PRESENT: Hauer, Peltier Potts, Schwab, McAllister 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of June 16, 1986, after the following correction has been made: Page 76 (Chas. Sibley) - sign a draft made out to Rose Sibley for any funds owed to Charles Sibley. All aye. Motion Carried. MOTION: Schwab made motion, Potts seconded, to approve the minutes of the Special Meeting of June 28, 1986, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Potts seconded, to approve the General Claims for July 7, 1986, as submitted. All aye. Motion Carried. For the record, the claim for $2,000 to the Relief Association covers $1,000.00 budgeted in 1985 but never paid, and the $1,000.00 budgeted for 1986. MOTION: Schwab made motion, Peltier seconded, to approve the Utility Claims for July 7, 1986, after the following additions have made: Cliff Crandall and Alan Flater - $202.50 for each All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Williams Bros. Pipeline Spill (Afton) William Bros. is proposing the hauling of contaminated soil from Afton (fuel oil #2) for application in Hugo. The property is owned by W. & G. Rehbein, and is located in the upper northwest corner of Hugo. Representatives from MPCA, Joe Magner, Kevin Faus, and Pat Madler, were present, along with representatives from William Bros., and Leggette, Brashears & Graham, consulting ground -water geologists. Approximately 7,000 square yards of soil would be transported to the Rehbein property. After review of conditions submitted by concerned parties, the City will further consider the con- ditions and continent at a later time. MOTION: McAllister made motion, Peltier seconded, that the City of Hugo prepare a policy letter, to be approved by the City Council at its next regular meeting, containing the conditions outlined by the City Engineer this evening, along with conditions of MPGA, Washing County Public Health, and any other conditions that may be incorporated in the policy letter by the City Attorney, prior to the next City Council meeting. An additional regular meeting will be scheduled 7 � July 7, 1986 Pipeline - cont. for July 21,1986, at 6:00 PM, to review this policy letter and submit for a vote. VOTING FOR: Hauer, Peltier, Schwab, McAllister VO'T'ING AGAINST: Potts Motion Carried. ONEKA LAKE - STATUS REVIEW' MO'T'ION: McAllister made motion, Peltier seconded, that the Plan of Operation as submitted to RCWD and the DNR, dated June, 1986, for Project 8611, shall be amended to read as follows (Page 1, No. 1): 1. The valve shall remain closed during those periods when the water in HardHx)od Creek is within (922.0 msl) of the top of the south end of 72" culvert located on 157th Street or when Oneka Lake is at or less then 930.5 msl. All aye. Motion Carried. MOTION: Potts made motion, Schwab seconded, authorizing the Mayor to hire a person to dynamite the beaver dams located in Hardwood Creek south of 157th Street. All aye. Motion Carried. MOTION: Potts made motion, Peltier seconded, authorizing the Mayor to hire a person to trap beavers in Hardwood Creek south of 157th Street. All aye. Motion Carried. 5.2 Harlee Anderson - Resubdivision Mr. Anderson is proposing the resubdivision of land recently divided by Charles Shubat. There was discussion regarding the upgrading of Fiona Avenue, as it is the only road in Hugo that is impassable in the spring. Mr. Anderson submitted a pro- posal with a cost of $7,000 to improve the road compared to an estimate of approxi- mately $35,000 as submitted by the City Engineer. MOTION: McAllister made motion, Schwab seconded, to approve the subdivision of Harlee Anderson to divide 22.8 acres into 3 parcels (File No. 1986-21) with all PC recommendations. The applicant is to bring Fiona up to the standards as recommended by the City Engineer as described in his letter of May 28, 1986. McAllister withdrew his motion. MOTION: Potts made motion, Hauer seconded, to approve the subdivision application of Harlee Anderson (1986-21) subject to the conditions of the PC, and that the applicant shall comply with Kuusisto's letter dated May 28, 1986 regarding the upgrading of Fiona Avenue. Potts and Hauer withdrew their motion. July 7, 1986 Harlee Anderson - cont. 79 MOTION: Hauer made motion, Schwab seconded, to approve the subdivision application of Harlee Anderson (1986-21) to divide 22.8 acres into 3 parcels, subject to the following conditions being met: 1. A registered certificate of survey be submitted. 2. Proof of ownership is provided. 3. The south one half of 125th Street be dedicated to the easterly property line of the subdivision. 4. Parkland dedication, in the amount of $100.00, be paid. 5. At the present, it is the opinion of the City of Hugo that Fiona is an impassable road, and may be so posted. VOTING FOR: Hauer, Schwab, McAllister VOTING AGAINST: Peltier, Potts Motion Carried. 5.5 Elsie Jasinski - Subdivision Mrs. Jasinski is proposing the subdivision of the recently created 10A parcel located at the southeast corner of Greystone and 175th Street. The Council stressed fact that the City cannot subdivide property when existing buildings would cross property lines. Mrs. Jasinski stated for the record that she would allow her son, Mike, to tear down the necessary buildings as requested by the city. MOTION: McAllister made motion, Peltier seconded, to approve the subdivision application Of Elsie Jasinski to divide 10A into 2 5 acre parcels, subject to the fol- lowing conditions: 1. The applicant pay a parkland dedication fee of $100.00. 2. The applicant, by accepting this subdivision, agrees that the two (2) buildings extending across property lines of parcel B, as indicated on Certificate of Survey dated March 8, 1985, will be removed. 3. The deed is not to be recorded until the Building Inspector certifies that the buildings have been removed. 4. Suhmission of a new Certificate of Survey. VOTING FOR: Hauer, Scwhab, McAllister VOTING AGAINST: Peltier, Potts Motion Carried. MOTION: McAllister made motion, Potts seconded, to grant a Special Use Permit for Mike Jasinski to construct a 40 x 63 pole building. The Building Inspector is authorized to release the Building Permit required for SUP (1986-25) after the City Clerk has certified to him that she has received a Letter of Credit of cash deposit, in the amount of $2,000.00, to guarantee to the City of Hugo that both buildings that are on the property line will be removed no later than October 31, 1986. All aye. Motion Carried. 5.4 Merila & Associates - Rezoning Merila & Associates, representing Keith Harstad, is proposing the rezoning of 25.8 acres from SFE to SFU. The present proposal is downscaled from a previous request. The land will incorporate 57 homesites, nine of which have already been approved. The Council touched on some of the things that will need to be addressed for subdivi- sion, assuming the rezoning is a p proved. July 7, 1986 Harstad - cont. The Planning Corrmi.sion held an additional public hearing with little opposition to the downscaled version. They recommended approval of the application. MOTION: Schwab made motion, Hauer seconded, to adopt ORDINANCE 1986-233, AN ORDI- NANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY. VOTING FOR: Hauer, Peltier Schwab, McAllister VOTING AGAINST: Potts Motion Carried. Mayor McAllister stated that he would look favorably upon their petitioning the City to oversee the project to insure that the project was completed to the satis- faction of the City. This was also the consensus of the Council. 5.6 Howard Moe - Subdivision Mr. Moe is proposing the division of apXoximately 2.3 acres into 5 parcels along with Outlot A. A 28.93' drainage easement is designated on the Certificate of Survey, but there is no mention of the easement in the legal description. Mr. Moe has 120 days in which to have the milar prepared. MOTION: McAllister made motion, Hauer seconded, to approve the preliminary plat for GARLEY ADDITION, dated 6/25/86, signed by Don W. Schmidt. Approval is subject to final final plat containing a written legal description of the drainage easement on the east side of Lot 1, Block 1. The Mayor and City Clerk are authorized to sign the final plat. All aye. Notion Carried. 5.7 Eugene Shultz - Renew of Nubile Home Permit MOTION: Potts made motion, Peltier seconded, to renew the Nubile Homer Permit for Eugene Shultz for a 90 day period. All aye. Motion Carried. 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee - No discussion 6.2 Planning Commission - No discussion 6.3 Building Inspector - No discussion 6.4 Fire Chief MOTION: McAllister made motion, Schwab seconded, authorizing the Fire Chief to repair the brakes on #3 truck, not to exceed $1,000.00 All aye. Motion Carried. A-'; C l prk MOTION: McAllister made motion, Peltier seconded, that the City do nothing with the Gambling License application for the Church of St. John the Baptist. All aye. Motion Carried. .68" July 7, 1986 MOTION: McAllister made motion, Peltier seconded, to extend the Special Use Permit for Leo Lutz until December 31, 1986. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, that Peter Kluegel, Plumbing Inspector, be directed to write or call Peter Greiskalns to set up an appointment to inspect the septic system at his rental property at 8726 122nd Street. The inspector is to submit a report indicating what action should be taken if the system proves to be inoperative. If system is not inoperative, the inspector is to advise the complaintant and the City Council. All aye. Motion Carried. CITY MANAGER The convdttee that visited Mankato State University to meet with Dr. Barrett reported was transpired at the meeting. MO`T'ION: McAllister made motion, Potts seconded, to extend the meeting past 11:00 PM. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, to schedule a public hearing for July 21, 1986, at 7:30 PM, to consider an ordinance establishing the office of City Administrator for the City of Hugo under statutory Plan A. All aye. Motion Carried. Councilman Hauer was directed to establish a "job description" for a City Administrator. MISCELLANEOUS MOTION: McAllister made motion, Potts seconded, to increase the salary of Mary Ann Creager by 50� per hour effective August 1, 1986. All aye. Motion Carried.
