MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL
August 3, 1987
The meeting was called to order by Mayor Atkinson at 7:03 PM.

Peltier made motion, Olson seconded, to approve the minutes for July 20, 1987,
as submitted.
All aye. Motion Carried.
Peltier made motion, Olson seconded, to approve the General Claims for August 3,
1987, in the amount of $11,294.23.
All aye. Motion Carried.
Peltier made motion, Olson seconded, to approve the Utility Claims for August 3,
1987, in the amount of $437.29.
All aye. Motion Carried.
5.A St. John's Church (Off -Sale Beer)
Peltier made motion, Olson seconded, to approve an Off -Sale Beer License to the
Church of St. John's for August 23, 1987 to be used in conjunction with their
annual Fall Festival.
All aye. Motion Carried.
7.A Minor Subdivision Survey (Lynn Carlson)
Mr. and Mrs. Lynn Carlson have made application to the City of Hugo for the subdi-
vision of property described as Lots 1 through 6, Blcok 10, Shadyside #4, in the
City of Hugo. The request made by Mr. Carlson is three -fold, and is being made
pursuant to Chapter 290 of the municipal code:
1. Waiver of the formal subdivsion requirements and allowing the subdivision on
land by certificate of survey.
2. Variance from the one acre lot size and front yard setback.
3. The resubdivision of the six existing platted lots in Shadyside #4 subdivision
into two buildable lots.
Total square footage of the property in question is approximately 31,620 square
feet, and is zoned SFE, requiring minimum one acre building lots. Both the
Planning Commission and City Council recommended approval of the preliminary
survey sketch subject to complaince with 320-5G of the city code, and all
setback requirements. The City Council also approved a variance from the minimum
one acre lot size. During the previous survey review, Mr. Carlson assured the
Planning Commission and Council that he could meet all lot dimensional requirements

for construction of a dwelling with the exception of the one acre minimum lot
size. In reviewing the final survey submitted by Mr. Carlson, it should be
noted that there are some substantial differences in lot depth and shoreline
location from the preliminary survey sketch. The original preliminary survey
sketch showed a lot depth of approximately 170' with an additional 70+ feet
to the lake shoreline. The final certificate of survey shows a maximum lot
depth of approximately 146' from Everton Avenue to the Bald Eagle Lake shoreline.
Our intial review would indicate that if Mr. Carlson is to meet the minimum
required 100' building setback from Bald Eagle Lake, and construct a standard
building of approximately 24' in depth, the front of the building would be
located only 4' from the road right-of-way on the south property line. It would
appear to be virtually impossible for Mr. Carlson to construct a dwelling unit
on this site without variances from the front yard setback and lake setback
requirements, when considering the lot depth changes from the preliminary survey
to the final survey. It should also be noted that the applicant must maintain
a minimum of 100' setback from shoreline in constructing an approved septic
system to serve any dwelling units on site. In an effort to demonstrate that
Parcel "B" of the certificate of survey is a buildable site, Mr. Carlson has
provided a sketch showing how a 24 x 34 home could be constructed on site. Mr.
Carlson has also provided a sketch prepared by Mr. Mark Peloquin showing how a
mound septic system can be located south of the proposed home. This septic
system was reviewed by the city engineer for his recommendations. The
sketch prepared by Mr. Carlson shows the house meeting the 100' setback require-
ment from the lake; however, it reflects only a 12' front yard setback from the
east property line. Mr. Carlson would need a variance from the front yard
setback allowing him to construct a home that would line up with homes both
north and south of the site in question. If the City Council approves the
survey, we would recommend it be done subject to the recommendations of the
city engineer and compliance with the sideyard setbacks, 100' setback from the
lake shoreline, as well as the ability to install an approved septic system not
of the holding tank type.
City Administrator, Ken Huber, received a call from the city engineer, this date,
with his recommendations for Parcel "B" should the Council approve the subdivision.
Mr. Huber reviewed the six conditions with the Council.
Peltier made motion, Olson seconded, to approve certificate of survey #8-3-87A
for the Lynn and Karen Carlson subdivision, waiver of the formal platting pro-
cedure, and two variances (lot area and front yard setback) for the following
described parcel of land: Lots 1 through 6, Block 10, Shadyside X64, Washington
County, Minnesota. Approval is subject to the following conditions:
1. No fill or buildings be allowed below the 913' elevation.
2. The well must be 50' from the septic system and 5' from the property line.
3. The septic system and house must be 100' from the Bald Eagle Lake shoreline.
4. The applicant shall submit a contour mep_of the site showing the mound septic
system designed prior to building permit. No holding tank will be permitted.
5. The house shall be located no closer to the road than the closest house
either side of ParcQl B.
6. There shall be no variance from the rear yard setback or side yard setback.

7.B Minor Subdivision (Vern Peloquin)
Mr. Vern Peloquin has made application to the City of Hugo for a minor subdivision
and waiver of the formal platting requirements for a .13 acre tract of land iden-
tified as a part of the SE4 of Section 17, T31N, R21W, Washington County. The
property in question is located east of Highway 61 immediately north of the Twin
Pine Trailer Court. The property is approximately 15.3' wide and 375' deep. The
Planning Commission has recommended approval of the survey and the preliminary
survey was subsequently approved by the City Council. We would recommend approval
of the final survey subject to compliance with any conditions.
Peltier made motion, Potts seconded, to approve certificate of survey #8-3-87B for
the Vern Peloquin subdivision and waiver of the formal platting procedure for the
following described parcel of land: Part of the SE4 of Section 17, T31N, R21W,
Washington County. Approval is subject to the following special conditions:
1. All conditions must be met prior to stamping of any deeds for recording by
the City Clerk unless otherwise permitted by Council action.
2. All fees relating to this subdivision approval shall be paid by the applicant
including recording documents with Washington County.
3. On-site activities permitted as a result of this subdivision shall not cause
the altering of any watercourse, ditch, or drainage system in this area.
4. No dwelling unit shall be permitted on this .13 acre tract of land unless this
entire building site meets the minimum width, depth, and lot area for the
zoning district.

8.A Special Use Permit (Krueger/Molitor)
Messrs. Chris Molitor and Stanford Krueger have made application to the City of
Hugo to allow construction of a 50' x 80' pole building (accessory building) in
an agriculture zone prior to construction of the principal building. Section 320-5,
Subd. H(1) of the zoning ordinance permits the construction of an accessory
building in a zoning district prior to a principal building by Special Use Permit.
The property in question consists of 40 acres and is identified as the NW4 of the
NE4 of Section 33, T31N, R21W, and was purchased on a contract for deed by Mr.
Stanford Krueger from Chris Molitor. Mr. Krueger states that it is his intent
to farm the,property in question and construct a pole building to house his
tractor and other fram equipment while operating, what he calls, a "gentleman's
farm". Mr. Krueger has stated that he has no plans to subdivide the 40 acres
in question, and has indicated that the property owner to the west of the site
has indicated his interest in extending 130th Street to the east at some time
in the future. At the Planning Commission meeting of July 22, 1987, Mr. Krueger
stated his plans are to construct a new home on the site in question either
this fall or some time in 1988. In 1986, the Hugo City Council entertained a
similar request to build an accessory building in advance of the principal
structure subject to special conditions of the permit. In the previous case,
the City Council required that a financial guarantee be posted by the applicant
guaranteeing that a home would be constructed prior to July 1,1987. The city
also required that no further subdivision of the property be permitted while
the permit was in effect. The Planning Commission recommended approval of the
SUP at their meeting of July 22, 1987 subject to certain conditions. Mr. Krueger
provided the city with a copy of a recorded 66'/easement assuring him permanent
access to the property in question. private roadway

Peltier made motion, Olson seconded, to approve the request of Chris Molitor
and Stanford Krueger for a SUP to construct a 50' x 80' pole building (accessory
building) in an agriculture zone prior to construction of the principal building.
Approval is subject to the following conditions:
1. A building permit for the pole building must be applied for within 120
days of the SUP approval. Substantial construction of any building and
improvements must be underway within 120 days of permit issuance.
2. Property lines must be identified on site by the petitioner to assure proper
building setbacks when constructed if required by the building inspector.
3. The building in question must be for storage of farm equipment related to
the farming operation, and no commercial or industrial use of the building
shall be permitted.
4. Driveways built over ditches or drainage areas must include the installation
of approved metal culverts in a manner acceptable to the city engineer.
5. No significant deviations from the approved site plan shall be permitted
unless reviewed by the Planning Commission and City Council followed by
an,amended SUP.
6. All fees relating to the review and issuance of this permit shall be paid
by the applicant including the recording costs at Washington County.
7. The property in question shall not be subdivided while this SUP is in effect.
8. The property owner shall permit access to the referenced site for periodic
inspections to assure conformance with this permit.
9. Failure to comply with all conditions of this SUP shall be cause for
revocation of said permit.
10. Construction of the principal residence must be substantially underway by
December 31, 1988.
11. A cashier's check or certificate of deposit, in the amount of $1,000.00,
payable to the City of Hugo, must be filed with the city to cover the cost
of building removal if home construction is not started by December 31, 1988.
Potts made motion, Olson seconded, to amend Item 11 changing the value of the
deposit from $1,000.00 to $2,500.00.

8.B Older Adult Home -Share Program Funding (Resolution)
In 1985, the City of Hugo entered into a Joint Powers Agreement with other communi-
ties in an effort to facilitate a home -share housing program sponsored by Lutheran
Social Services. The city's contribution to the program in 1986 was $215.00
and $143.00 in 1987. It is proposed that the city's participation in 1988 will
be ZERO. The concept of this program is to help older adults remain in their
homes longer than otherwise possible by securing suitable live -ins to assist them
with their day-to-day needs. The proposed resolution reaffirms the city's interest
to continue participation in this pilot program during the 1988 calendar year.

Potts made motion, Peltier seconded, to adopt RESOLUTION 1987-42, A RESOLUTION
OF INTENT TO REAUTHORIZE FUNDING FOR THE OLDER ADULT HOME -SHARE PROGRAM.

8.0 Road and Bridge Maintenance Agreement
In late July, 1987, the city received notice from Washington County that they have
revised our agreement for road and bridge maintenance for the 1987 and 1988 fiscal
years. The primary changes in the agreement are in the wage rates for employees
and equipment rental rates. The new wage rates are effective January 11, 1987, and
the new equipment rates are effective August 1, 1987. In reviewing the revised
rates, the mileage rate for vehicles increased from 250 and 330 per mile to the
new rates of 350 to 400 per mile, a 16% to 21% increase. The wage increases reflect
a 3% to 5% increase in 1987. The equipment rental rates are rather complicated and
lengthy, therefore,We have taken the three major types of equipment most commonly
used in the City of Hugo for comparison:
1. The single axle dump truck rates increase from $12.10/hour to $22.30/hour
reflecting an 84% increase.
2. The tandem axle dump truck rates increased from $13.75 hour to $19.10/hour
reflecting a 39% increase.
3. The motor grader rental rates increased from $19.80/hour to $23.00/hour
relecting a 16% increase.
The total 1987 budget for street maintenace, snow removal,.and bridge maintenance
was $166,300.00. That number reflects no increase from the 1986 budget of
$166,550.00. Assuming that the cost of street maintenance in 1987 was accurately
projected, the city should anticipate exceeding its street maintenance budget by
approximately 3% for labor, and approximately 30% ± for equipment rental in the
last four months of this year.
Councilman Potts felt that the city had no option other than to enter into the
new contract, but suggested that the city contact the county expressing our object-
ion to increases of this magnitude without any warning.
Olson made motion, Peltier seconded, authorizing the Mayor and City Clerk to
execute the revised Road and Bridge Maintenance Agreement, August 1, 1987 through
June 30, 1988, between the City of Hugo and Washington County.

11.0 Miscellaneous
Atkinson made motion, Olson seconded, to add the matter of public improvement on
125th Street/130th Street/Homestead Drive to the agenda.
All aye. Motion Carried.
Mr. Bob Anderson was present at the meeting to present a new petition to the Council
with more than 35% of the front footage for the public improvement of paving 125th
Street/130th Street/Homestead Drive. He stated that the property owners have agreed
that the assessment should be by a per lot assessment rather than by front footage.
Atkinson made motion, Potts seconded, that the City Council accept the petitioner's
verbal request to withdraw the petition for public improment on Homestead Drive
previously submitted and scheduled for public hearing.

request for public improvements on 125th Street and 130th Street.

Atkinson made motion, Peltier seconded, to adopt RESOLUTION 1987-43, A RESOLU-
TION DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT FOR
HOMESTEAD DRIVE WEST SUNSET LAKE PROJECT.
