Olson made motion, Peltier seconded, to approve the minutes for Septem-
ber 19, 1988 as submitted.

October 3, 1988, in the amount of $43,595.45.

VARIANCE REQUEST "GARAGE" (G & H BUILDERS)
On behalf of G & H Builders, Mr. Paul Husnik has made application to the
City of Hugo for a variance to construct an 896 square foot garage on Lot
2, Block 2, Bald Eagle Estates in the City of Hugo. The maximum allowable
garage in this zoning district is 720 square feet, and the request will
exceed that limit by 176 square feet. This matter was reviewed by the
Board of Zoning Adjustments at their September 28, 1988 meeting at which
time the Board recommended approval of the variance with the understanding
that the city is in the process of amending the zoning ordinance to allow
1,000 square foot garages in residential zoning districts.
Vail made motion, Peltier seconded, to approve the variance request of
G & H Builders, to construct an oversized garage of 896 square feet on Lot
2, Block 2, Bald Eagle Estates.

VARIANCE REQUEST "POLE BUILDING" (JOHN GROSS)
Mr. John Gross, 9915 170th Street North, has applied to the City of Hugo
for a variance to construct a 40' x 120' pole barn building closer to the
road than the principal residence on site. Mr. Gross owns a 40 acre tract
of land zoned agricultural identified as the W 1/2 of the W 1/2 of the NE
1/4, Section 12, T31N, R21W. The certicate of survey shows the parcel in
question as consisting of Parcel A and Parcel B. It should be noted,
however, that the property has not been subdivided by the city, and it is
being dealt with as a 40 acre tract of land not the subdivided parcel as
shown. Washington County has verified that Mr. Gross owns, and is paying
taxes on, one 40 acre tract. Accessory storage in an agricultural zone on
tracts of 20 acres or more is unlimited; however, the variance is
necessary to allow the building closer to the road than the principal

feet from 170th Street. The Board of Zoning Adjustments reviewed this
request at their meeting of September 28, 1988, and said Board recommended
granting of the variance allowing the accessory building closer to the
road than the principal residence with the understanding that the city's
zoning ordinance is being amended to deal with this requirement more
appropriately. Said recommendation by the Board of Zoning Adjustments was
subject to special conditions.
Potts made motion, Peltier seconded, to approve the variance request of
Mr. John Gross, 9915 170th Street North, to construct a 40' x 120' pole
barn building closer to the road than the principal residence on site.
The property is identified as the W 1/2 of the W 1/2 of the NE 1/4,
Section 12, T31N, R21W, Washington County, Minnesota. The variance
approval is subject to the following special conditions:
1. The use of both pole barns is strictly limited to uses subordinate to
the principal uses of a residence and that of farming. No other type
of commercial ventures shall operate from within these pole barns.
2. Any subdivision to a lot size smaller than 20 acres shall be cause for
removal of the 40' x 120' pole barn at the owner's expense.
3. No subdivision shall take place which leaves these pole barns on a
separate tract of land.
4. The conditions of this approval shall be filed with the County
Recorder, and applicant shall pay any filing costs.
SPECIAL USE PERMIT (WETTERSTROM)
Dill and Judy Wetterstrom have made application to the city for a special
use permit to house two horses on their property in an RR2 zoning
district. The property in question is 5.56 acres, and is generally
described as all that part of Lot 1, Bloc[:: 1 lying north of a line running
from the northeasterly corner of Lot 1•?, Block 2, to the easterly line of
said Lot 1 and parallel to the southerly line of said Lot 1, Sunset Part::,
Hugo, Minnesota. The site plan indicates the general layout and the
corral area where the horses will be confined. This request was reviewed
by the Planning Commission at a public hearing on September 28, 1988, and
said Commission unanimously recommended approval of the Special Use Permit
subject to special conditions.
Olson made motion, Peltier seconded, to approve a Special Use Permit for
Bill and Judy Wetterstrom, 12863 Ingersoll Avenue North, to house two
horses on their property in an RR2 -zoning district. The property in
question is described as all that part of Lot 1, Block. 1, lying north of a
line running from the northeasterly corner of Lot 13, Bloch: 2, to the
easterly line of said Lot 1 and parallel to the southerly line of said Lot
1, Sunset Park. Approval is subject to the following special conditions:
1. The number of horses permitted on site shall be limited to two.
2. The horses shall be restricted to the area identified as the corral or
fenced area indicated on the site pian.
3. No resubdivision of the 5.56 acre tract of land in question shall be

SPECIAL USE PERMIT (BIGHLEY)
William and Karen Bighley of 5764 150th St. No. have made application to
the City of Hugo for a special use permit to construct a 26' X 8'
unattached garage (accessory building) in an SFU zone. The applicants
currently have 452 sq. ft. of garage and accessory buildings on site and
are requesting an additional 720 sq. ft. The Maximum allowable without a
4pecial use permit is 980 sq. ft. The unattached garage is to be located
north of the existing attached garage, 5' from the west property line, and
18' from the rear property line. Mr. Bighley has indicated that he
intends to expand his living quarters into the existing 14' X 2`2' attached
garage and utilize the proposed garage for storage of his automobile and
personal belonqinqs. This matter was reviewed by the Hugo Planning
Commission at a public hearing on September 2S, 1988, and said Commission
unanimously recommended approval of the Special Use Permit noting,
however, that the garage in question cannot be used for auto repair or
other commercial uses, and must be restricted 'to other types of storage
customary to a residence, and other special conditions.
Mr. Bighley was present at the Council meeting, and stated that he
understood that the proposed accessory building was to be used strictly
for residential purposes, and that no commercial use would tat -.-.e place in
the building.
Vail made motion, Peltier seconded, to approve a special use permit for
William and f --;wren Bighley, 5764 150th Street Norty, to construct a 26' x
28' unattached garage (accessory building) in an SFU zone, subject to the
following special conditions:
1. The proposed garage be Used for residential purposes only .
2. The exterior and roof of the proposed garage be of the same material
and appearance as the principal residence on site.

applicant including the cost of recording at Washington County.

AUTO DISMANTLING LICENSE (BRANDT
Mr. Richard Brandt of Hugo Auto Farts, 16615 Forest Boulevard North, has
made application to the City of Hugo for an Auto Dismantling License to
operate in the City of Hugo. The property in question is located in the
SW 1/4 of the SE 1/4 of the NE 1/4 and that part of the South 40 rods of
the SW 1/4 of the NW 1/4 lying easterly of the right-of-way of the
Northern Pacific Railroad Company in Section 8, T31N, R21W consisting of
approximately 6.5 acres. The property is 400' wide by approximately 700'
deep and fronts on Highway 61. This request was reviewed by the Hugo
Planning Commission at their September 28, 1988 meeting, and said
Commission recommended approval of the Auto Dismantling License subject
special conditions.
Atkinson made motion, Vail seconded, to -approve the Auto Dismantling
License for Mr. Richard Brandt dba Hugo Auto Farts, 16615 Forest Boulevard
North. The property in question is located in the SW 1/4 of the SE 1/4 of
the NE 1/4, and that part of the South 40 rods of the SW 1/4 of the NW 1/4
lying easterly of the right-of-way of the Northern Pacific Railroad in
Section 8, T31N, R21W, Washington County, Minnesota. Approval is subject
to the following special conditions:
1. All existing fences surrounding the premises shall be maintained in a
condition satisfactory to the city at all times.
2. The driveway shall be maintained clear at all times so that customers
are not prevented from reachinq the parking area, and no auto
dismantling may be conducted within fifty (50) feet of the parking
area. All storage must be within the fenced area.
3. The owner/operator shall submit a plan indicating fire lanes and the
layout of the auto dismantling yard and the area where automobiles are
stored, to the City of Hugo, within twenty (20) days after the date of
this Auto Dismantlinq License. In the event the existing conditions
do not comply with the plan layout as submitted, the owner/operator
shall cause the automobiles and other materials within the auto
dismantling yard to be rearranged to comply with said plan within
ninety (90) days after the date of this Auto Dismantling License.. It
is understood that in the preparation of said plan, the owner/operator
shall provide fire lanes between stored automobiles, and between the
stored automobiles and the boundaries of the property. Said fire
lanes so arranged to be a minimum of ten (10) feet in width at ground
level and to the height of stacked automobiles, and no more than two
(2) rows of stored automobiles shall be stacked between fire lanes. A
spacing of at least (10) feet shall be maintained for any automobiles,
parts, or materials, from any building, or a spacing in excess of ten
(10) feet that may be necessary to provide adequate fire protection.
4. No tires are to be piled along the southerly property line and must be
disposed of in a manner acceptable to the Minnesota Pollution Control
Agency and the Washington County Public Health Department.
5. Cars or other vehicles stacked in the auto dismantling yard shall not
be stacked over a height equivalent of two (2) passenger autos.
6. The owner/operator shall provide on the site, an adequate storage tank:
to hold any crankcase oils or gasoline or other petroleum products
which may be drained from the stored vehicles prior to their
dismantling.

7. The owner/operator shall cause signs to be erected and/or maintained,
notifying customers not to park on Highway 61, and directing customers
to the paved parking area west of main building as per the site plan.
B. A financial security, in the amount of $1�500.00, shall be posted with
the City of Hugo to insure that the conditions of the license are
complied with.
9. Any change of operation of said auto dismantling yard shall require
application by the owner for an amendment of the Special Use Permit
prior to any such change of operation being implemented' All
operations shall conform with all conditions of this permit.
10. The owner/operator is to install a monitoring well at the licensed
site and test must be performed by a laboratory of the
owner's/operator's choice, and should be tested for oil, gas, lead,
anti -freeze, etc.
11. All activities on site shall not camse the altering of any
watercourse, ditch, or drainage system in this area.
12. No auto parts, tires, and other miscellaneous debris may be buried on
site.
13. All interior roads on site, identified in the site plan, shall be kept
open at all times for access by firefighting vehicles and to assure
adequate access to all locations on site.
14. All flammable liquids stored on site shall be in compliance with city
fire marshall's requirements'
15. Functional fire extinguishers shall be provided in the office and all
vehicles used on site.
16' All ditches on or around the lot in question must be kept open at all
times and may not be filled without the consent of the City of Hugo.
17. All auto dismantling and other activities on site must be conducted in
a manner acceptable to the Minnesota Pollution Control Agency and
Washington County Public Health Department.
18. The licensee shall provide the City of Hugo with site access to
inspect for compliance with this license.
19. This license, as herein conditioned, shall be reviewed as specified
(every two years). The violation of conditions herein set forth may
result in the revocation of the license at any time. '
20. Failure to agree to these conditions by not signing this permit shall
void same.
21. Failure to adhere to the conditions of this permit shall be grounds
for permit revocation.

that they would prefer reviewing this every two

RESOLUTION CERTIFYING SPECIAL ASSESSMENTS
Minnesota Statutes require that annually the city certify its special
assessments with Washington County for placement on the tax rolls and
collection with 1989 taxes'

CERTIFYING SPECIAL ASSESSMENTS FOR COLLECTION IN 1989.

PROPOSED ZONING ORDINANCE AMENDMENTS
In March of this year, the city staff Submitted a questionnaire to City
Council members inquiring as to their concerns regarding needed
modifications in the city's zoning ordinance. Input was received from
most City Council members indicating their concerns and suggestions
regarding the updating of our zoning ordinance. Earlier this summer, the
city administrator- took. the liberty of preparing a draft rewrite of the
conservancy district portion of the city's zoning ordinance in an attempt
to reflect a new, simplified format incorporating the recommendations of
the City Council. City staff has requested that the Council review this
approach to a city zoning ordinance rewrite for future discussion. The
staff has received encouragement from the City Council to work on updating
the city's zoning ordinance this winter; however, city staff does not want
'to spend the hours and effort necessary in preparing an ordinance that the
City Council is not comfortable with. If the staff is to begin working on
the zoning ordinance this winter, it would be appropriate to get Council
input now so that the ordinance is what the City Council wants as opposed
to an ordinance reflecting only the staff's ideas and input. The Council
will be prepared to discuss this matter at the next regular City Council
meeting (10/17/88).
MISCELLANEOUS
Atkinson made motion, Peltier seconded, that the City of Hugo accept the
resignation of Troy Sonnefeld from the Hugo Planning Commission.

Atkinson made motion, Peltier seconded, that the City of Hugo appoint
Gayle Thoreson to fill one of the current vacancies on the Hugo Planning
Commission for a term to expire 12/31/91.
All aye. Motion Carried.
Mayor Atkinson stated that during a "slower month" he would like to
discuss the possibility of obtaining a grant for a City Hall addition with
the city administrator.
Information regarding "CELEBRATE MINNESOTA 1990" is to be provided to the
Hugo Lions Club for possible incorporation into their Good Neighbor Days.
City Administrator, i`en Huber, informed the Council that Monday, October
10th is a legal holiday and City Hall will be closed for business;
however, city staff will be working on that day.

The hockey rink located at Hugo Elementary School is being refurbished for
use this winter - board replacement and painting.
Atkinson made motion, Vail seconded, that summer intern, Tom Marshall,
continue to work for the City of Hugo on a part-time basis.

The City Council directed the city administrator to contact Grant Township
and White Bear Township regarding their possible participation in the
improvement of Goodview Avenue south of Hugo's corporate city limits to
C.S.A. Highway #10. The city would consider paying engineering costs for
their portion of the road. It would be up to the individual communities
to determine how the construction costs would be paid.
