PRESENT: Hauer, Peltier, Potts, Schwab, McAllister 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of April 7, 1986, after the following change has been made: Page 44 (9.1) - A copy of the letter is to be sent All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Potts made motion, Peltier seconded, to approve the General Claims for April 21, 1986, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the Utility Claims for April 21, 1986, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Cyril LaCasse - Subdivision Charlie LaCasse, representing Cyril, was present to submit a certificate of survey for the newly created lots (2). Engineer Kuusisto's office inspected the site for review of possible drainage problems, and reported that the site proposed none. The Planning Commission recommended approval, and waived the hardshell requirement. MOTION: Peltier made motion, Potts seconded, to approve the subdivision request of Cyril LaCasse to subdivide approximately 37 acres into 3 separate parcels. Approval of division is subject to payment of $200.00 parkland dedication fee. All aye. Motion Carried. 5.2 John Bergman - Subdivision MOTION: McAllister made motion, Hauer seconded, to table application until later in this meeting and the next regular Council meeting. All aye. Motion Carried. 5.4 John Gross - Variance Mr. Gross has proposed the construction of a pole barn closer to 170th Street than the principal structure. His building site is a substantial distance from the road and should be no problem. The Planning Commission recommended approval. 48 April 21, 1986 MOTION: Peltier made motion, Schwab seconded, to approve the application of John Gross for a variance to construct accessory building closer to road than the principal structure. MO'T'ION: McAllister made motion, Schwab seconded, to amend the previous motion to include the pole barn is for personal use only. AMENDMENT - All aye. Motion Carried. MAIN MO'T'ION - All aye. Motion Carried. 5.3 Don Sempel - Subdivision Mr. Sempel, Safeway House Movers, is proposing the division of lots B and C lying along 165th Street. An unsigned certificate of survey and proof of ownership was sbumitted. The Planning Commission recomiended approval. MOTION: Potts made motion, Peltier seconded, to approve the subdivision request of Don Sempel to create Lots B and C, contingent upon submission of a signed Certificate of Survey. No parkland dedication for Industry. All aye. Motion Carried. 5.5 Hugo Lions Club - Good Neighbor Days (On sale non -intoxicating Liquor) Bill Monahan, representing the Lions, submitted a letter stating that June 6, 7, and 8 has been designated as Hugo GOOD NEIGHBOR DAYS. MOTION: McAllister made motion, Peltier seconded, to reserve the City Park on June 6,7,8, 1986 for the Lions' GOOD NEIGHBOR DAYS, and to issue them an ON SALE NON -INTOXICATING LIQUOR LICENSE for those days. Motion Carried. 5.6 American Legion Auxiliary - Gambling License MOTION: Hauer made motion, Potts seconded, regarding the American Legion's re- quest for a Gambling License, that the City Council do absolutely nothing. All aye. Motion Carried. 5.7 Forest Lake Youth Service Bureau - Purchase Service Agreement MOTION: Peltier made motion, Hauer seconded, to table this matter until Charles Johnson has reviewed and commented. All aye. Motion Carried. 5.8 Washington County Road Maintenance Agreement MOTION: Schwab made motion, Hauer seconded, to authorize the Mayor and Clerk to sign the Road Maintenance Agreement for 1986-87. All aye. Motion Carried. RAi April 21, 1986 MOTION: McAllister made motion, Potts seconded, that Mrs. Peltier be in charge of screening invoices before being placed on agenda for claims. All aye. Motion Carried. BALD EAGLE BRIDGE PROTECT MOTION: McAllister made motion, Hauer seconded, that the engineer be given the authorization to hire surveyors for the Bald Eagle bridge program. All aye. Motion Carried. Mr. Seever, Oneka Lake Blvd., had contacted Councilman Potts regarding flooding as a result of the releasing of water from Oneka Lake. It was suggested, and Mayor McAllister concurred, that the placing of benchmarks to indicate water levels would be a good idea. George and Kathy Schtowchan, 7041 Oneka Lake Boulevard, were present and expressed concern with the possibility of flooding on their property when the ditch project, releasing water from One-ka Lake, is implemented. Fred Hummel, 7225 Oneka Lake Boulevard, was also present and requested the city to provide a written statement regarding specifics relating to the project. He wa concerned that when the present Council no longer exists, it is important that thepple are informed. Mr. Hummel did not want the e -ate of water discharged to exceed the level of the existing culvert. Mayor McAllister asked that Mr. Hummel write down his concerns and submit to the City Engineer for his recommendation tothe city. MOTION: McAllister made motion, Peltier seconded, to adopt RESOLUTION 1986-5, A RESOLUTION AUTHORIZING THE CITY LEGAL STAFF TO INITIATE FORMAL CONDEMNATION PROCEEDINGS TO OBTAIN PROPERTY OWNED BY ALEX AND/OR TAMARA ZALUCKYJ AS ATTACHED AND DESCRIBED AS EXHIBIT "A" (CERTIFICATE OF SURVEY) AND EXHIBIT "B" (LEGAL DESCRIPTION). AND BE IT FURTHER RESOLVED, THE CITY LEGAL STAFF IS DIRECTED TO PETITION THE COURT FOR ACCESS TO THE PROPERTY AS QUICKLY AS MAY BE ALLOWED BY LAW. All aye. Motion Carried. The following is an itinerary for this project: 1. The survey and legal description should be completed by end of the week of 4/21/86. 2. On April 28, there will be a staff meeting at Howard Kuusisto's office (legal and engineering) to sign the documents for condemnation. 3. Before May 19, we are going to try and get the documents filed at Washington Cty. 4. Once we file the documents, the question is whether we have to wait 90 days to file a court injunction - hopefully not. If we can file during the 90 day period, the earliest we could get possession of the property is August 18. 5. After the sealed bids are opened on May 19, there is 105 days that we must give a start workorder. That will take us to September 1st. MISCELLANEOUS MOTION: McAllister made motion, Scwhab seconded, that Councilmen Hauer and Schwab draft a new ordinance containing provisions as to the dollar amount for parkland dedication and report to the Council within 60 days. All aye. Motion Carried. 50 April 21, 1986 FIRE CHIEF MOTION: Schwab made motion, Peltier seconded, that the Fire Chief be authorized to expend $865.00 to send 8 men to the State Fire School. All aye. Motion Carried. Istvanovich stated that Granger's are burying oil tanks in the area of their new construction. He suggested that an ordinance be adopted requiriring all abandoned tanks be removed. He will be checking on sample ordinances to be presented to the Council. 7.0 UNFINISHED BUSINESS 7.1 Bruce Bernin - Financing Mr. Bernin was informed of the previous action to adopt RESOLUTION 1986-5, and informed of the steps that are to follow. 9.0 ATTORNEY AND ENGINEER Messrs. Johnson and Kuusisto made available their monthly reports. MORE MISC. The neighbor across the street from Mrs. Peltier was present to discuss the "beaver" problems around the vicinity of his property. Councilman Hauer discussed the Kubitschek/Peterson property on Bald Eagle Lake, and hoped that Charles Johnson would have a report to make at the next meeting after review of the Kubitschek abstract.
