PRESENT: Olson, Peltier, Potts, Atkinson City Administrator, Ken Huber City Attorney, Charles Johnson City Clerk, Mary Ann Creager ABSENT: Deane Vail Peltier made motion, Potts seconded, to approve the minutes of November 7, 1988 as submitted. All aye. Motion Carried. Peltier made motion, Olson seconded, to approve the minutes of the BOARD OF CANVASS on November 10, 1988 as submitted. All aye. Motion Carried. Potts made motion, Peltier seconded, to approve the General Claims for November 21, 1988 in the amount of $55,126.12. All aye. Motion Carried. Olson made motion, Peltier seconded, to approve the Utility Claims for November 21, 1988 in the amount of $388.89. All aye. Motion Carried. CHARITABLE GAMBLING LICENSE Atkinson made motion, Potts seconded, that the City of Hugo has no objection to the renewal of the Gambling License to MS to operate at Ricci's Saloon, and waives the 60 waiting period. All aye. Motion Carried. WASHINGTON COUNTY ASSESSOR PRESENTATION Mr. Scott Menne presented the Council with a report summarizing the new property tax laws for the taxes payable in 1989, and more specifically, homestead credit and state aids. SITE PLAN APPROVAL (INTER -STATE LUMBER) Mr. Don Kratt and Gary Peppard have made application to the City of Hugo for a site plan approval to construct a 20' x 100' loading dock on Burlington Northern Railway property' The site in question is generally described as part of Lot 26 of County Auditor's Plat No. 7, Section 20, T31N, R21W, and is located at the southwest corner of 145th Street and Highway 61. There is currently an existing warehouse on site, and it is the applicants' intent to extend a loading dock to the railroad spur located west of the warehouse. The property in question is zoned CB. ., / City Council meeting of 11/21/88 Page 2 - Potts made motion, Peltier seconded, to approve the site plan of Don Kra+ and Gary Peppard (Inter -State Lumber, 5517 145th Street) to construct a 20' x 100' loading dock on Burlington Northern Railway property. The site in question is generally described as part of Lot 26 of County Auditor's Plat No. 7, Section 20, T31N, R21W, Hugo, MN. All aye. Motion Carried. MINOR SUBDIVISION (FRANCIS LUTZ) Mr. Francis Lutz has made application to the City of Hugo for the subdivision of a 39.5 acre tract of land by minor subdivision and waiver of formal platting requirements. .The property in question is zoned agricultural, and is generally described as the NE 1/4 of the NE 1/4 of Section 15, T31N, R21W located north of 157th Street west of Ingersoll Avenue, east of Harrow Avenue, and south of 165th Street. This request was reviewed by the Hugo Planning Commission at their October 26, 1988 meeting, and said Commission recommended approval of the minor subdivision and waiver of the platting requirements subject to the special conditions. The plat will consist of two 10 acre parcels and one 19.5 acre parcel. The survey has been reviewed by the Rice Creek Watershed District, and Mr. Steve Woods has informed me that they have no problems with the development as proposed, and have no need for drainage or other easements on site. Copies of the approved RCWD permits will be on file prior to the stamping of any deeds for this parcel. Peltier made motion, Potts seconded, to approve final Certificate of Survey #11-21-88 for Mr. Francis Lutz, waiver of the formal platting procedure, for the following described property: The NE 1/4 of the NE 1/4 of Section 15, T31N, R21W located north of 157th Street, west of Ingersoll Avenue, east of Harrown Avenue, and South of 165th Street. Approval is subject to the following special conditions: 1. All fees relating to the subdivision shall be paid by the applicant including the cost of recording documents with Washington County. 2. Developer pay fee ($525.00) in lieu of parkland dedication at the time of final survey approval. 3. A drainage plan, including holding ponds and ditches, must be approved by the watershed district and maintained by the property owner with the method of maintenance to be reviewed by the city engineer. 4. Mailbox locations shall be approved by the United States Postal service. 5. Developer shall install one tree per lot of a minimal size within the subdivision development as per city regulations. 6. Approved driveways or drainage ways must include the installation of a minimum 15" diameter, corrugated metal culvert acceptable to the city, if required by the city building inspector. 7. The developer shall secure Rice Creek Watershed District approval of their on site drainage plan prior to approval of the final survey by the city council. 8. Percolation tests must be completed on each of the buildable lots and must be submitted to the city for review prior to final survey approval. 9. Lot lines within the subdivision must be identified to determine proper building setbacks if required by the building inspector. All aye. Motion Carried. City Council meeting of 11/21/88 Page 3 WASHINGTON COUNTY SEPTIC INSPECTIONS As per previous Council direction, the staff has met with representatives of Washington County to discuss the possibility of their providing septic system inspections for the City of Hugo. Currently, Hugo has an arrangement with the county to do inspections for existing septic systems. That arrangement has worked out very well, and city staff feels there may be some merit in having all of septic systems permitted and inspected by the county. The two steps necessary for the city to pursue this matter would be to enter into a formal agreement with Washington County for this service, and proceed with the adoption of a septic system ordinance consistent with that being enforced by Washington County. Potts made motion, Olson seconded, directing city staff to proceed with the steps necessary to contract with Washington County for septic system inspections, and the city attorney review the contract agreement and city staff prepare a draft ordinance. All aye. Motion Carried. RESOLUTION CLARIFYING BUILDING PERMIT REQUIREMENTS As per previous Council discussion, the staff has prepared a resolution clarifying the requirements for securing of a building permit. Apparently, there has been some confusion with regard to what requires building permits in the City of Hugo. Information from the city's building code and Minnesota Statutes with regard to uses exempt from the securing of building permits was provided to the Council for their review. City staff feels this clarification will be helpful in dealing with the public as well as elected and appointed officials in the City of Hugo. After a lenghty discussion relating to the requirement to obtain building permits for work performed in excess of $1.00 in value,_it was decided that the city administrator and building inspector will further discuss this matter, and report their findings to the Council at a later date' MINING PERMIT RENEWAL (GEORGE INDYi--.`.IEWICZ) Mr. George Indykiewicz, 1920 Highway 96, New Brighton, Minnesota has made application for his annual mining permit renewal to remove black dirt and fill from his property generally described as the NW 1/4 of Section 17, T31N, R21W, in the City of Hugo. The parcel of land is 165 acres in size. The request before the Council is renewal of the permit issued previously. The City Council may want to consider renewal of this permit on a two year basis to avoid annual renewals unless there is a change in the method of operation or violations of the permit' Atkinson made motion, Peltier seconded, to renew the Mining Permit for George Indykiewicz for a two year period, subject to the previous conditions as set forth by the city. City Council meeting of 11/21/88 Page 4 MISCELLANEOU The City of Hugo has scheduled a recount for the Council -at -Large position for Thursday, December 1, 1988 at 9:00 AM. City Attorney, Charles Johnson, reported that a tentative settlement has been negotiated for the appeal of assessments made by Joe Card and Clara Letourneau. Atkinson made motion, Potts seconded, that the city attorney negotiate a possible settlement as discussed with the City Council this evening. All aye. Motion Carried. A court hearing regarding the litigation between Hugo and the White Bear Rod and Gun Club has been scheduled for November 30, 1988' Peltier made motion, Olson seconded, to adjourn at 9:36 PM.
