MINUTES OF THE PROCEEDINGS FOR THE CITY COUNCIL MEETING OF 9/6/88
The regular meeting was called to order by Mayor Atkinson at 7:00 PM.

Peltier made motion, Vail seconded, to approve the minutes of the regular
meeting of August 15, 1988 as submitted.
All aye. Motion Carried.
Vail made motion, Peltier seconded, to approve the minutes of the special
meeting of August 22, 1988 as submitted.
All aye. Motion Carried.
Potts made motion, Peltier seconded, to approve the General Claims for
September 6, 1988 in the amount of $54,757.19.
All aye. Motion Carried.
Vail made motion, Peltier seconded, to approve the Utility Claims for
September 6, 1988 in the amount of $6,689.95.
All aye. Motion Carried.
APPOINTMENT TO BROWN'S CREEk:: WATER MANAGEMENT BOARD
We have been notified by Brown's Creek Watershed District that the term of
Dave Truax: has expired. Dave has served as Hugo's representative to the
board since it's inception. Our representative to the board will serve a
three year term. Mr. Truax has indicated that he is willing to continue
to serve on the board if the city council chooses to reappoint him.
Atkinson made motion, Peltier seconded, that the City of `HLtgo reappoint
Dave Truax•: to serve as its representative on the Brown's Creek WMO for a
term to expire 7/1/91.

MINOR SUBDIVISION REQUEST (JAMES CRAIN)
Mr. Herman Strehlow and Celia Crain have made application to the City of
Hugo for the subdivision of a 67 acre tract of land into two parcels, one
consisting of 41 acres and one of approximately 26 acres. The 41 acre
parcel is located at the northwest corner of Everton Avenue and County
State Aid Highway No. 8, while the 26 acre tract is located south of
County State Aid Highway No. 8 at it's intersection with 146th St. No. It
is the intent of the applicant to construct a residence on parcel B as
indicated on the certificate of survey. The property in question is
currently zoned conservancy requiring minimum 20 acre sites. The site is
generally described as a part of the east half of the northwest 1/4 of
Section 19, T31N, R21W, Washington County. The site development has been
approved by Rice Creek Watershed District, and permits have been forwarded

to the city. Mr. Crain has stated that all structures on site will be
built at an elevation of at least 911.9 to assure conformance with the
city's floodplain regulations. The Hugo Planning Commission has
recommended approval of the minor subdivision and waiver of the formai
platting requirements subject to special conditions.
Atkinson made motion, Potts seconded, to approve the final certificate of
survey #9-6-88 for Herman Strehlow and Celia Crain, waiver of the formal
platting procedure, for the following described property: The East 1/2 of
the NW 1/4 of Section 19, T31N, R21W, Washington County, Minnesota.
Approval is subject to the following conditions:
1. Final survey must be submitted to the city council within 90 days of
preliminary survey acceptance or this approval shall be null and void.
2. All conditions of survey approval must be met prior to stamping of any
deeds for recording by the city clerk.
3. Property lines, and applicable easement lines, must be identified on
site by the applicants to assure proper setbacks when buildings are to
be constructed if required by the building inspector.
4. Driveways or drainage areas must include installation of a minimum 15"
diameter corrugated metal culvert in a manner acceptable to the city
if required.
5. No building permits are to be issued until the required permits are
secured from the appropriate watershed district and the DNR where
applicable.
6. All fees relating to this subdivision approval shall be paid by the
applicant including the cost of recording documents with Washington
County.
7. Any driveway permits requiring access to highways or county roads may
not be issued until permits are secured with Washington County or
MNDOT.
8. On site activities permitted as a result of this subdivision shall not
cause the altering of any watercourse, ditch, or drainage system in
this area.
9. Percolation tests must be submitted to the city prior to final survey
and plat approval.
10. Payment of the parkland dedication fee ($175.00) shall be made prior
to final survey approval.
11. All roadway and drainage easements must be shown on the final survey.

REQUEST FOR MULTIPLE SEWER CONNECTION
Mr. Terry Granger is requesting council authorization for a multiple sewer
connection to serve a home under construction at 5598 141st St. The lot
in question is a part of a minor subdivision (DeFoe property) approved by
the city council earlier this year. At the time of the subdivision
approval, the applicant stated that there would be separate service lines
installed for each of the lots in question. After discussing this matter
with the city engineer and utility superintendent, this request for a
multiple sewer connection was denied by the city staff. With the
exception of multiple services for separate buildings under a single
ownership, allowing for these types of connections is a bad practice and

can create administrative and legal problems for the city in the future.
The city engineer has indicated that from a technical standpoint a 6"
service line to the street can accommodate the flowage from the two
houses; however, he also agrees that allowing multiple connections can be
a bad practice. We have advised Mr. Granger of the appeal procedure to
the city council pursuant to Chapter 262-6 Subd. B of the municipal code'
Mr. Granger has indicated that providing a separate connection will cost
him an additional $2,000. The city has authorized him to make the
necessary cuts in the street for the connection; however, Mr. Granger's
concerns seem to be economic in nature'
At the Council meeting, Mr. Granger questioned why the city would want to
tear up the existing roadway for possible future road problems, and stated
that the connection would be done according to state code with clean outs
to be installed at the street. A letter from the city engineer stated
that if the multiple connection is approved that a manhole be installed at
the connection for clean-out purposes.
Mayor Atkinson and Councilman Vail and Olson felt that multiple connection
could create problems for the city some time in the future, and in general
is not a good precedent'
Vail made motion, Peltier seconded, to deny the request of Mr. Terry
Granger for a multiple sewer connection to serve a home located at 5598
141st Street North based on potential future problems for the city, and
they do not want to set this type of precedent.

RESOLUTION AUTHORIZING TRAFFIC REGULATORY SIGNS
Following a review of recommendations by the sheriff's department, city
staff is recommending the installation of traffic regulatory signs at
certain intersections in the City of Hugo.
Peltier made motion, Olson seconded, to adopt RESOLUTION 88-41, RESOLUTION
AUTHORIZING INSTALLATION OF TRAFFIC REGULATORY SIGNS'
VOTING AYE: Olson, Peltier, Potts, Vail, Atkinson
VOTING NAY: None

1989 GENERAL FUND BUDGET
On August 22, 1988 the city council received the proposed general fund
budget for 1989. A summary of the budget and detail of the Hugo Fire
Department's request was previously submitted to the Council for their
After balancing the proposed budget documents, City Administrator stated
that the necessary resolutions will be drafted and submitted to the
Council for their meeting of 9/19/88. The utility budget will also be
ready for Council review for the meeting of 9/19/88.

MISCELLANEOUS
Mayor Atkinson asked that the Council submit their comments to the City
Administrator regarding the format for amending of the city's zoning
ordinance.
The city administrator reported on the status of cable TV progress,
Richard Schuh mining permit, and compost recycling signs.
Olson made motion, Peltier seconded, to adjourn at 9:06 PM.
