PRESENT: Hauer, Potts, Schwab, McAllister Engineer, Howard Kuusisto ABSENT: Peltier 3.0 APPROVAL OF MINUTES MOTION: Schwab made motion, Hauer seconded, to approve the minutes of January 6, 1986, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Potts made motion, Hauer seconded, to approve the General Claims for January 21, 1986, as submitted. All aye. Motion Carried. MOTION: Hauer made motion, Schwab seconded, to approve the Utility Claims for January 21, 1986, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Dave Truex - Brown's Creek Watershed District Mr. Truex was unable to attend tonight's meeting, and has requested he be placed on the agenda for the Council meeting of February 3. 5.3 Harstad & Associates - Rezoning The Clerk spoke with Ken Briggs of Harstad, and Mr. Briggs stated they were not yet ready to appear before the Council and requested an "indefinite" extension. MOTION: Hauer made motion, Schwab seconded, to grant an extension to Harstad and Associates until May 19, 1986, at which time action will be taken on their application for a rezoning. ENGINEER Because of inclement weather, Engineer Kuusisto' matters were discussed so he could leave the meeting. Howard stated that he had heard from Washington County in that will be making application for funding for replacement of bridges on Elmcrest Avenue and the north end of Bald Eagle Lake. The city will need some kind of agreement with Lino Lakes prior to any repairs because of our common borders. Hugo would be respon- sible for engineering costs and demolition, and the other costs would be paid for by the county. January 21, 1986 The county will be making application at this time for the Bald Eagle bridge. The Elmcrest bridge can be submitted later after an agreement is signed. MOTION: Hauer made motion, Schwab seconded, authorizing the City Engineer to request Washington County to submit an application for funding for re- placement of the brdige on the north end of Bald Eagle Lake, and for him to prepare plans and specifications. Mr. Kuusisto to negotiate an agreement with Lino Lakes, in cooperation with the City Attorney, for the replacement of the bridge on our common border (Elmcrest Ave). All aye. Motion Carried. Councilman Hauer will be in contact with Howard regarding the Kubitschek/Peterson lots on Bald Eagle Lake. 5.2 Roger Schadt - Boy Scount Troop #151 Mr. Schadt was present to express concerns his Scout Troop has over the recent mailing sent by the Forest Lakes Area Recycling Center. Hugo's largest fund- raiser is the paper drive, and they feel people are going to be confused because of the card inserted in the mailing identifying another Boy Scout troop. Mayor McAllister assured Mr. Schadt that Hugo would support Hugo's troop if they came in with some kind of plan for a "recycling" center. The Council was agree- able to holding a special meeting to discuss their plans, and figure out how to have it implemented. HUGO LIONS CLUB The Lions Club would like to conduct a radar run on Egg Lake, February 9. This matter was to be discussed at the last PC meeting, but no meeting was held for lack of a quorum. Because they need a commitment to go ahead with their plans, o it is necessary for the Council to consider their request this evening. MOTION: McAllister made motion, Hauer seconded, to grant a SUP to Hugo Lions Club to conduct a radar run on Egg Lake on February 9, 1986, subject to the following conditions: 1. The club contact Scott Malinowsky, Washington County Sheriff's Dept., and, if necessary, obtain a permit. 2. Provide evidence of liability insurance. 3. Reimburse the city one-half the cost of an off-duty peace officer. 4. Fee for SUP is waived. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, that the City of Hugo hire on its payroll, an office of the Washington County Sheriff's Office, to police the radar run to be held on February 9. The office will be covered by the city's insurance for workman's comp and vehicle. All aye. Motion Carried. Mayor McAllister discussed the availability of gambling operations within the city's liquor establishments. He felt the city should possibly consider previous appli- cations should the local organizations express interest in the near future. January 21, 1986 FIRE CHIEF The City has received an application for appointment to the Fire Department from Mike Nelson. Previously he had been a volunteer for 4 years, but has been on a leave of absence. Fire Chief, Ron Istvanovich, stated that he had been an active member, and would recommend his reappointment. MOTION: Potts made motion, Schwab seconded, to approve the appointment of Mike Nelson to the Hugo Fire Department. All aye. Motion Carried. There was further discussion relating to the ambulance service provided by District Memorial Hospital, and a recent article in the Forest Lake Times. MOTION: McAllister made motion, Hauer seconded, to send a letter to John Jergens, 1st District Commissioner, asking that he discuss matters with the Hugo City Council before making any recommendations for the City of Hugo. VO'T'ING FOR: Hauer, Schwab, McAllister ABSTAINED: Potts (did not read article) Motion Carried. ADDI`1'IONAL REGULAR COUNCIL MEETINGS MOTION: McAllister made motion, Schwab seconded, to schedule an additional regular Council meeting for February 3, at 6:15 PM, to hear a presentation from Dr. Gary Mayer regarding the hepatitis inoculation program, and any other appropriate city business. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, to schedule an additional regular Council meeting for March 3, at 6:15 PM, to discuss the 1985 audit with the City's auditors, and any other appropriate city business. All aye. Motion Carried. COMPREHENSIVE PLAN MOTION: Potts made motion, Schwab seconded, to pay the Washington County Planning Department $3215.00 for work performed on the city's Comprehensive Plan. Ail aye. Motion Carried. 5.4 Wally Otto - 8:00 PM The city's Building Inspector notified the Counil that he had observed a newly con- structed building on the Walter Otto property, 13624 Isleton Avenue, and that no Site Plan had been approved or Building Permit applied for. For the record, Mr. Otto, present at the meeting, was informed that all meetings are tape recorded. Mr. Otto stated he was denied a permit in 1981 because he did not own recently purchased property (15 acres). He stated that the land is now paid for. He acknowledged that he has constructed a 54 x 90 pole building, but did not feel a building permit was 10 January 21, 1986 Walter Otto - cont. necessary because it was being used for agricultural purposes. Mr. Otto stated that previous Mayor, Marvin LaValle, had stated that if you own 20 acres you could fill the property with buildings. Otto did not state whether LaValle had mentioned anything about the need for building permits. McAllister asked Otto if he had made any attempt to contact the City Clerk or Building Inspector prior to construction, and he responded "no". McAllister inquired as to how Mr. Otto would feel about removing the building, and Otto responded, "The building will not come down". MOTION: McAllister made motion, Schwab seconded, that this matter be forwarded to Attorney Sarah Mardell to investigate whether the construction of this building is grounds for a misdemeanor charge. MOTION: McAllister made motion, Schwab seconded, an amendment to this motion that if the Attorney discovers violation of a building code or a zoning ordinance that she is to file a formal complaint against Mr. Otto. AMENDMENT VOTING FOR: Schwab, McAllister VOTING AGAINST: Hauer, Potts Motion Failed ORIGINAL MOTION VOTING FOR: Hauer, Potts, Schwab VOTING AGAINST: McAllister Motion Carried. MISCELLANEOUS MOTION: McAllister made motion, Hauer seconded, that Richard Vail and the First State Bank of Hugo be notified that Vail's Letter of Credit must be�--- renewed. The City would draw on the Letter of Credit rather than allow to expire. All aye. Motion Carried. Francis Lander, the city's assessor, was present to explain the formula the state uses to determine mill rates. Hugo's tax will increase by 8 mills, and Mr. Langer explained how the increase would affect different market valued houses. McAllister felt the explanation would be beneficial prior to the issuance of real estate taxes. MOTION: Potts made motion, Schwab seconded, to adjourn at 9:10 PM. All aye. Motion Carried.
