HomeMy WebLinkAbout1988.12.19 CC MinutesYINUMES FOR COUNCIL MEETING OF-DECE BER 1.V 1983 - ' The meetinywas called to order by Mayor Atkinson at 6:30 PM' PRESENT: Olson, Peltier, Potts, Vail, Atkinson City Administrator, Ken Huber City Clerk, Mary Ann Creager Peltier made motion, Vail seconded, to approve the City Council minutes of December 5, 1988 as submitted. All aye. Motion Carried. Potts made motion, Peltier seconded, to approve the General Claims for December 19, 1988 in the amount of $23,538.25. All aye. Motion Carried. Vail made motion, Peltier seconded, to approve the Utility Claims for December 19, 1988 in the amount of $287.86. All aye. Motion Carried. RENEWAL OF LIQUOR AND RELATED LICENSES (R. RICCI) In that city ordinances do not provide for the revocation of the liquor license after conviction of the first liquor -related offense, city staff would recommend that the City Council act on the renewal of the liquor and related licenses for Ricci's Saloon and Eatery prior to the hearing for possible suspension of the licenses' Atkinson made motion, Potts seconded, to adopt RESOLUTION 88-56, RESOLU- TION APPROVING LIQUOR AND RELATED LICENSES FOR ROBERT M. RICCA DBA RICCI'S SALOON & EATERY FOR THE YEAR 1989. VOTING AYE: Olson, Peltier, Potts, Vail, Atkinson ' VOTING NAY: None Motion Carried. As per Council direction, the public hearing was scheduled for 12/19/88 at 6:30 PM, requesting Mr. Bob Ricci appear and show why his liquor license should not be suspended for conviction of a liquor -related violation' The city prosecuter submitted a letter indicating the outcome of the liquor licensing violation in question. The Council was provided a list of incident reports filed by the Washington County Sheriff's Department dating back to August 5, 1987. The incident reports merely reflect situations where the sheriff's department has reported possible violations and warned Mr. Ricci regarding the city's ordinance on operating after hours. At the Council's direction, city staff requested that a representative of the Washington County Sheriff's Department appear at the public hearing. Notices were also sent to Mr' Ricci as required in the municipal code. If the City Council chooses to suspend the licenses in question for a specified period of time, city staff would recommend that tne Council word the resolution carefully. / T( City Council meeting of 12/19/88 Page 2 Captain Tom Greene of the Washington County Sheriff's Office was present to explain the incident reports, and reviewed Ricci's past convictions of liquor ordinance violations. Mr. Ricci was present and stated that he felt he was being harassed by the sheriff's office. (ATTORNEY CHARLES JOHNSON ARRIVED AT 6:45 PM.) Mr. Ricci also felt that the violations were not serious (after-hours occupancy) because they did not involve liquor consumption. Councilman Potts suggested a five day revocation, but suspend the revocation if there were no other violations within a year. Councilmember Peltier questioned why there were so many warnings issued before a citation was issued. Councilman Olson felt that because of the many warnings that were issued, it would be appropriate for the city to order a three day suspension, waive two days if no there are more violations, and serve a one day suspension. Mayor Atkinson and Olson felt that the city had to enforce city ordinances because of the many warnings issued to Mr' Ricci. Councilmen Potts and Olson did not feel that Mr. Ricci was being harassed in that the deputies were only doing their jobs. Atkinson made motion, Vail seconded, to adopt RESOLUTION 88-57, RESOLUTION DIRECTING THE SUSPENSION OF LIQUOR LICENSES FOR ROBERT M. RICCI. VOTING AYE: Olson, Vail, Atkinson VOTING NAY: Peltier, Potts Motion Carried. WHITE BEAR TOWNSHIP - JOINT POWERS AGREEMENT At the request of the City Council, White Bear Township has revised the language in the Joint Powers Agreement for the 120th Street road improvement project as per the recommendations of the city attorney' Atkinson made motion, Vail seconded, authorizing the City of Hugo to enter into a Joint Powers Agreement with White Bear Township and Ramsey County for the improvement of County Road J (120th Street North). VOTING AYE: Olson, Potts, Vail, Atkinson VOTING NAY: Peltier Motion Carried. Mr. Stanford Krueger has requested Council consideration for allowing hin to begin construction on his home by December of 1989 as opposed to the previously designated December 31, 1988 date. Mr. Krueger received a special use permit allowing him to construct an accessory building prior to a principal residence, and said request was granted subject to special conditions. Item #10 of the SUP requires that the principal building mus be substantially underway by 12/31/88. Mr. Krueger has indicated that because of the cost of site improvements, he will not be ahle to begin constructicx' of the principal residence until some time in 1989. He is requesting that the date in Item 410 of the SUP be extended to 12/31/89. /57 City Council meeting of 12/19/88 Page 3 Peltier made motion, Potts seconded, that the date in Item #10 of Stanford Krueger's SUP 410 be extended from December 31, 1988 to December 31, 1989. All aye. Motion Carried. MISCELLANEOUS Mayor Atkinson referred to a letter of response from Washington County regarding the upgrading of Elmcrest Avenue. In essence, they stated that the county would share in any costs unless they take over the roadway. Mayor Atkinson asked that city staff communicate with Washington County Public Works requesting that they ask the Washington County Board to reclassify Elmcrest Avenue to a county road. A letter is also to be forward to Lino Lakes requesting that they approach Anoka County with a similar request. The city received a letter from a resident regarding a motorcycle accident on Everton Avenue, and a request that a street sign be placed in proximity of the accident to avoid future occurrences. The matter is to be referred to the sheriff's office for their investigation and subsequent recommendation. City Attorney, Charles Johnson, reviewed the status of the White Bear Rod and Gun Club matter, the Ingersoll assessment appeal, and the "Stanek" matter. Art Potts suggested that some time in the future the city consider publication of a magazine outlining the history of the city, along with current opportunities, to help promote the city. Mayor Atkinson acknowledged the last Council meeting for Art Potts and Teddy Peltier, and thanked them for their many years of dedicated service to the City of Hugo.
