriculture. The preliminary plat of St. Sauver's Westview Addition was reviewed by the City Council on October 16, 1989, at which time the City Council gave its preliminary approval. The required percolation tests have been completed on all six lots, and meet with Washington County's approval. The required permit from the RCWD has been secured, and the fee in lieu of parkland dedication has been paid. City Administrator, k;en Huber, explained that Outlot A. as indicated on the plat, will be quit claimed to the property owner to the north to alleviate a potential legal problem. Vail made motion, Jesinski seconded, to approve the final plat of ST. SAUVER'S WESTVIEW ADDITION for the subdivision of a 60 acre tract of land into six lots of approximately 10 acres each. The property is generally described as that part of the north 105 acres of the SW 1/4 of Section 27, T31N1, R21W, lying east of the west 1,257.75 feet, and part of the south 150 feet of the S 1/2 of the NW 1/4 of Section 27, T31N, R21W, Washington County, Minnesota. Final plat is subject to the following conditions: 1. Subdivision approval shall be contingent upon compliance with plat requirements, as well as the grading, stormwater drainage, and utility plans. 2. All conditions of plat approval must be met prior to the stamping of any deeds for recording by the city clerk: unless otherwise permitted by Council action. 3. The property lines on site must be identified by the applicants to assure proper setbacks when buildings are to be constructed, if required by the building inspector. 4. Proposed driveways or drainage areas within the development must include installation of a minimum 15" diameter corrugated metal culvert in a manner acceptable to the City. 5. No building permits shall. be issued until the plat has been approved and recorded with Washington County. / S� City Council meeting of December 18, 1989 Page b. All. fees relating to this subdivision shall be paid by the applicant including the cost of recording documents with Washington County. 7. Installation of required stormwater control shall be installed at the developer's expense. S. No improvements, landscaping, or grading shall be permitted in the defined drainage areas without the express written authorization of the City and the approved watershed districts. 9. All property owners shall be responsible for maintenance of drainage areas within easements on their property. 10. Developer shall comply with all requirements and restrictions applicable to identified wetlands. 11. The developer shall be responsible for street signs, identifying mailbox locations, providing as --built drawings, installation of trees, and culverts within the development, as required. 12. Any exterior lighting or advertising activities on site must be approved by the City. All aye. Motion Carried. VARIANCE - GARAGE SIZE On behalf of Fred Macalus. Jr., Collova Construction has made application to the City of Hugo for a variance to construct a 684 square foot attachec garage in an SFE zone. The maximum allowed under current ordinance standards is 721 square feet. The request in question is consistent with past Council policy regarding the granting of variances for attached garages up to 1,000 square feet in size. The property in question is generally described as Lot b, Block 1, Bald Eagle Estates (aka 4940 Gallivan Court). The applicant has indicated that the garage will be used for residential/personal storage only. Atkinson made motion, McAllister seconded, to approve the variance request of Collova Construction, on behalf of Fred Macalus, Jr., for the construction of a SS4 square foot attached garage on Lot b, Block: 1, Bald Eagle Estates (aka 4940 Gallivan Court). The garage is to_be used for residential/personal storage only. All aye. Motion Carried. COUNCIL PRIORITIES Mayor Atkinson requested that the City Council complete and submit its review of the Council priorities list. This matter will be discussed at the regular Council meeting of January lb, 1990, allowing time for the City Administrator to tally the numbers. CITY ATTORNEY - REPORT ON THE STATUS OF THE WHITE BEAR ROD €< GUN CLUB City Attorney, Charles Johnson, reported on this matter, and recommended that the City continue with its present course of action. City Council meeting of December 18, 1989 Page 3 City Administrator, Ken Huber, reported that because of the State of Minnesota's possible deficit in forecasted revenue, the City of Hugo may be looking at further reductions in Local Government Aid. Atkinson made motion, Olson seconded, to adjourn at 7:35 PM' All aye. Motion Carried' Mayor Atkinson reconvened tonight's meeting at 7:50 PM for further discussion of the White Bear Rod & Gun Club litigation and the City's course of action' Atkinson made motion, Olson seconded, to adjourn at 7:55 PM.
