MINUTES OF THE PROCEEDINGS_ FOR THE CITY COUNCIL MEETING OF APRIL 4. 1988
The regular meeting was called to order by Mayor Atkinson at 7:00 PM.
PRESENT: Peltier, Potts, Olson, Vail, Atkinson
City Administrator, Ken Huber

Peltier made motion, Olson seconded, to approve the minutes for March 21,
1988 as submitted.
All aye. Motion Carried.
Vail made motion, Peltier seconded, to approve the General Claims for
April 4, 1988 in the amount of $11,989.64.
All aye. Motion Carried.
Olson made motion, Peltier seconded, to approve the Utility Claims for
April 4, 1988 in the amount of $4,796.05.
All aye. Motion Carried.
REZONING REQUEST (ARCAND/k::EYSTONE BUILDERS)
The matter before the Council is a continuation of earlier -Council
meetings dated March 21 and March 7. The request involves a petition by
Mrs. Irene Arcand and keystone Builders Corporation for the rezoning of
160 acres from agricultural to RRI residential. The property in question
is described as the E 1/2 of the SE 1/4 of Section 33, T31N, R21W, and the
western 1/2 of the SW 1/4 of Section 34, T31N, R21W, and approximately
2.13 acres owned by Mrs. Arcand lying north, northwest of County Road 10.
The property abuts on 125th Street to the north and County State Aid
Highway ltd on the south. Agricultural zones require a minimum 10 acre lot
size while the developers are requesting a minimum lot size of 3 acres.
The applicant is proposing this rezoning with the intent to subdivide the
property into 35 to 40 lots, and construct homes in the price range of
$200,000 to $400,000. Both the proponents of this development and
opponents of the development have had an opportunity to present their
positions to the Planning Commission and City Council at previous
meetings. The applicants requested that this matter be tabled to the City
Council meeting of April 4, 1988 so that a decision can be made with all
Council members present. The developers have argued that the proposal in
question: 1) is consistent with -the comprehensive plan, 2) is consistent
with development in the surrounding area, and 3) that the site in question
can accommodate on-site septic systems and the traffic that could be
generated as a result of this type of rezoning request. The opponents
have argued that this type of rezoning will allow for development that: 1)
is inconsistent with the comprehensive plan, 2) is inconsistent with
development in the surrounding areas, 3) will overload classrooms in the
school district that serves that area, 4) will raise tastes, 5) is a spot
zoning, and 6) jeopardizes environmental concerns.

The City Council has been provided with a lot of facts, opinions, and
personal emotions regarding this issue. We recognize the difficulty in
mak:inq a decision of this nature in light of all the circumstances
surrounding this proposal. Whatever decision is made by the Council
should be supported by fact and carefully documented.
Potts made motion, Peltier seconded, to deny the application of Irene
Arcand and keystone Builders Corporation for the rezoning of 160 acres
from agricultural (10 acre lot size) to RR1 residential (3 acre lot size)
for the following reasons:
1. The rezoning will allow for development that is inconsistent with the
city's comprehensive plan requiring a minimum of five gross acres for
each dwelling unit outside of the city's urban service area.
2. The unimproved gravel roads serving this property are not in a
condition that will accommodate the additional traffic generated by
this development density.
3. The Metropolitan Council has stated "The city is strongly urged to
adopt density zones of one unit per 10 acres for the rural area", and
this rezoning would allow for a greater density than recommended.
4. There are no municipal sewer services available in this area to serve
the development in question, and the use of on-site septic systems for
a development with a three acre per dwelling unit density could
seriously jeopardize the water quality in this area.
5. The areas surrounding the site are primarily zoned for 5 acre and 10
acre developments.

PERSONNEL. POLICY (CITY OF HUGO)
Olson made motion, Peltier seconded, to table review of the proposed
personnel policy until the regular City Council meeting of April 18, 1988
for further Council review.

City Council meeting of 4/4/88
FOREST LAk..E YSB CONTRACT
The annual contract for services from the Forest Lake YSB has been
submitted for Council approval. The contract appears to be the same as
those entered into in previous years. The city's participation, as
reflected in the contract, is in an amount not to exceed $2257.00. The
city administrator noted the city attorney's concerns about certain
language in the contract.
Atkinson made motion, Olson seconded, authorizing the Mayor and City ClerF:.
to sign the Forest Lake Youth Service Bureau Contract for the year 1988.

REQUEST FOR WAIVER OF SUBDIVISION REQUIREMENTS (KOSTUCH,�
The city received a letter from Mr. John k:ostuch, Jr., requesting a waiver
of the city's subdivision requirements for Sunny Creek: Acres requiring the
installation of concrete curb and gutter. In his letter, Mr. Kostuch
states that because of the high cost of installing sewer into this
project, it will be financially difficult for him to pay the cost of the
concrete curb and gutter. He is requesting authorization to install
bituminous curbing as designed by the city engineer. He has also
requested authorization to install the sanitary sewer at his own expense
subject to compliance with city design requirements. Mr. Kostuch would
like to avoid providing a letter of credit equal to 15% of the cost of
all improvements, and would like to provide a letter of credit to cover
just the cost of bituminous surfacing and curbing that would not be
installed until b to 9 months after the sewer and street base are in
place.
Vail made motion, Potts seconded, that because of the one acre lots in the
Sunny Creek Acres subdivision, the City Council grants a waiver of the
concrete curb and gutter requirements, and will allow for a bituminous
curb and gutter as designed by the city engineer, or construction of the
road to rural section standards to accommodate storm water drainage with
said street design to be approved by the city engineer.

MISCELLANEOUS
Atkinson made motion, Peltier seconded, that the City of Hugo grant an
extension to Gene/Lisa Sampson and Mr. and Mrs. Anafarta to June 30, 1988
to allow them additional time in which to relocate their tractor/trailer
now parked at their residences at 6560 177th Street and 6761 177th Street,
respectively.
