PRESENT: Olson, Peltier, Vail, Atkinson City Administrator, Ken Huber City Clerk, Mary Ann Creager ABSENT: Potts Peltien made motion, Olson seconded, to approve the City Council minutes of 11/21/88 as submitted. All aye. Motion Carried. Olson made motion, Vail seconded, to approve the minutes of the Board of Canvass on 12/i/se as submitted. All aye. Motion Carried. Vail made motion, Peltier seconded, to approve the General Claims for December 5, 1988 in the amount of $26,543.50. All aye. Motion Carried. Olson made motion, Peltier seconded, to approve the Utility Claims for December 5, 1988 in the amount of $4,163.20. All aye. Motion Carried. 5.1_ LIQUO;__ . MISCELLANEOUS LICENSES Atkinson made motion, Peltier seconded, to remove the name of Robert M. Ricci dba RICCI'S SALOON & EATERY from the resolution for consideration of the City Council for liquor license approval. All aye. Motion Carried. ' Atkinson made motion, Peltier seconded, to adopt RESOLUTION 88-54, RESOLUTION APPROVING LIQUOR AND RELATED LICENSES. VOTING AYE: Olson, Peltier, Vail, Atkinson Motion Carried. Mayor Atkinson suggested that the City Council hold a public hearing at its next regular meeting (12/19/88) to consider possible suspension of Mr. Ricci's liquor license for numerous liquor related violations at his establishment. Councilman Vail suggested that a Washington County deputy also be present to represent the sheriff's office in this matter. Atkinson made motion, Peltier seconded, that the City Council hold a public hearing on 12/19/88 at 6:30 PM to enable Mr. Ricci to show why his liq"or license should not be suspended. All aye. City Council meeting of 12/5/88 Page 2 REZONING REQUEST_S_E.,_WLASC IN) Ray and Ramona Wlaschin have made application to the City of Hugo for the rezoning of a 16.7 acre tract of land from agriculture to RR2. The property in question is located south of County Road 8 in the W 1/2 of the SE 1/4 of the SW 1/4 of Section 36, T31N, R21W, Washington County, Minnesota . There is currently a house located on the extreme southwest corner of the site. The property is approximately 550 feet in width and 1,322 feet in length, and abutts agricultural zones on the west, north, east, and Grant Township to the south. The Hugo Planning Commission reviewed a similar request by Mr. Wlaschin on January 28, 1987. This request by Mr. Wlaschin was denied by the City Council on February 22, 1987. The Hugo Planning Commission again reviewed this request on November 22, 1988, and recommended its approval based on the 5 acre minimum lot size outside the urban service area as noted in the Comprehensive Plan. They also stated that a rezoning was no guarantee of a subdivision approval unless a subdivision meets city requirements and policies. Vail made motion, Peltier seconded, to adopt ORDINANCE 1988-252, ORDINANCE AMENDING CHAPTER 320 OF THE HUGQ CITY CODE ENTITLED "ZONING" DISTRICT CLASSIFICATION OF THE DESCRIBED REAL PROPERTY. VOTING AYE: Olson, Peltier, Vail, Atkinson Motion Carried. Jennie and Melvin Vietor have made application to the City of Hugo for the subdivision of a 19'84 acre tract of land into residential parcels in an agricultural zoning district. The property in question is located on the east side of Jeffrey Avenue in part of the E 1/2 of the SE 1/4 of Section 11, T31N, R21W, Washington County, Minnesota. The traci of land located south of Parcel B is owned by another party, and the tract of land located north of ParcelA is owned by Mrs. Vietor. The applicant has requested waiver of the square footage requirement and lot width for Parcel B because the easement north of Parcel A, and building locations, restrict the size of the site. Apparently, the access easement north of Parcel A is a fenced area and it might create some difficulty if the property line was moved from the proposed location. The Planning Commission recommended approval of this subdivision subject to special conditions. Olson made motion, Peltier seconded, to approve the final certificate of survey #12/5/88 for Jennie and Melvin Vietor, waiver of the formal platting procedure, for the following described property: Part of the E 1/2 of the SE 1/4 of Section 11, T31N, R21W, Washington County, Minnesota. Approval is subject to the following conditions: 1, The final survey be submitted to the City Council within 90 days of the commission's recommendation and the revised survey incorporate th recommendations of the staff, Rice Creek Watershed District, and other governmental agencies. r3 City Council meeting of 12/5/88 Page 2. The final survey will not be submitted to the council until all legal, engineering, and staff recommendations have been incorporated into the survey' 3. All fees relating to the subdivision shall be paid by the applicant including the cost of recording documents with Washington County. 4. Developer pay fee ($350.00) in lieu of parkland dedication at the time of final survey approval. 5. A drainage plan including holding ponds and ditches must be approved by the watershed district and maintained by the property owner with the method of maintenance to be reviewed by the city engineer. 6. Mailbox locations shall be approved by the United States Postal service. 7. Developer shall install one ±ree per lot of a minimal size within the subdivision development as per city regulations. 8. Approved driveways or drainage ways must include the installation of a minimum 15" diameter, corrugated metal culvert acceptable to the city if required by the city building inspector.. 9. The developer shall secure Rice Creek Watershed District permit prior to approval of the final survey by the City Council. 10. Percolation tests must be completed on Parcel "B" prior to City Council approval. 11. Lot lines within the subdivision must be identified to determine proper building setbacks if required by the building inspector. All aye. Motion Carried. SPECIAL USE_PERMIT (S.. ERHARDT Although this request was approved by the Planning Commission, the applicant has requested that hisapplication be withdrawn at this time. ' INGERSOLL AVENUE PRCJECT_- CHANGE ORDER, The staff is recommending approval of Change Order #1 for the Ingersoll Avenue P.I. project. This change order should not affect the total project cost as other quantities were below estimate. These changes were made during road construction and need Council ratification. Peltier made motion, Vail seconded, to approve Change Order #1 for the Ingersoll Avenue P.I. project. All aye. Motion Carried' , As per Council direction, city staff has researched and amended the previously submitted resolution to refect the intent of the City Council and city ordinances. Vail made motion, Olson seconded, to adopt RESOLUTION 88-55, RESOLUTION CLARIFYING WORK EXEMPT FROM SECURING BUILDING PERMITS. VOTING AYE: Olson, Vail, Atkinson VOTING NAY: Peltier Motion Carried. City Council meeting of 12/5/88 Page 4 11.0 MISCELLANEOUS Atkinson made motion, Peltier seconded, to appoint Larry Johnson and Keith Greenwaldt to the Hugo Fire Department, subject to the required probationary period' All aye. Motion Carried. City Administrator, Ken Huber, recommended that the city clean the city's drainage ditch for Fitzgerald Avenue located on city property. The Council approved the proposed cleaning project in the amount of $650.00. _ Atk±oscm made motion, Olson seconded, that the City Council reschedule the . starting time of their next regular meeting of December 19, 1988 from 7:00 All aye. Motion Carried. Councilmember Peltier felt that the city should pursue adoption of an ordinance regulating 3 -wheelers in the City of Hugo. Mrs. Peltier also stated that she would like to enter her name to fill one of the current vacancies on the Planning Commission. The Council directed the City Administrator to send a letter to the Burlington Northern Railroad indicating a desire to be given the right o'. first refusal if the B.N.
