PRESENf: Hauer, Peltier, Potts, Schwab, McAllister Attorneys, Charles Johnson and Jack Hennen Engineer, Howard Kuusisto WILLIAMS PIPELINE SPILL Williams Brothers is proposing the hauling of fuel contaminated oil to Rehbein property located at 180th Street and Elmcrest. Mayor McAllister, Charles Johnson, and Howard Kuusisto drafted a policy letter, along with 14 conditions, and submitted them to the Council for their action. MO'T'ION: Peltier made motion, Schwab seconded, to adopt the submitted policy letter, along with the 14 conditions, and forward them to W & V Rehbein. The Mayor is authorized to sign policy letter. VOTING b`OR: Hauer, Peitier, Schwab, McAllister VOTING AGAINST: Potts Motion Carried. Michael Granger, representing the Rehbein Company, verbally withdrew his request to have the contaminated soil hauled to the Rehbein property in Hugo. He also stated that the Rehbein Company will reimburse the City for all costs incurred regarding the request. MOTION: Potts made motion, Hauer seconded, that the City of Hugo accept Rehbein's request to withdraw their request to farmland contaminated soil on their property in the City of Hugo. Ali aye. Motion Carried. 3.0 APPROVAL OF MINUIES MOTION: Schwab made motion, Peltier seconded, to approve the minutes of July 7, 1986 as surmi.tted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MUTION: Peltier made motion, Schwab seconded.,. to approve the General Claims for July 21, 1986 as submitted. All aye. Motion Carried. MOTION: Potts made motion, Peltier seconded, to approve the Utility Claims for July 21, 1986 as submitted. Ail aye. Motion Carried. 84 July 21, 11986 5.0 PETITIONS, REQUr;STS, 0,D&MUNICATIONS & LICENSES 5.1 Anderson Brothers - Extension of Nicht Hours Mayor McAllister stated that Anderson tsrothers is considering bedding on another project witn the possibility of approaching the City with another request for nighttime hours. John Erickson, representing Anderson Brothers, stated that this time he would like to get permission and conditions stipulated before they bid on another project. At this point in the meeting, numerous neighboring residents affected by the hotmix operation, voiced their displeasure�Efle noise and traffic. There were also many convents regarding the speed of the trucks as well as allegations of carelessness. Deputy Brian Nelson was present and stated that the Sheriff's office is well -aware of the complaints, and have been watching the trucks carefully. He felt that most people feel that the trucks are speeding because of their size. They have been monitoring the speed, and have found that the great majority of trucks are well within the speed limits. Connie Crever and Marvin LaValle were present, and disagreed that the trucks were a nuisance and that they were speeding. It was their opinion that Anderson Bros., is doing a superb job. Mr. Erickson, if he so chooses, can approach the City for a variance to the Mining Permit's hours of operation should Anderson Bros., be awarded with a future bid. 5.3 Dead Tree in Park MOTION: McAllister made motion, Peltier seconded, that Charles Schwab, Parks Conr,iissioner, be authorized to have dead tree removed from the park. All aye. Motion Carried. 5.4 Oneka Lake Status Report The City has drafted a Stipulation for Dismissal because of its inability to obtain a reasonable permit from the Minnesota Department of Natural Resources. MOTION: Schwab made motion, Peltier seconded, authorizing the Mayor to sign the Stipulation Agreement between Alex and Tamara Zaluckyj, Marcel Miron and Joyce Seever, and the City of Hugo. All aye. Motion Carried. Councilman Potts made a statement expressing his regrets thathe project could not be completed, as well as sympathy for the people adversely affected by the high water. MOTION: Peltier made motion, Schwab seconded, that the City of Hugo accept the letter read by Mayor McAllister as Hugo's official policy regarding the action for dismissal for condemantion. All aye. Motion Carried. 5.2 City Administrator Position The public hearing to consider an ordinance establishing the position of City Administrator was called to order at 8:20 PM. There was no one present to make comment, and no written comments were received. The public hearing closed at 8:21 PM. July 21, 1986 CITY ADMINISTRATOR A draft ordinance establishing this position was reviewed by the Council and Attorney, Charles Johnson. Appropriate changes were made in the draft proposal. MOTION: Hauer made motion, Schwab seconded, to adopt ORDINANCE 1986-234, AN ORDINANCE AMENDING CHAP'T'ER 20 OF THE CITY CODE OF HUGO, ESTABLISHING THE OFFICE AND POSITION OF CITY ADMINISTRATOR IN THE CITY OF HUGO, AND DEFINING THE DUTIES AND RESPONSIBILITIES OF THE CITY ADMINISTRATOR. VOTING FOR: Hauer, Potts, Schwab, McAllister VOTING AGAINST: Peltier Motion Carried. MOTION: Schwab made motion, McAllister seconded, that the City proceed to hire a City Administrator on a full-time basis. Full-time to be defined by the Selection Committee - comparable to a 40 hour week. VO'T'ING FOR: Hauer, Schwab, McAllister VOTING AGAINST: Peltier, Potts Motion Carried. MOTION: McAllister made motion, Schwab seconded, to appoint James Hauer, George Atkinson, and Marvin LaValle to serve on a screening committee to fill the position of City Administrator for the City of Hugo. The required advertisements shall be published in the city's official newspaper, St. Paul/Minneapolis newspapers and Minnesota Cities. The committee shall report to the City Council at the regular meeting of October 6, 1986, with three (3) qualified candidates. VOTING FOR: Hauer, Peltier, Schwab, McAllister VOTING AC-,AINST: Potts Motion Carried. 9.0 ATTORNEY AND ENGINEER Attorney Johnson is to draft a letter to the attention of Willard Harley regarding the status/history of the Frank Kubitschek property. Engineer Kuusisto sulmutted his monthly report. Marvin LaValle was present and requested the City keep itself informed regarding the future drainage of Bald Eagle Lake as it relates to probable water problems for property owners downstream. MOTION: McAllister made motion, Schwab seconded, that the City Clerk write a letter to Mayor Benson, Lino Lakes, informing him that Rice Creek Watershed District agendasand minutes are being mailed to Marilyn Anderson, City Clerk. I would suggest, as Mayor of his neighboring com=ity, that he discuss with the City Clerk the possibility of distributing copies of Rice Creek's communications to the members of his City Council. VOTING FOR: Peltier, Schwab, McAllister VOTING AGAINST: Potts, Hauer Motion Carried. 86 July 21, 1986 MOTION: McAllister made motion, Peltier seconded, that the City Engineer be authorized to release and return bid bonds and cash deposits for Project 8611 advising the contractors that the City of Hugo has offi- cially abandoned the project.
