PRESENT: Peltier, Potts, Olson, Vail, Atkinson City Administrator, Ken Huber City Attorney, Charles Johnson City Clerk, Mary Ann Creager Peltier made motion, Vail seconded, to approve the minutes of May 2, 1988 as amended. All aye. Motion Carried. Vail made motion, Peltier seconded, to .approve the General Claims for May 16, 1988, in the amount of $58,8C)6.40.' All aye. Motion Carried. Potts made motion, Peltier seconded, to approve the Utility Claims for May 16, 1988 in the amount of $163.40. All aye. Motion Carried. HUGO LIONS CLUES - 3.2 NON -INTOXICATING LIQUOR LICENSE AtL::inson made motion, Peltier seconded, to grant approval of an on --sale _.2 beer license to sell alcoholic beverages during Good Neighbor Days on June 10, 11, and 12, 1988, for the Hugo Lions Club, All aye. Motion Carried. AMERICAN LEGION POST AUXILIARY 620 - CHARITABLE GAMBLING Atkinson made motion, Peltier seconded, that the City of Hugo has no objection to the American Legion Post 620 Auxiliary to operate bingo games at 5736 147th Street North, and waives the 30 days waiting period. All aye. Motion Carried. FINAL SURVEY APPROVAL= ( DON SEMPEL.. _ SUB.. D . ) On behalf of Safeway Movers, Inc., Mr. Don Sempel has made application to the city of Hugo for a minor subdivision and waiver of the formal platting requirements to subdivide an 18.5 acre tract of land in the city of Hugo. The preliminary survey was reviewed by the Planning Commission, and subsequently approved by the City Council on April 18, 1988. The parcel in question is generally described as an 18.5 tract identified as part of the SE 1/4 of Section 8, T31N, R21W, Washington County, Minnesota. Peltier made motion, Potts seconded, to approve the final certificate of survey #5-16-88 for Mr. Don Sempel (Safeway House Movers), waiver of the formal platting procedure, for the following described property: Part of the SE 1/4 of Section 8, T31N, R 1W, Washington County, Minnesota. Approval is subject to the following special conditions: JZ City Council meeting of 5!16/88 Page 2 1. All conditions of this approval must be met prior to stamping any deeds for recording by the city clerk unless otherwise permitted by City Council action. 2. All property lines must be identified on site by the applicant to assure proper building setbacks if required by the building inspector. 3. Driveways or drainage areas must include installation of a minimum 15" diameter corrugated metal culvert in a manner acceptable to the city. 4. All fees relating to the subdivision approval shall be paid by the applicant including the cost of recording documents with Washington County. 5. On-site activities permitted as a result of this subdivision shall not cause the altering of any watercourse, ditch, or drainage systgem in the area. 6. Payment of all parkland dedication fees shall be made prior to final. survey approval ($125.00). 7. Approval of this subdivision shall not create any landlocked parcels adjacent to the site. B. Any future subdivision of Parcels 1 and 2 of this survey shall be done by formal plat. All aye. Motion Carried. 7.2 SUBDIVISION ORDINANCE Utilizing the city's existing subdivision ordinance and a draft ordinance prepared by an ordinance committee of the City Council, the city engineer, the city attorney, and city administrator have drafted a subdivision ordinance that will wort: well in the City of Hugo. The Hugo Planninq Commission spent one entire evening reviewing this ordinance, and it comes to you with their unanimous recommendation for approval. Although vie could not call this a model ordinance, we do feel it fits the City of Huqo well, and is a tremendous improvement over our current ordinance. This ordinance should be easier for the staff, Council, residents, and developers to read and understand. After a page -by -page review of the ordinance, and the making of several changes, Mayor Atkinson made the following motion: Atkinson made motion, Peltier seconded, to adopt ORDINANCE 88-248, AN ORDINANCE REGULATING THE DIVISION OF PROPERTY AND SETTING REDUIREMENTS FOR PLATTING AND DEVELOPMENT OF PROPERTY IN THE CITY OF HUGO. All aye. Motion Carried. SPECIAL USE PERMIT D. RIECk Donald and Nancy Rieck: have made application to the city of Hugo for a Special Use Permit and site plan approval to keep one horse on their property described as follows: That part of Government Lot 5, Section ;'5, T31N, R21W, Washington County, Minnesota, lying east of the west 486.16 feet and north of the south 1,060 feet containing 5.0 acres more or less, subject to Irish Avenue North along the east line. The property in question is zoned RR2, and the city's zoning ordinance would allow for one 57 City Council meeting of 5/16/88 Page _ horse on a tract of land this size. It is the intention of the appli.c_ant to construct a 121' x 16' foot horse barn, and provide a fenced area 265' 45(-.)' to confine the horse. The Hugo Planning_ Commission reviewed this... request at their April '?7, 1988 meeting, and recommended approval of said request subject to compliance with the special conditions and identifying an area on site where the animal. would be confined. There were no objections raised to this request at the public hearing on April 27th. Olson made motion, Peltier seconded, to approve the Special Use Permit and Site Flan for Donald and Nancy Rieck to keep one horse on their propert.,; on their property described as follows: That Fart of Government Lot 5, Section -?5, T•31N, R?1W, Washington County, Minnesota, lying east of the west 486.16 feet and north of the south 1,060 feet containing 5.0 acres more or less, subject to Irish Avenue North along the east line. Approval is subject to the following conditions: 1. The number of horses permitted on site shall be limited to one. The animal shall be restricted to the area identified as the corral car fenced in area on the site plan. No resubdivision of the five (5) acre tract of land in question shall be permitted or this special use permit shall be null and void. 4. No commercial use of the property shall be permitted. 5. All fees relating to the issuance of this permit shall be paid by the applicant including the cost of recording at Washington County. S. All activities on site shall not cause the altering of any watercourse, ditch, or drainage system. 7. The applicant must provide access to the referenced site for periodic inspection by the city to assure conformance with this permit. 8. Any revisions to the approved site plan must be reviewed by the Planning Commission and City Council. 9. All animal feces on site as a result of boarding this horse shall. be removed in a manner acceptable to the city. 10. The animal on site shall be that of the property owner, and shall be for personal use only. 11. The applicant must comply with any DNP recommendations. All aye. Motion Carried. F' I CI::*UF' TRUCE-:: PURCHASE City staff is requesting Council authorization to proceed and secure quotations for the purchase of a pickup truck for the city staff. Currently, the city staff, consisting of the city clerk, deputy clerk, code enforcement officer, city administrator, utilities personnel, and administrative intern, all share use of the Ford Bronco. Said vehicle is also used by the fire department personnel on various occasions. The city street supervisor has also had occasion to use the Ford Bronco when his vehicle is not operating properly. Currently, there are employees i.ising their own personal vehicles because of their inability to operate the Bronco and the lack; of availability of the vehicle. The city has provided for funding of a vehicle with equipment certificates. It is our intent. to �� � �� �� � City Council meeting of 5/16/88 Page 4 buy a small or medium-sized pickup truck with a bench seat, air conditioning, automatic transmission, and other standard features. Rather than prepare detailed specifications, it our intent to write some general specifications as noted above, and secure quotations from local car dealers for the purchase of a vehicle on the lot. Atkinson made motion, Vail seconded, authorizing the purchase of a small/medium sized pickup truck. All aye. Motion Carried. MISCELLANEOUS The city received a letter from Mrs. Joyce Seever stating that because of speeding cars, she has had to replace fencing needed for securing horses boarded on her property lying along Oneka Lake Blvd. This matter is to bs referred to the city engineer for his review as to roadway design. Councilman Potts again mentioned the illegal parking of an over -sized truck at the Rick Flanagan property located at 6319 175th Street in violation of his special use permit and a recent court's ruling ' Mr. Barry Stack, land surveyor for Mr. Schuneman, was present to clarify any questions the Council may have had regarding the 8chuneman subdivision. City engineer, Howard Kuusisto, had responsed to a Council directive regarding the road right-of-way width in question. The Council agreed to accept the variable right-of-way width as proposed on the certificate of survey. The city administrator reported on the new telephone system purchased by the city. Peltier made motion, Potts seconded, to adjourn at 9:10 PM. All aye. Motion Carried.
