MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL
July 6, 1987
The regular meeting of the City Council was called to order by Mayor George Atkinson
at 7:00 PM.
PRESENT: Peltier, Potts, Olson, Vail, Atkinson

Potts made motion, Peltier seconded, to approve the minutes of June 15, 1987, as amended.
All aye. Motion Carried.
Peltier made motion, Potts seconded, to approve the General Claims for July 6, 1987,
in the amount of $10,129.21.
All aye. Motion Carried.
Vail made motion, Peltier seconded, to approve the Utility Claims for July 6, 1987,
in the amount of $4,112.31.
All aye. Motion Carried.
7.A American Legion Auxiliary Presentation
Representatives from Hugo's American Legion Auxiliary were present at this meeting
to present a check in the amount of $1,500.00, to the City of Hugo, to be used for
the purchase of a hydro spreader by the Hugo Fire Deparment. This tool will enable
the rescue squad to remove victims from vehicles involved in traffic accidents. The
Mayor expressed the city's appreciation to the Auxiliary for their generous donation.
8.A Preliminary Subdivision Survey (Vern Peloquin)
Mr. Vern Peloquin has made application to the City of Hugo for a minor subdivision
and waiver of formal platting requirements for a .13 acre tract of land identified
as part of the SET of Section 17, T31N, R21W, Washington County. The property in
question is located east of Highway 61 immediately north of the Twin Pine Trailer
Court. Apparently when other property was previously subdivided, a 15.3 foot tract
of land was omitted from the land descriptions, and it is Mr. Peloquin's intent
to consolidate this tract of land with property immediately north, owned by Mr.
Robert C. Bernier. Mr. Peloquin states that the property in question is zoned SFE.
If the property in question is combined with the site to the north, as proposed,
we can see no objection to the proposal subject to special conditions. This request
was reviewed at a public hearing of the Planning Commission meeting on June 24, 1987,
and said Commission unanimously recommended approval subject to special conditions.
Mr. Peloquin asked if he could received a letter from the city stating that the
City Council has approved the subd of the .13 acre tract of land in question. The
Council agreed provided that he submit a final survey with the irons clearly marked
on the survey and the legal description of the .13 acres identified on the survey.
Peltier made motion, Vail seconded, to approve the preliminary survey for Vern Peloquin
and waiver of the formal platting procedure for the following described property:
part of the SE4 Of Section 17, T31N, R21W, Washington County. This approval is
subject to the following special conditions:

1. A final survey must be submitted to the Council for approval within 90 days
of preliminary survey acceptance or this approval shall be null and void.
2. All conditions must be met prior to stamping of any deeds for recording by
the City Clerk unless otherwise permitted by Council action.
3. All fees relating to this subdivision approval shall be paid by the applicant
including recording documents with Washington County.
4. On-site activities permitted as a result of this subdivision shall not cause
the altering of any watercourse, ditch, or drainage system in this area.
5. No dwelling unit shall be permtted on this .13 acre tract of land unless this
entire building site meets the minimum width, depth, and lot area for the
zoning district.

8.B Preliminary Subdivision Survey (Laura Stoltzman)
Mrs. Laura Stoltzman has made application to the City of Hugo for a minor subdivi-
sion and waiver of the formal platting requirements involving a 40 acre tract of
land identified as the NE4 of the NE4 of Section 15, T31N, R21W, in the City of
Hugo. The property is located on the soutwest corner of 157thStreet and Ingersoll
Avenue. It is the intent of Mrs. Stoltzman to divide said property into four 10
acre tracts for residential purposes. The property is currently zoned agriculture
and is setting in idle acres. There is currently a dwelling on proposed Parcel A
of the preliminary survey, and it is our understanding that proposed Parcel D is to
be conveyed for the purpose of cosntructing a residential dwelling. All of the
areas surrounding the tract in question are zoned agriculture. This request was
reviewed at a public hearing of the Hugo Planning Commission on June 24, 1987,
at which time said Commission unanimously recommended approval of the minor
subdivision and waiver of the formal platting requirements subject to special
conditions.
Mrs. Stoltzman's son and daughter-in-law were present at this Council meeting
and stated that they had spoken to someone at the county assessor's office regarding
this application. They were informed that this subdivision would result in an
increase in the tax base for the property, and that Mrs. Stoltzman now wishes to
amend her application and is asking for the creation of a 10 acre tract and a 30
acre tract.
Atkinson made motion to table this application until the applicant decides what
her plans are for the division of the property.
Atkinson withdrew his motion.
Peltier made motion, Potts seconded, to approve the preliminary survey for Laura
Stoltzman and waiver of the formal platting procedure for the following described
property: the NEI of the NE4 of Section 15, T31N, R21W, Washington County,
Minnesota. This approval is subject to the following special conditions:
1. The property owner notify any future purchaser of the property that the site
in question was once a sanitary landfill which may affect soil conditions
and water quality in that area.
2. Final survey, indicating a 10 acre parcel and a 30 acre parcel, must be sub-
mitted to the Council within 90 days of preliminary survey acceptance or this
approval shall be null and void.

3. All conditions must be met prior to the stamping of any deeds for recording by
the city unless otherwise permitted by Council action.
4. Property lines must be identified on site by the applicant to assure proper
setbacks when buildings are constructed if required by the building inspector.
5. Any commercial or industrial use of said property not specifically permitted
in this zoning district shall be strictly prohibited.
6. Driveways or drainage areas must include installation of 15" minimum corrugated
culverts acceptable to the city.
7. No building permits are to be issued until the required permits are secured
from the appropriate watershed district, percolation tests are submitted to
the city, and approval is secured from the DNR for wetlands areas.
8. All fees relating to this subdivision shall be paid by the applicant, including
the cost of recording documents with Washington County.
9. Any driveway permits requiring access to highways or county roads may not be
issued until permits are secured from Washington County.
10. The use of this property will not be in violation of any restrictive covenants.
11. On-site activities permitted as a result of this subdivision shall not cause
the altering of any watercourse, ditch, or drainage system in this area.
12. Payment of parkland dedication fee ($125.00) must be made prior to the time of
final survey approval.
13. Issuance of deed approval or building permits shall be in compliance with the
above listed general conditions.

8.0 Public Improvement Project (Homestead Drive/Sunset Lake)
Pursuant to Chapter 429 of the Public Improvement Code, an application has been
made for the improvement of Homestead Drive, west of Sunset Lake, between the south
line of 130th Street and the north line of 125th Street, by the improvement of
bituminous surfacing, as per the petitioners. Previous Council action involved
declaring the adequacy of the petition and ordering preparation of a feasibility
report for this project by the City Engineer. Following review of the feasibility
report, if the Council wishes to move forward with this project, the appropriate
action would be to pass on a resolution receiving the feasibility report and calling
for a hearing on this improvement.
Tom Fast, representing Kuusisto Engineering, reviewed the feasibility study with the
Council. The improvement will cost an estimated $55,492.00,including contingencies,
with an estimated assessment cost of $1790.00 per lot or $8.35 per foot.
The cul-de-sac at the end of Homestead Drive and 125th Street to County Road 10 were
not included in this feasibility study.
Atkinson made motion, Peltier seconded, to adopt RESOLUTION 1987-38, A RESOLUTION
RECEIVING REPORT ON IMPROVEMENT FOR HOMESTEAD DRIVE/SUNSET LAKE BITUMINOUS SURFACING
PROJECT 1987-25.
8.D Special Use Permit/Gravel-Pit- (Goiffon/Hansen)
Mr. Andrew Goiffon has made application to the City of Hugo for the review of their
SUP allowing for the operation of a gravel pit and materials processing facility
in the SW4 of the NWr of Section 23, T31N, R21W. This matter was reviewed by the
Hugo Planning Commission onJune 24, 1987, at which time said Commission recommended
approval and continuation of the SUP.

8.E Mining Permit (Richard Schuh)
Mr. Richard schuh has made application to the City of Hugo for a Mining Permit
to operate a gravel pit and materials processing facility in the SW4 of the NW4
of Section 23, T31N, R21W. This request was reviewed by the Hugo Planning
Commission on June 24, 1987, at which time said commission recommended renewal
of the Mining Permit subject to special conditions. After review of the submitted
Mining Permit, the Council recommended the following changes be made:
Item 5 - Delete "crankcase oil"
Item 12 - Change times from 7:00 AM and 7:30 PM to 7:00 AM and 7:00 PM.
Atkinson made motion, Potts seconded, for the continuation of the SUP and approval
of the Mining Permit for Richard F. Schuh to operate a gravel pit and materials
processing facility at the Goiffon/Hansen pits, effective July 6, 1987 until
July 5, 1988, a copy of which is on file at the office of the City Clerk.

8.F Dike Improvement Project (Ed Fashingbauer)
In the fall of 1984, the city undertook a project to improve road conditions on
Goodview Avenue just north of 125th Street. For many years the city had problems
with flooding and road erosion on Goodview just north of the Fashingbauer home.
The city entered into an agreement with the Fashingbauers in the spring of 1984,
and the city proceeded to construct a dike and improve the ditch allowing for
better drainage in this area which resulted in improved road conditions. The
city constructed a small dike west of Goodview Avneue on the Fashingbauer
property to retain water in a ponding area located east and slightly north of
the Fashingbauer home. In the spring of 1987, the ponding area dried up and the
Fashingbauers feel that the water once held in the pond is seeping through the
dike constructed by the city and is draining into the ditch adjacent to Goodview
Avenue. They have requested that the city undertake a project, with the city
engineer's guidance, to correct this problem at city expense. City Adminstrator,
Ken Huber, reviewed this request with Howard Kuusisto and Tom Fast., who are
suggesting improvements to the dike that may correct this problem. Estimated
cost of the improvement if $1,000.00, which is not budgeted in 1987.
Tom Fast, present at the Council meeting, reviewed the history of the project,
as well as what steps could be taken to correct the problem. Kuusisto Engineering
is recommending that a 2' wide trench be dug out along the dike 4' deep and be filled
with a clay material. Mr. Tom Fast stated that they are not 100% sure that
this will totally alleviate the leeching.
Atkinson made motion, Vail seconded, that the City Council authorizes the expend-
iture of up to $1,000.00 to attempt to seal the area around the pipe opening and
dike as well as any other apparent deficiencies.

The Council recessed the meeting at 8:10 PM to observe a demonstration of the
hydro spreader by the Hugo Fire Department. The meeting reconvened at 8:22 PM.
9.A Volunteer Fire Fighter Resignation
Peltier made motion, Atkinson seconded, to accept the resignation of Jeffrey
Pearson from the Hugo Fire Department effective 6/1/87.
All aye. Motion Carried.
It was the consensus of the City. Council that, in the future, the Council be notified
of any such resignations, but no formal action will be required.

9.B Resignation from Board of Zoning Adjustment & Appeals
The city received a letter of resignation from Chuck Henry from the Board of Zoning
Adjustment & Appeals as a result of his recent appointment to the Hugo Planning
Commission. Mayor Atkinson will be meeting with Troy Sonnenfeldt regarding his
interest in filling the vacancy.
9.0 NSP Permit Request
Potts made motion, Peltier seconded, to approve Project No. HURCNAT-AAP for NSP.
All aye. Motion Carried.
9.D Potts vs. City of Hugo Court Appeal
Atkinson made motion, Peltier seconded, that the City of Hugo retain the law firm
of Magnuson and Dieperink to represent Hugo in the court appeal of Potts vs. City
of Hugo.
VOTING AYE: Peltier, Olson, Vail, Atkinson
ABSTAINED: Potts
Motion Carried.
11.0 Miscellaneous
Councilman Vail inquired about the status of cable TV for the City of Hugo. Administra-
tor Huber stated that he will review the file, and place this matter on the agenda
for the Council meeting of July 20th.
Potts made motion, Peltier seconded, to adjourn at 8:50 PM.
